HomeMy WebLinkAbout1964-10-16 Minutes153-2 • BOARD OF ADJUSTMENT MINUTES The Board of Adjustment met at 4:00 P.M. on Friday, October 16, 1964, in the City Council Room in the City Administration Building. John I. Smith and Members present: J. F. Robinson, J. A. Pennington and George Bowen. Members absent: John I. Smith and James T. Kerlin Others present: Mr. and Mrs. Thomas J. Stout; and Mr. Hugh Kincaid, attorney representing the applicant Mr. Kenneth W. Lance. In the absence of Chairman John I. Smith, J. F. Robinson prisided as Chairman. Mr. Robinson called the meeting to order and requested the applications be presented. The first application considered was that of Mr. and Mrs. Thomas J. Stout at 232 West Ash Street. Mr. Stout requested permission to erect a 5 ft. by 8 ft. gpen-dovered porch onto the front of his residence on Ash Street. This residence, which is already closer to the street right-of-way (20 feet), would be within approximately 14 feet of the street with the proposed porch. The public hearing was held on said application on September 11, 1964, however neither the applicant nor a representative were present. The Board did not take any action upon the application, but the Board did request that the applicant be notified before the next meeting. • There was discussion had on the request of Mr. T. J. Stout. Mr. Stout told the Board members that the purpose of this porch was to protect the front door from weather. After several questions and more discussion, the applicant was dismissed. - 0 - The next request for a variation from the requirements of the zoning regulations was made known by Mr. Hugh Kincaid, attorney for Mr. Kenneth W. Lance. The variation requested by the applicant is for the use of property located on Holly Street between Garland Avenue and Oakland Avenue. The property is located in a R-2 Two Family Residential District. Mr. Kincaid explained to the Board that Mr. Lance could not be present at the meeting because he was called out of town. Mr. Kincaid told the Board that his client would like to build a duplex upon the property. The lot has 50 feet of street frontage; however in the R-2 zoning district the ordinance require's 60 feet. All setback, lot area, parking, etc. as required by ordinance could be met except for the shortage of the 10 feet of street frontage. The street frontage requirement by ordinance whether for a duplex or for a single family residence is 60 feet and the lot is only 50 feet wide. Mr. Kincaid pointed out that with such requirement this lot could not be built upon. There was discussion had concerning the structures and lots to the east and to the west of the lot in question. • As the Board members felt that the request was clear and there were no further questions, the applicant's attorney was dismissed. - 0 - 154-2 James Pennington moved that the Board of Adjustment not waive the require- ments of Ordinance No. 1239 as requested by Thomas J. Stout inorder that a 5 ft. by 8 ft. open convered front porch could be erected upon the residence at 232 West Ash Street, but that the Board approve the erection of a canopy across the south (front) entrance to protect the door from weather; said canopy to extend no farther from the walls of the building than three (3) feet and to be approximately six (6) feet (east and west) and that said canopy is to have no posts which would extend to the ground, and that the city build- ing inspector be and is hereby authorized to issue a permit for said canopy to Mr. Thomas J. Stout if requested. The motion was seconded by George Bowen and passed unanimously. The original request was denied as the Board members felt that the residence was already in violation of the zoning regulations and that the addition of said front porch would only increase the violation. In regard to the request of Mr. Kenneth W. Lance, George Bowen moved that the Board of Adjustment waive the requirements of Ordinance No. 1239, Article V. Section 3•, Paragraph 4, Area and Bulk Regulations, subparagraph d. Building lot requirements, and that Mr. Lance be permitted to build a duplex upon a lot with 50 feet of street frontage.
