• BOARD OF ADJUSTMENT MINUTES
The Fayetteville Board of Adjustment met in a special.'session at 4:00 P.M.
on Thursday, July 16, 1964, in the City Council Room in the City Administration
Building.
Members present: J. I. Smith, J. F. Robinson and J. A. Pennington.
Others present: Harold E. Lieberenz, City Building Inspector; Bill Thomas;
Glenn Nelson, applicant; Mrs. W. S. Clark, applicant; Peter Estes, Attorney;
Clarence Tune; and I. S. Fitzgerald, applicant.
Members absent: George Bowen and James T. Berlin.
The meeting was called to order by Chairman John I. Smith. Mr. Smith asked
that the applications before the Board for consideration be presented*'.'
Harold E. Lieberenz, City Building Inspector, reported that the first appli-
cation would be that of Mr. I. S. Fitzgerald. Mr. Fitzgerald, representative
of the Continental Oil Company, had requested a variance from the zoning regulations.
The variance requested was for permission to erect a canopy over the gasoline
pump island at the Conoco Service Station at 433 North College Avenue. The proposed
canopy would be approximately 4.5 feet from College Avenue instead of the 15 feet
required by the zoning regulations. There was a short discussion after which
• the applicant was dismissed.

The second application to be considered by the Board of Adjustment was that
of Mr. Glenn Nelson. The City Building Inspector explained that the variance
requested by Mr. Nelson was for permission to erect a car -port and a patio
roof on his residence at 1730 North Oakland Avenue. The proposed roof would be
closer to the rear (east) property line than the 30 feet required by the zoning
regulations. Mr. H. Lieberenz expalined that it was a matter of definition of
front and rear yards under the zoning ordinance. If Mr. Nelson's front door faced
Kelley Street, then the City Building Inspector could have issued the permit.
After a short discussion, the applicant was dismissed.

The next application was that of Mrs. W. S. Clark who appeared before the Board
to request permission to move the residence at 338 South Duncan Avenue onto the
rear part of the lot and to erect a new duplex on the front part of the lot.
Mr. Lieberenz, City Building Inspector, explained that the lot frontage on
Duncan Avenue needed 10 feet more before he could issue a building permit for
these two proposed dwellings on this property.
The Board members asked Mrs.Clark her plans. After there were no further
questions, the applicant was dismissed.

Harold E. Lieberenz next introduced Mr. Peter Estes and Mr. Clarence Tune:-

Mr. Estes and Mr. Tune were present to discuss the decision of the Board
at its meeting on March 27, 1964, regarding the application of Ms. C. Tune.
Mr. Tune had requested permission to erect another duplex on his property
on North Leverett Avenue, Mr. Estes, attorney, explained that Mr. Tune eras
out of the City and was unable to attend the March 27, 1964, meeting. Mr. C.
Tune stated that he felt that there was room for another duplex on his
property and if he were permitted to tuild the duplex, he would curb and gutter
and pave a 26 foot width drive off Leverett Avenue. Also he could move
the proposed building east enough'_so.that thirty ('30) feet would be maintained
between the proposed new duplex and the existing duplex.
There were a few more questions and after a limited discussion, Mr. Clarence
Tune and Mr. Peter Estes were d'smissed.
There was discussion had on the application of Mr. I. S. Fitzgerald.
J. A. Pennington moved that the Board of Adjustment defer action upon this
application until information could be obtained as to whether or not the
canopy would be a traffic hazard. The motion was seconded by J. F. Robinson
mad passed unanimously.
J. F. Robinson moved that the Board of Adjustment approve the application •
of Mr. Glenn Nelson in which a request to build closer to the rear property
line than the required thirty (30) feet was made by Mr. Nelson. The motion
was seconded by J. A. Pennington and passed unanimously.
0n the application of Mrs. W. S. Clark,J. A. Pennington moved that the Board
approve the application for two dwellings upon a lot which needed 10 feet
more of street frontage inorder to meet the requirements of the zoning
regulations. The motion was seconded'by J. F. Robinson and passed
unanimously.
There was discussion had on the application of Mr. Clarence Tune which had
been denied at the March 27, 1964, meeting. J. A. Pennington moved that the
Board approve the request of Mr. Clarence Tune on condition that a thirty (30)
foot separation be maintained between the proposed new duplex and the exist-
ing dwelling. The motion was seconded by J. F. Robinson and passed unanimously.
The Board also suggested that Mr. Tune pave, curb and gutter the drive for
a width not less than 26 feet, back to back.
There being no further business, the meeting was adjourned.
