HomeMy WebLinkAbout1964-05-29 Minutes141-2 BOARD OF ADJUSTMENT MINUTES , • The Fayetteville.Board of Adjustment met in the City Council Room in the City Administration Building on Friday, May 29, 1964, at 3:30 p:'m. Members present: J. I. Smith; George Bowen and J. A. Pennington. Others present were Paul Young, architect; W. R. Tester, applicant and representative of the Southwestern Bell,, -Telephone Company; Bill Green, representative of the Southwestern Bell Tele phone.:Company; James Wilson, Assistant City Inspector; and Mrs. J. W. Eoff, applicant. Members. absent:,•James Kerlin and J. F. Robinson:- .... ......... .......... . __ - .----- -- The meeting was called'to order by Chain J. I. Smith. The application submitted by Mrs. J. W. Eoff was heard first. Mrs. Eoff was present to explain her application.; r.. . Mrs. Eoff told the Board that she wanted permission to build a new residence on lot 19 of Clay Yoe's Subdivision.- The roof of the proposed car port would only be 15 feet from West Lakeridge Drive instead of the 25 feet required by ordinance. The car..port, had to..bepulled closer to the, street -because of --the slope -of the land. . Mrs. Eoff had had a scale cardboard model prepared. This model showed the elevation _,.and .setbacks. . She .said, that building would be. -low. She -•mentioned •that by uprooting trees the car port could be.moved!to the east and still be useable; however engineers • and the geology department at the University of Arkansas said that the lot should not be disturbed. The signatures of property owners within the subdivision were submitted to the Board of Adjustment for records. -These signatures!were necessary because the sub- division covenants required a greater setback from the property line in question than the city zoning regulatinns. There were a few more questions and after a limited discussion, the applicant was dismissed.. The second application before the Board of Adjustment was that of Mr. W. R. Tester acting in behalf of the Southwestern Bell Telephone Company. Mr. W. R. Tester, Mr. Paul Young and Mr. Bill Green were present to make known the plans of the Southwestern Bell Telephone Company. The variation requested was for the use of the property located on the east side of North Leverett Avenue and approximately 814 feet north of North Street. The property owned by the telephone company -is 200 feet (north and south)-'by'300 feet (east and west) and is located in an I-lA Light Industrial Zone of the City of Fayetteville, Arkansas. The request was made by the telephone company so that a service building could be erected within 10 feet of the north property line. The City Inspector explained that the city zoning ordinance requires the building to be located 25 feet from the north property line. • Mr. Tester pointed out that all of the area of the service building as shown on drawings mailed to the Board of Adjustment members is not building but approximately half of it is canopy. 142-2 If the service building were set to face the north, there would be problems created in the winter because of the weather. Because of • the two types of installation trucks, the small car port is being erected. The car port could not be moved to the east and the other buildings could not be made to comply because of the rate of growth and the expansion of the buildings which will be a necessary construction. Poles and reels of calbes will be stored in an area in the southeast corner of the property of the Southwestern Bell Telephone Company. A construction store room and maintenance room would be erected in the main building. The gates of the yard would be closed at 6:00 p.m. Mr. Tester mentioned that the property oener to the north does not object to the building being erected closer to the property line than permitted by the zoning ordinance. This property owner's only concern was that the trees be left. There being no further discussion, the applicant and other parties present in behalf of the Southwestern Bell Telephone Company were discussed. George Bowen moved that the Board of Adjustment not approve the variance of the zoning ordinance as requested by Mr. W. R. Tester acting in behalf of the Southwestern Bell Telephone Company. The motion was seconded by James A. Pennington and passed unanimously. It was the opinion of the Board: that the variance requested was too great a deviation from the zoning regulations. • On motion by James Pennington, seconded by George Bowen, because of the topography and the moving dirt, the Board of Adjustment unanimously voted to waive the requirements of the zoning ordinance and approve the application of Mrs. J.
