• BOARD OF ADJUSTMENT MINUTES
The Board of Adjustment met at 4:00 P.M., Wednesday, December 16, 1964, in
the City Council Room of the City Administration Building.
Members present: John I• Smith, J. F. Robinson, James T. Kerlin, George
Bowen and J. A. Pennington. All Board members were present.
Others present: G. E. Wheeler and Ward Ramey.
The meeting was called to order by Chairman John I. Smith. The minutes of
November 13, 1964, and November 27, 1964, were approved as written and mailed
to the Board members.
Chairman John I. Smith reported that the only application to be considered at
this meeting was that of Mr. Bill Werner. Chairman Smith asked that this
application be presented.
Mr. Ward Ramey of Fayetteville Real Estate and Mr. G. E. Wheeler were at the
meeting to represent Mr. Bill Werner and to explain the application. Mr. G. E.
Wheeler who was more familiar with the application was the spokesman. Mr. Wheeler
explained that Mr. Werner had appealed to the Board for a variation from the
requirements of the zoning regulations for the use of property located on the
northwest corner of the intersection of Razorback Road and U. S. Highway 62
West. The property is located in a C-2 Thoroughfare Commercial District.
• Mr. Werner wishes to erect a drive-in eating and drinking establishment upon
the property. The zoning regulations consider setbacks to be from overhangs
(whether a canopy or eave) to property lines; therefore with parking in front
(Highway 62 West) and on the side (Razorback Road) of the proposed drive-in,
the canopy would be closer than the 40 feet required by ordinance. Mr. Wheeler
pointed out that the actual building wall would be 30 feet from the east property
line. This setback, disregarding the canopy, would be the only violation of
the zoning ordinance.
There is an existing highway right-of-way of 59 feet on Razorback Road and 60
feet is desired. Mr. Wheeler reported that he had checked with the Arkansas
State Highway Department inorder to determine what was going to be required on
curbs, entrances, exits and other safety factors. There was further discussion
had by the Board and Mr. Wheeler concerning the highway right-of-way.
The Board
felt
that
the information
needed on the
application had
been furnished;
therefore
Mr.
G. E.
Wheeler and Mr.
Ward Ramey were dismissed.
A lengthy discussion followed. During the discussion Mr. Wheeler was asked to
return to the meeting and explain the figures given on the highway (Razorback
Road) shoulders, actual pavement and right=of-way. Mr. Wheeler was dismissed.
The Board members were ready to make a decision. James A. Pennington moved that

side yard of an intersecting street and on the front yard, parking
to be in both the side yard and the front yard, and that Mr. Bill •
Werner, applicant, be issued a building permit provided that he
comply with the following:
(1)
The
entire
structure
(building
and canopy) be moved four
drive-in canopy;
feet
to the
west;
building
to the west.
(2)
There
be angle parking
on both the east and west sides
West Sixth Street
of the
drive-in canopy;
and
(3)
The canopy be
no
closer to
West Sixth Street
(U.
S. Highway
62 West) than
the
building
to the west.
The motion was seconded by George Bowen and passed unanimously.
The meeting adjourned at 5:30 P.M. as there was no further business to
be discussed.
