HomeMy WebLinkAbout1965-03-03 Minutes175-2 BOARD OF ADJUSTMENT MINUTES • The Board of Adjustment met in the City Council Room of the City Administration Building at 4:00 p.m., Wednesday, March 3, 1965. Members present: , John I. Smith, James Kerlin and George Bowen. Members absent: J. F. Robinson and J. A. Pennington. Others present: W. R. Tester, applicant; Bill Green; C. A. Wynn, Robert C. Bigger and another representative of the Southside Baptist Church. The meeting was called to order by Chairman John I. Smith. The application of the Southside Baptist Church for the use of property located at the southeast corner of Dunn Avenue and Thirteenth Street was heard first. This property is more particularly described as lots 1 and 2 of Block 4 of Wilson -Dunn Addition to the City of Fayetteville, Arkansas, and is located in an R-2 Two Family Residential District, Robert C. Bigger explained that the construction of an addition onto the south side of the existing church building was proposed. This addition would be used for classrooms and for a recreation room. The proposed addition would be closer to the south side yard than permitted by • the zoning regulations in the R-2 zoning district. The encroachment upon the side yard requirement and the fact that the church building is located upon property with much less lot area than the 2 Acres required by ordinance are the only items for which a variance is requested. There was discussion on the number of parking spaces available and the number of exit's and entrances onto the property. Mr. Bigger explained that presently there is a drive off Thirteenth Street and consideration has been given for construction of a drive off Dunn Avenue. Only a portion of the rear yard is used for parking but additional area is available on the east (rear) of the building and could easily be made useable for parking. Since the maximum seating capacity of the main auditorium is 150 persons, the off-street parking required by ordinance would be 30 (10 ft. by 20 ft.) spaces. This off-street parking requirement could be complied with by the church. Chairman Smith inquired if any objections had been made to the application. It was reported that no objections had been voiced by anyone in the form of a letter, petition, or telephone call. There being no further questions or discussion, the applicant and others present regarding the Southside Baptist Church application were dismissed. The last application considered by the Board of Adjustment was that of Southwestern • Bell Telephone Company for the use of property located at 138 North East Avenue in a C-3 Central Commercial District. This property is more particularly described 176-2 as lots 2 and 3 of Block 14 of the Original Town Plat of the City of Fayetteville, Arkansas. • Bill Green and W. R. Tester of the Southwestern Bell Telephone Company explained the request. The construction of a two-story and basement addition onto the east side of the existing building was proposed. This addition would displace the existing off-street parking of the telephone company. W. R. Tester said that parking spaces will be needed for employees and company cars. There is an area in front of the building marked for customers. The company cars would be parked in the area only in the day time. The company employees could park in the city parking lot on the northwest corner of Meadow Street and East Avenue. Mr. Tester said that he had never seen this city parking lot over one-half full. Also Decon Wade had cleared an area for parking on the southwest corner of East Avenue and Spring Street and on the southeast corner of Spring Street and Block Avenue, Bill Green said the proposed addition was needed to house more equipment. A great deal of space is required for such equipment. Both Mr. Green and Mr. Tester said that additional property for off-street parking was being sought. There being no further discussion, Bill Green and W. R. Tester were dismissed. In regard to the application of W. R. Tester of Southwestern Bell Telephone Company, George Bowen moved that the off-street parking requirements of the zoning ordinance be waived and that the city parking lot on the northwest corner of Meadow Street and East Avenue being within 400 feet of the Southwestern Bell Telephone -.Company building be considered as off street parking for the telephone company as requested. The motion was seconded by James Kerlin and passed unanimously. In addition it was the recommendation of the Board that the Southwestern Bell Tebphone company seek additional property so as to furnish its employees with off-street parking. This property should be acquired before the area is built up solid with commercial buildings. James Kerlin moved that the Board of Adjustment approve the application of the Southside Baptist Church for the construction of an addition onto the south side of the existing church building; said addition to be closer to the south side yard than permitted by ordinance. The motion was seconded by George Bowen and passed unanimously. The Board suggested that in the event of future expansion of the church, additional property should be sought. The Board of Adjustment minutes of February 3, 1965, and December 16, 1964, were approved as written and mailed to the Board members. There being no further business, the meeting was adjourned.
