The Board of Adjustment met in the'City Council Chambers in the City Administration Building on Friday, October 25;•1963, at 4:00 p.m.' Members present: J. I. Smith, George Boren and•James A. Pennington. Also present were: Judy Robertson, applicant; Chester House, Miss Robertson's builder; Mrs. Leon Borden and Mrs. William Moore, interested parties; Suzanne Lighton, applicant, and Harold E.'Lieberenz, City Building Inspector: Members absent: T. M. Schieratz and J. F. Robinson. The meeting was called td order by Chairman J. I. Smith. The Board of Adjustment minutes of September 13, 1963, September 27, 1963, and October 1. 1963, were approved as written and mailed to the members. The first application to be considered by the Board was that of Judy and Marna Robertson who requested�a variation to Zoning Ordinance No. 1239 for the use of the property located at 124 South Duncan Avenue. Chairman Smith asked the City Building Inspector to explain the application. Harold Lieberent, City Building' Inspector, said that'he could not issue Chester House, the applicants' builder; a building permit because the lot upon which the applicants wanted to build did not have sufficient lot frontage. The applicants own two lots which have a total of 100 foot street frontage. One lot has a dwelling • already upon it: '-The applicants wculd like to build a duplex building'on the other lot. The ordinance requires a 60 foot street frontage before building.e. duplex. Mr. Lieberenz told the Board members that the applicants had said they plan to.build onto the proposed duplex in the future to make an apartment building. This would be done after the existing house located on the adjacent lot is moved or torn down. Apartments would.be permitted as the property is in a Rw3 zone. Judy Robertson told those present that the garage shown on the drawing was torn down and therefore no longer existed. Mrs. Leon Bowden, 122+1 South Duncan Avenue, owns the lot north of the applicants' property. Mrs. Bowden said she would have objected if the building were to be closer than five (5) feet to the north property line....She.was assured -the building roof overhang -would be 5 feet from the property line. " Mrs. William Moore owns property across the street. She said she bad no objections but was merely interested in the applicants' request. There being no further questions, the applicant and interested panties were dismissed. The neat and last application was that of Suzanne Lighton who requested a variation to Zoning Ordinance No. 1239 for the use of the property located at 424 North Willow Avenue in a F�2 Two Family Residential District. • Harold Lieberenz, City Building Inspector, explained the application to the Hoard. Permission had been requested by Suzanne Lighton to erect an attached car port on the south side d her residence. The roof of the proposed car port will be four (4) feet from the eoflth property line instead of the five (5) feet required by 124-2 Zoning Ordinance No. 1239, Suzanne Lighton said she had requested to build closer to the property line for safety and convenience. Miss Lighton said the existing garage was very old and was not long enough. In bad weather she stated she parked her car in the drive way; therefore she had considered building the car port on the south side and attaching it to the house. Luella M. Puckett owns the property to the south. ;Miss Lighton was sure Miss Puckett had no objections. Miss Lighton said a slanting rock wall and a wide drive separated the two properties. The people to the north and across the street have no objections. The Hoard had no questions; therefore the applicant was dismissed. -�eeeei�e• George Bogen moved that the Board of Adjustment approve the variation to Zoning Ordinance No. 1239 as requested by Judy and Marna Robertson and that the City Building Inspector be authorised to issue.a building permit to erect a duplex on a lot which has a 50 foot lot frontage. The motion was seconded by J. A. Pennington and passed unanimously. J. A. Pennington moved that the Board of Adjustment approve Susanne Lighton►s request for a variation to the zoning ordinance -so that an attached car.port could be erected four.(4) feet from the southe(side) property line. The motion, seconded by George Bowen, passed unanimously. There being no further business, the meeting was adjourned.
