HomeMy WebLinkAbout1965-03-24 Minutes• 177-2 BOARD OF ADJUSTMENT MINUTES The Board of Adjustment met in the City Council Room of the City Administration Building at 4:00 p.m., Wednesday, March 24, 1965. Members present: John I. Smith, George Bowen, J. F. Robinson, J. A. Pennington and James Kerlin. All Board members were present. Others present: Reverend Charles R. Snow, applicant. Chairman John I. Smith called the meeting to order. The minutes of February 24, 1965, and March 3, 1965, were approved as written and mailed to the Board members. The application of Reverend Charles R. Snow, acting in behalf of the Trinity Temple, was the first to be heard. The variation requested by Reverend Snow was for the use of property located on the North side of Rolling Hills Drive and is more particularly described as beginning at the Northwest corner of Lot 14 of Block 1 of Oakland Hills Addition, thence west 300 feet, thence South 400 feet to Rolling Hills Drive, thence East along the North curb of Rolling Hills Drive to the Southwest corner of Lot 17 of Block 1 of said Oakland Hills Addition, thence North to the point of beginning. The applicant requested permission to construct a new church complex upon the property. Church use is permitted in the C-2 Thoroughfare Commercial zoning district upon review by the Board of Adjustment after a public hearing is held. The applicant • proposed to provide more than enough lot area, front yard setback, west yard setback, rear yard setback and off-street parking; however the proposed construction would be only 10 feet from the east side yard. Reverend Snow made clear a few points which were shown on the material mailed to the Board members. The Trinity Temple owns also lot 14 to the east; therefore 3 acres of lot area was available. The building wall would be 20 feet from the west property lines of lots 15, 16 and 17 to the east. A covered walk -way would be 10 feet from the property line. A master plan of present and future expansion of the church was shown to the Board members. The eventual church complex would be 10 feet from the east property line and 15 feet from the west property line. There was a lengthy discussion which followed. After the discussion the applicant was dismissed. 0 -- The last application brought before the Board of Adjustment was that of A. L. Shamblin. Mr. Shamblin requested a variation for the use of property located at 123 West Spring Street. This property is more particularly described as part of Lot 8 of Block 12 of Fayetteville Original Plat,and is located in an R-4 Multi -Family Residential and Dormitory District. The applicant requested permission to tear down his existing garage and build a • car port directly where the present garage now stands. The existing garage is closer to the east side yard property line than the five feet required by ordinance. 178-2 Chairman Smith reported that A. L. Shamblin would not be at the public hearing because of illness. As the Board members were familiar with • the application of A. L. Shamblin, the discussion was short. J. F. Robinson moved that the Board of Adjustment waive the requirements of the zoning regulations governing setbacks for accessory buildings in the R-4 Multi -Family Residential District and that A. L. Shamblin be issued a building permit for the construction of a new car port which is to be no closer to the east property line than existing garage which will be torn down. The motion was seconded by George Bowen and passed unanimously. The Board members felth that the new construction would not be the fire hazard the old garage was and the new car port would not degrade the appearance of Mr. Shamblin's residence and that of his neighborhs. In regard to the application of the Trinity Temple, J. A. Pennington moved that the Board of Adjustment not waive the setback requirements as requested by Reverend Charles R. Snow for the new church complex proposed, but that a building permit be issued for the proposed building if the setbacks required by ordinance are complied with. The motion was seconded by George Bowen and passed unanimously. It was the opinion of the Board of Adjustment that the 10 feet from the east side yard was too close to the property line and generally the 50 feet side yard setback requirement was too much; however unitl the zoning • regulations were amended new construction should conform to the present requirements of the zoning ordinance.
