HomeMy WebLinkAbout1965-01-13 Minutes161-2 BOARD OF ADJUSTMENT MINUTES • The Fayetteville Board of Adjustment met at 4:00 p.m., Wednesday, January 13, 1965, in the City Planning Office in the City Administration Building. Members present: John I. Smith, George Bowen and J. F. Robinson. Members absent: J. A. Pennington and James Kerlin. Others present: Tom Eads, John Mahaffey, George Kirsch and Loyd N. Stout. The meeting was called to order by Chairman John I. Smith. Mr. Smith reported that the Board would consider two applications. The first application to be heard by the Board was that of A. L. Shamblin and Mabel A. Horton. Tom Eads, building contractor, was present to represent the applicants. Mr. Shamblin and Mrs. Horton had requested permission to erect a two -car garage upon the lot line between their property at 123 West Spring Street and 119 West Spring Street. In the R-4 zone the zoning regulations require an accessory building to.be five (5) feet from all lot lines. The shared garage, however, would be on the property line instead of setback five (5) feet on each side of the lot line. • Mr. Eads said there are two old frame garages located upon the properties now. The applicants propose to remove these frame structures and replace them with one large garage. In reply to a Board member's question, Mr. Eads said it would be difficult to drive into two garages if they were setback so as to comply with the zoning ordinance. One drive way is used by both Mr. Shamblin and Mrs. Horton. The drive way is between their houses. There being no further discussion, Mr. Eads was dismissed. 0 The second and last application to be considered was that of the North Street Church of Christ on the northeast corner of the intersection of North Leverett Avenue and West North Street, Mr. George Kirsch and Loyd N. Stout, Elders of the North Street Church of Christ, were present to discuss their request for permission to build an addition onto the north side of the existing church building. The proposed addition would be closer to the east side yard than permitted. Also the church is located upon a tradt of land which is less than the 2 acres required by the zoning ordinance. Mr. John E. Mahaffey arrived at the meeting. He was present to represent the the Church of Christ. • Mr. Loyd Stout explained that they wanted to build onto the present sturcture inorder to obtain the classrooms.needed. Five classrooms are proposed. 162-2 Chairman John I. Smith asked why the addition did not line up with the existing wall on the east and the addition be extended farther north. John E. • Mahaffey pointed out that a problem of span and expense would be involved if the addition were extended farther north. The representatives of the Church of Christ mentioned that the addition had been designed in such manner that it would conform with the unusual pattern of the existing building. There was discussion had on the possibility of acquiring additional property to the east. The church elders said property to the north had been purchased for parking, but they questioned purchasing more property. There being no additional questions, all parties were dismissed. After a short discussion, J. F. Robinson moved that the Board of Adjustment waive the requirements of the zoning ordinance and that the North Street Church of Christ members be permitted to build within 30 feet of the property line on the east side yard and be permitted to build upon a lot with less lot area than the 2 Acres required. The motion was seconded by George Bowen and passed unanimously. On the application of A. L. Shamblin and Mable A. Horton, George Bowen moved that the Board of Adjustment approve the request of the two appli- cants and that a permit be issued for the construction of a two -car garage • on the property line between their lots. The motion was seconded by J. F. Robinson and passed unanimously.
