HomeMy WebLinkAbout1963-08-23 Minutes107-2 BOARD OF ADJUSTMENT MINUTES • The Board of Adjustment met on Friday, August 23, 1963, at 4:00 p.m., in the City Court Room in the City Administration Building. Members present: J. I. Smith, J. F. Robinson and J. A. Pennington. Members absent: T. M. Schiewetz and George Bowen. Applicants and others present: Harold E. Lieberenz, City Building Inspector, and the following applicants: Ellis Burgin and Mr. and Mrs. J. A. Bowman. Paul Wilburn, the Bowmants architect, was also present. Chairman J. I. Smith called the meeting to order. The minutes of the last two meetings (June 28, 1963, and July 12, 1963) were approved as written and mailed to the members. Mr. Ellis Burgin's application was considered first. The variation requested by Mr. Burgin to the zoning ordinance was for the use of the property located at 225 North Block Avenue. This property is located in a C-3 Central Commercial Zone. Mr. Burgin said he had purchased this property because it was in the same zone as his present office is located within. This property, according to Mr. Burgin, had been purchased for a future office site. Mr. Burgin pointed out that the immediate area around his property was still resi— • dential; therefore at the present he wanted to convert the building into a duplex residence. Mr. Burgin said he had already put an apartment in the upstairs and he planned to rent the apartment until such time as commercial buildings are'located in the area. If pSNrpssion were not given to rent the downstairs as an apartment, Mr. Burgin said his recourse would be to rent it to a party..who wanted to operate a small commercial business. Harold Lieberenz told the Board that two items had to be considered: (1) The city zoning ordinance states that the Board of Adjustment must approve -duplex residences in the C-3 Commercial Zone before the building inspector may issue a building permit; and (2) the property has a 50 foot lot frontage; whereas the zoning ordinance requires a 60 foot lot frontage for duplex residences in this zone. J. A. Pennington asked Mr. Lieberenz if he had heard any objections to the applicant's request. Mr. Lieberenz replied no. Mr. Burgin was dismissed and the next and last application was considered. The variation requested by Mr. and Mrs. Bowman to the zoning ordinance was for the use of the property located on Shrewsbury Lane. This property is located in a R—IA Single Family Residential District and is more particularly described as lots 11 and 12 of Block 2 in the Replat of Southampton Addition to the City of Fayetteville, Arkansas. • Mr. Lieberenz told the Board that the applicants wish to erect a new residence on the above—mentioned lots. The proposed residence will be approximately fifteen (15) feet from the rear lot line instead of the thirty (30) feet required by the city zoning ordinance.. 108-2 Mr. Lieberenz pointed out that with the type of house which the Bowman's • wish to erect there is a problem of lot grade. Because of the shape and topography of the lot, this request for a variation from the zoning ordinance was made. A question was asked about any plat covenants. Mr. Bowman said he had checked into the matter and learned there are no plat covenants. Mir. Lieberenz said ha had received no complaints or inquiries on the Bowman's application. There being no further questions, the Bowman!s and D: . Wilburn were dismissed. --- 0 J. F. Robinson moved that the Board of Adjustment grant Mr. Ellis Burgin!s request to use the downstairs area of the residence at 225 North Block Avenue for an apartment. J. A. Pennington seconded the motion which passed unanimously. Due to the topography the Board members looked favorably upon Mr. and Mrs. J. A. Bowman's application. J. F. Robinson moved that the Board of Adjustment approve the application for a variation from the requirements of the city zoning ordinance. J. A. Pennington seconded the motion.
