• BOARD OF ADJUSTMENT MINUTES
The Fayetteville Board of Adjustment met at 4:00 p.m., Wednesday, January 20,
1965, in the City Council Room in the City Administration Building.
Members present: John I. Smith, George Bowen and J. A. Pennington.
Members absent: J. F. Robinson and James T. Kerlin
Others present: Henry Shreve, applicant
The meeting was called to order by Chairman John I. Smith.
The minutes of the meeting of January 13, 1965, were approved as written
and mailed to the members of the Board of Adjustment.
The only application to be considered by the Board was that of Mr. Henry
Shreve for the use of property located on Missouri Way,
Mr. Shreve requested permission to build a new residence closer to the rear
(north) property line than permitted by the zoning ordinance. The new residence
would be approximately 19 feet from the property line in§tead of the 30 feet required
by ordinance in the R -1B Single Family Residential District.
The applicant explained to the Board members that because of the shallowness of
• the lots and because of the topography he could not comply with the rear yard
setback required by the zoning ordinance. He pointed out that the rear yard
setback was the only violation of the zoning ordinance.
As the
Board members
were familiar with
the property being
considered, there
were no
questions or
further discussion.
The applicant was
dismissed.
On motion'by J. A. Pennington, seconded by George Bowen, the Board of Adjustment
unanimously voted to approve the issuance of a building permit to Mr. Henry
Shreve for the construction of a new residence which would be closer to the rear
yard (north) property line than permitted by the zoning ordinance. It was the
opinion of the Board that a hardship was created because of the topography.
The meeting was adjourned.
