HomeMy WebLinkAbout1964-09-11 Minutes149-2 • BOARD OF ADJUSTMENT MINUTES The Board of Adjustment met in a regular session at 3:30 P.M., on Friday, September 11, 1964, in the City Clerk's office in the City Administration Building. (Due to the remodeling work being done in the City Council Room, the meeting was held in the City Clerk's Office.) Members present: J. I. Smith, J. F. Robinson, J. A. Pennington and James T. Kerlin. Members absent: George Bowen Others present: Mr. S. K. Graham, applicant; Mr. Harold B. Watson, applicant; Mr. John E. Wary, applicant; Mr. William G. Underwood, applicant;.and Mr. Fay Jones, architect. The meeting was called to order by Chairman J. I. Smith. The Chairman requested that the applications be presented in the order in which they were filed. The first application was that of Mr. S. K. Graham, Mr. Graham appeared before the Board to request permission to build a garage apartment on the back of his lot at 522 South Duncan Avenue. The real estate is located in an R-3 Multi -Family Residential District. There is an existing duplex located upon the lot. All requirements of this R-3 zoning district could be met except that there would be two principal buildings on one lot. • Mr. Graham said the apartment would be a single family unit which would be recited to boys. The garage would be 9 feet by 30 feet. The over all building would be 30 feet by 24 feet as shown on the drawing submitted with';the application. The Board members had no questions; therefore the applicant was dismissed. - 0 - The next application was that of Mr. Harold B. Watson. Mr. Watson requested permission to build a two -car carport and an open -covered porch onto his residence at 732 Woolsey Avenue. The roof line of the car port and of the open -covered porch would be approximately 16 or 17 feet from the front yard line. In the R-13 Single Family Residential District the zoning regulations require a minimum front yard depth of 25 feet. Mr. Watson stated that his neighbors had no objections. He said that the proposed construction would be closely in line with the other houses on the street; and that the roof line would not project out as far as some. Mr. Watson pointed out that his house was erected too close to the side property line to permit the construction of a drive -way to the rear yard. The Board members felt that the applicant had presented the facts of this case; therefore the applicant was dismissed. -0- • Mr. William G. Underwood's application was heard. Mr. Underwood requested a variance from the zoning regulations for the use of the real estate at 617 150-2 West Dickson Street in a C-3 Central Commercial District. The applicant stated he planned to tear down an existing residence and duplex and build a new two-story office and business building. The proposed building will not have the required number of off-street parking spaces on the lot. The applicant requested the Board to consider City Parking Lot No. 6 at Gregg Avenue and West Dickson Street. Mr. Fay Jones, architect, presented plans of the proposed building. Mr. Jones designed the building to accommodate a jewelry store and a clothing store on the main floor and office spaces on the second floor. There would be 2,000 square feet of floor space on each floor. Mr. Jones said he h.o)ped to establish his office at this location. He stated that his clients were usually from out of town and there were only three or four clients a year. Mr. Underwood said that almost all of his trade was that of University students who walked. The employees parked in the rear of the present building. In sunanary it was the applicant's opinion that all of the parking spaces required by ordinance would not be needed even if the requirement could be met. 0 Mr. Underwood told the Board that a temporary easement for a drive way could be obtained from Fred Hannah who operates .the Gulf Service Station to the east. Mr. Underwood stressed the fact that this easement could be terminated at any time. With no easement there would be no access to the 60 £t. by 50 ft, space in the rear of the proposed new building. • Chairman J. I. Smith made the objections of the neighbors known. Mr. Smith reported that these objectors felt that parking should be provided upon the lot or at least as much parking as possible. After a lengthy discussion regarding the plans and parking, the applicant and his architect were dismissed. -0- The application of John E. Wray in which a request was made for a variance from the zoning ordinance *as the use of property in an R-4 Multi -Family Residential and Dormitory District at 621 North Leverett Avenue was given consideration. The applicant owns property upon which there are two separate buildings; . An existing garage apartment (one unit) and a shed which has been used as an apartment (one unit) are in one building; and an existing apartment house with four family units is the other building. The applicant would like to remodel the interior of the apartment house so as to increase the number of family units by two. The tool shed which is now being used for storage would not, according to Mr. Wray, be used as.an apartment. By doing this remodeling there would be 3 units on the main floor and 3 units in the basement of the apratment house. Because of the two buildings on one lot, there is less street frontage • (85 feet) than required by zoning regulations (110 feet). Also the 151-2 • increase of units to a total of seven reduced the lot area. There is 11,900 square feet available, but 15,500 square feet of lot area is needed to comply with zoning regulations. After discussion, the applicant was dismissed. - 0 - The last application was that of Mr. Thomas Stout at 232 West Ash Street. Mr. Stout had requested permission to build an open -covered front porch closer to his front yard property line than permitted by ordinance in the R-lA Single Family Residential District. Neither Mr. Stout nor any other person was present in regard to the application. There being no more applications to be heard and all persons being dismissed, the Board met to act upon the applications. On the application of Mr. Thomas J. Stout for a variance from Zoning Ordinance No. 1239 for the use of property at 232 West Ash Street, James Kerlin moved that the Board of Adjustment defer action until all members have had a change to see the property. The motion was seconded by James A. Pennington and passed unanimously. • James Kerlin moved that the Board of Adjustment waive the requirements of Zoning Ordinance No. 1239, and that Mr. John E. Wray be permitted to remodel the interior of the of the apartment house at 621 North Leverett Avenue so as to increase the existing number of units in the apartment house to six by the addition of two more units; and that this approval be given provided that the tool shed is not used for an apartment unit. The motion was seconded by J. F. Robinson and passed unanimously. After a lengthy discussion, J. F. Robinson moved that the Board of Adjustment waive the parking requirements of Zoning Ordinance No. 1239 in the C-3 Central Commercial District and that Mr. William G. Underwood be given permission to use the City Parking Lot No. 6 located on the southeast corner of Gregg Avenue and West Dickson Street; said lot being within 400 feet of the building. The motion was seconded by James T. Kerlin and passed unanimously. It was the opinion of the Board members that the required off:street parking space could not be reasonably provided on the same lot upon which the office building was proposed. James Pennington moved that the Board of Adjustment waive the front yard setback requirements of Zoning Ordinance No. 1239 in the R -1B Single Family Residential District as requested by Mr. Harold B. Watson and that Mr. Watson be permitted to erect his proposed two -car carport and open -covered porch within 17 feet of the front yard property line. The motion was seconded by James Kerlin and passed unanimously. The Board was of the opinion that the neighborhood houses were no closer to the street than Mr. Watson's proposed construction would be. • The application of Mr. S. K. Graham was considered. On motion of James Pennington, seconded by James Kerlin, the Board unanimously voted to approve the 152-2 request of Mr. S. K. Graham to build a garage apartment on the back of • his lot at 522 South Duncan Avenue. The Board felt that this construction would not be out of order with the neighborhood or its uses.
