HomeMy WebLinkAbout1965-02-03 Minutes165-2 • BOARD OF ADJUSTMENT MINUTES The Board of Adjustment met at 4:00 p.m., Wednesday, February 3, 1965, in the City Administration Building. This meeting was held in the Decision Room of the Chamber of Commerce. Members present: John I. Smith, J. F. Robinson, J. A. Pennington, George Bowen and James T. Kerlin. All Board members were present. Others present: Frank Potts, applicant; Humphrey Heasty, applicant; Belle Dinwiddie, architect for H. Heasty; Carl Hurst, Director of the Youth Center; Harry Vr6ndergrif£, Richard Walden and Helen Edmiston, all members of the committee representing the Youth Center. The meeting was called to order by Chairman John I. Smith. Mr. Smith requested that the application of the Fayetteville Youth Center be heard first as it was of public interest. Mr. Carl Hurst, Director, had made application for a variation from the require- ments of the zoning regulations for the use of property on California Drive. This property is located northwest of the football field in Harmon Play Grounds and southeast of the present Youth Center building. This property is located in an R-2 Two Family Residential District. • The donstruction of the Youth'Center's swimming pool building is proposed upon the property. Publicly owned recreation facilities are permitted in the R-2 zone upon review and approval of the Board of Adjustment. Mr. Hurst stated that the building would be approximately 100 feet from California Drive. The building is over 100 feet in width and length. The pool itself will be about 77 feet by 42 feet. A committee consisting of Harry Vandergriff, Richard Walden and Helen Edmiston were present to represent the Youth Center. As the Board had few questions and there were no objections voiced at the meeting, the applicant was dismissed. Eel The next application considered by the Board was that of Mr. Frank Potts. Mr. Potts had requested permission to remodel and use a two-story frame structure for a 4 unit apartment house and small beauty salon. The building is located at 615 North College Avenue in a C-2 Thoroughfare Commercial District. Residential use (multi -family) is permitted in the Cpw commercial zone upon review and approval of the Board of Adjustment provided the residential use conforms to the area and setback requirements of the R-4 Multi -Family Residential and Dormitory District. . Mr. Potts told the Board that the remodeling would be on the interior. He explained that the two-story structure had been used for an apartment house 1 before it was converted to a commercial use when Ruth's Beauty College • was established. The beauty college has since been relocated as a larger lot was needed for the school. The "use" of the property was the only problem as all lot area, setback and parking requirements could be met for the 4 unit apartment hois e and the beauty salon. There being no further discussion, the applicant was dismissed. 0 Mr. Humphrey Heasty's application was the last one to be given consider- ation at the meeting. Mr. Heasty had requested permission to erect a new one-story six -unit apartment house upon the property located on the north side of South Street between Church Avenue and Locust Avenue. The property is located in a R-3 Multi -Family Residential District. The applicants proposed apartment building would be situated upon a lot which would be approximately 400 square feet short of the lot area required for 6 units; the building at its closest point would be 16 feet from the rear yard (north) property line instead of the 20 feet required by ordinance; and the off-street parking would be provided in the front yard rather than in the side or rear yard. Miss Belle Dinwiddie, architect, was present to answer any questions. • She pointed out that the lot line on the north was not straight as shown on the Board's drawing. The closest point of the building to the property line would be at the northeast corner and at this point the building would be 16 feet from the rear, yard (north) property line. After the public hearing, Chairman J. I. Smith reported to the Board that A. L. Shamblin, who had jointly filed an appeal with Mrs. Mabel A.Hort6n.for the construction of a two -car garage upon the property line between his lot and Mrs. Horton;s lot, had called. Mrs. Horton does not wish to build the garage as proposed in the application heard by the Board at a public hearing held January 13. Chairman Smith said he would check into Mr. A. L. Shamblin;s request to build his portion of the garage and would report to the Board of Adjustment at its next meeting.:, J. F. Robinson moved that the Board of Adjustment authorize the issuance of a permit for the construction of the Youth Center's swimming pool building as the use is bond fide and conforms t6.the yard and area • 167-2 • requirements of the R-2 zone and the use would traffic, endanger public safety or be injurious residential character of the neighborhood. The motion was seconded by James Kerlin and passed unanimously. After discussion, on motion by J. F. Robinson and seconded by James Kerlin, the Board of Adjustment unanimously voted to approve the application of Mr. Humphrey Heasty in which permission was requested to erect a one-story six -unit apartment house upon a lot approximately;400 square feet short of the required lot area, to erect the building within 16 feet of the rear yard (north) property line, and to provide off-street parking in the front yard.
