HomeMy WebLinkAbout1964-11-27 Minutes157-2 • BOARD OF ADJUSTMENT MINUTES The Board of Adjustment met on Friday, November 27, 1964, at 4:00 p.m., in the City Council Room in the City Administration Building. Members present: John I. Smith, J. F. Robinson, George Members absent: J. A. Pennington and James Kerlin Others present: Roscoe Kuhn of R K Sales Company, applicant. The meeting was called to order by Chairman John I. Smith. The Chairman re- ported that the application of R K Sales Company was the only appeal to be heard at this meeting. Mr. Roscoe Kuhn of R K Sales Company explained to the Board that he had tried to comply with the city zoning regulations on the installation of two gasoline pumps by installing the pumps closer to the.entrances to the building. The pumps are too close to the doorways. There is the danger of vapor fumes com- ing into the building when doorways are open. The proposed location of these pumps will be 32 feet from the pavement, 7 feet from the highway right-of-way and 20 feet from the front end of the building. In reply to a Board member's question regarding ownership, Mr. Kuhn said he had a 5 year lease and the first year will expire March 1, 1965. Ellis Burgin oras • the property. Mr. Kuhn pointed out that only the pumps and not the tanks would have to be moved. The tanks are close to the rock retaining wall and are back far enough that future street widening would present no problem. Mr. Kuhn said he would be willing to move the pumps back should there be any future widening of the highway right-of-way. There was discussion of the erection of any signs up above the pumps. The applicant said there would be a sign about 20 feet above the pumps and 4 feet in diameter. The sign, however, would be no closer to the highway right-of-way than the pumps. The Board members had no further questions; therefore the applicant was dismissed. J. F. Robinson moved that the Board of Adjustment waive the zoning requirements of Article V, Section 7-4-a of Ordinance No. 1239, and its amendments, as requested by the applicant Roscoe Kuhn of R K Sales Company, and that if necessary the gasoline pumps are to be moved at the time of any widening of the highway right- of-way. The motion was seconded by George Bowen and passed unanimously. Because of conflicting meetings and schedules, the Board of Adjustment members requested that the meetings of the Board be held the second and fourth Wednesday of each month.
