BOARD OF ADJUSTMENT MINUTES
The Fayetteville Board of Adjustment met in the City Council Room in the City
Administration Building on Friday, May 1, 1964,at 4:00 p.m.
Members present: J. F. Robinson, J. A. Pennington, J. I. Smith, James Kerlin
and George Bowen. Others present: Harold E. Lieberenz, City Building Inspector;
Thomas Comley, applicant; Kenneth Cockrom, architect; Larry Carter; Barton Schulz;
and Robert L. Curtis.
The meeting was called to order by Chairman J. I. Smith.
Harold Lieberenz reviewed the proposal of Thomas Comley for the benefit of those not
present at the April 24 meeting. The City Inspector explained that Mr. Comleyls
application requesting a variation to the zoning ordinance was for the use of property
located on the NE corner of Melma.r Drive and North Garland Avenue. The property is
described as Block 5 of Bel Air Acres Second Addition and is located in an R-3 Multi -
Family Residential Zone.
The applicant had come before the Board to request permission to erect 6 apartment
buildings on a plot of ground which had not been platted. Two buildings are not
fronting on a street. Under the section of the zoning ordinance on group housing, the
Board has the right to approve this variance. Also a request was made by Mr. Cowley
for a variance on the parking requirement. The proposed plans provided some off street
parking between two apartment buildings and the street.
• Mr. Comley and Mr. Cockrom pointed out that several more apartments could have been
put upon the property and the lot area would have complied with the requirements of
the zoning ordinance; however the more desirable arrangement was the 6 buildings as
shown on the plans.
There was no further discussion and the applicant was dismissed.
Mr. Larry Carter and Mr. Barton Schulz were present in behalf of Mr. M. 0. Rasberry.
All attended the April 24 meeting at which time a public hearing was.held on the
application of Mr. Rasberyy (See Minutes of April 24).
Mr. Schulz, architect, submitted an amended drawing of the plot plan of the parking
area of the proposed apartments. At the April 24 meeting there was some concern
by the Board of Adjustment on the usability of the parking spaces to the west of
the alley. On the amended drawing there were provisions made for 5 parking spaces
(101 x 241) and 9 parking spaces (101 x 201). Building "B" was moved 2 feet to the east
(Hill Avenue) which left a 13 -foot setback instead of a 15 -foot setback off Hill
Avenue. The area way between Building "B" and "C" was decreased 2 feet. These
buildings were moved to the east inorder to increase the length of the parking spaces
as much as possible.
There was no further discussion on the amended drawing on the application of M. 0.
Rasberry.

J. F. Robinson moved that the Board waive the requirements of Zoning Ordinance
No. 1239 and that Thomas Comleyls request for a variance of.the:zoning;ordi:nance.

be approved. The motion was seconded by James Kerlin and passed
unanimously.
After a long discussion George Bowen moved that because of the amount \
of lot area which would be occupied by the proposed new auditorium of
the Immanuel Baptist Church, the Board not waive the requirements of Zoning,
Ordinance No. 1239. J. F. Robinson seconded the motion and the motion
passed unanimously.
The Board discussed the canopy which was being erected at 1914 North College
Avenue at the Hudson Oil Company. It was the opinion of those present that
their decision of March 27 should be reversed because the canopy was setback
nearly in line with other buildings to the south and it was a type of structure
which could easily be moved if North College Avenue were widened. James
Kerlin moved that the Board reverse their decision of March 27, 1964, and
approve the request of the National Aluminum Distributors Company. The
motion was seconded by James Pennington. The motion passed unanimously.
On the application of M. 0. Rasberyy and tle amended drawing of the proposed
apartments, J. F. Robinson moved that the Board of Adjustment approve the
application and the amended drawing provided that all the parking spaces on
the west next to the alley be 241 x 10t. The motion was seconded by J. A.
Pennington and passed unanimously.
There being no further business, the meeting was adjourned.
