HomeMy WebLinkAbout1963-09-13 Minutes113-2 BOARD OF ADJUSTMENT MINUTES The Board of Adjustment meeting which was to have been held Fridayv September 13, 1963, at 4:00 p.m. was conceled because th6 city offices were closed. This meeting was re -scheduled to be held Tuesday, September 17, 1963, at 4:00 p.m. The Board of Adjustment met in the City Council Chambers in the City Administration Building on Tuesday, September 17, 1963, at 4:00•p.m. Members present: T. M. Schiewetz, George Bowen and J. A. Pennington. The applicant, Mr. Clarence W. Tune, was also present. In the absence of Chairman J. I. Smith, T. M. Schiewetz presided at the meeting. Mr. Schiewetz said that the purpose of the meeting was to hear and consider the application of Mr. Clarence W. Tune in which a variance was requested. The variation to the zoning ordinance requested by Mr. Tune was for the use of the property located. on North Leverett Avenue east of 1364 and 1366 North Leverett Avenue. This property is located in a R-2 Two Family Residential District. M]r. Tune owns a piece of property which is 323 feet deep (east and west). The lot has a 90 foot street frontage. There is an existing duplex located upon the lot. This existing duplex faces North Leverett Avenue. There is a 12 -foot private drive which goes back to the east (rear) of the lot. At this point Ns. Tune corrected the inform- ation which had been given to the Board members. Mr. Tune said the drive was 24 feet • wide. Mr. Schiewetz continued. Mr. Tune has come before the Board to request permission to locate another duplex upon the lot. It was pointed out that Section 3 of ARTICLE VI EXCEPTIONS AND MODIFICATIONS states that the Board of Adjustment may approve more than one building on a plot of ground under certain conditions. Mr. Tune said he could meet the conditions with the exception that the duplex would front on a 24 foot private drive instead of a public street. The Board members felt that the case had been well presented; therefore they had no questions to ask Mr. Tune. There being no further discussion, the applicant was dis- missed. James Pennington moved that the Board of Adjustment waive the requirements of Zoning Ordinance No. 1239, passed and approved June 13, 1960, and approve the application of Mr. Clarence W. Tune in which he requested permission to build a duplex on a lot which already had a duplex located upon it. The motion was seconded by George Bowen and passed unsnimously.
