BOARD OF ADJUSTMENT MINUTES
• The Board of Adjustment met on Friday, April 26, 1963, at 3:30 p.m. in the City
Council Room in the City Administration Building.
Present: J. F. Robinson, George Bowen, J. A. Pennington, Harold E. Lieberenz and the
following applicants: Mr. 0. V. McCullah, Mr. Adlai F. Arnold and Mrs. Robert D. Hay.
Mrs. Hay's parents were also present.
J. F. Robinson, who acted as chairman in the absence of Chairman J. I. Smith, called
the meeting to order. There were no minutes to be approved as the minutes of the last
meeting had not been mailed to the members.
The.application of Mr. 0. V. McCullah was considered first. Mr. McCullah appeared
before the Board of Adjustment in behalf of Annie B. Spurlock. The variation requested
by Mr: McCullah to the zoning ordinance was for the use of property which is located
at 48 East South Street and is located in a C-2 Thoroughfare Commercial District. This
property is more particularly known asthe Southeast part of lot 1 of Block 42 in the
Original Plat of the City of Fayetteville, Arkansas.
Mr. Harold Lieberenz explained to the Board that Mr. McCullah requests permission to
enlarge and remodel an existing residential garage. The existing garage is located
on the street line and is wall to wall with a similar garage on the property to the
west of this location. The owner wishes'to erect a new garage a little farther from
the street line. The new proposed garage would be closer to the street line and closer
to the west property line than permitted by the city zoning ordinance.
Mr. McCullah said the present garage is about to fall down. He said that 3 feet of
the garage is on city property which is the reason the owner wants to set the garage
back before having any repair work done. The garage will be moved back 5 feet from the
city's property line; therefore the garage would actually be back B feet from its
present location. The construction'will be of concrete block and will be partly under
the ground. Mr. McCullah said the lady who owns the garage to the west planned to
tear down her existing garage and erect a new garage as soon as she could if Annie B.
Spurlock's request was granted by the Board.
Mr. Lieberenz reported that he had received no complaints or objections. There was no
additional information to be, given; therefore the chairman dismissed the applicant.
Adlai F. Arnold appeared before the Board. Mr. Arnold requested a variation to the
zoning ordinance for the use of the property at 535 Wilson Avenue. This property is
more particularly described as lot 3 of Wilson's Second Addition to the City of Fayette-
ville, Arkansas. The property is located in a R -1B Single Family Residential District.
Mr. Lieberenz told the Board that Mr. Arnold wishes to build an attached carport to the
north.(side) of his residence. The roof of the proposed carport would,be only about
two (2) feet from the north property line. Also the proposed structure may be closer
to the street line than permitted by the city zoning ordinance.
Mr. Arnold presented to the Board a signed statement from the property owner to the
north. The property owner, Louise W. McNutt, stated she had no objections to Mr. Adlai.

Mr. Robinson inquired about the material to be used in the proposed structure.
Mr. Arnold said he did not know for sure. Mr. Arnold pointed out that the two feet in
question would not be encroached upon by the proposed roof overhang.

Mr. Arnold told the Board that a run away car which entered his yard and caused
considerable damage had stipulated his plans. James Pennington asked why the
carport could not be erected in the rear yard. Mr. Arnold said that the car- •
port could be put in the back, but he doubted if the carport would be used very
often. His house:has no back entrance at the present other than the door from
the den which is located on the south side of the house.
There were no further questions; the applicant was dismissed.
The last applicant to be heard at this meeting was Mrs. Robert D. Hay. The
variation requested by Mrs. Hay to the zoning ordinance was for the use of
property located at 740 Huntsville Road.
Mrs. Hay had come before the Board to request permission to remodel a single
family residence by building a shed -type addition onto the existing house and
move a trailer under the addition. The residence would become a duplex. This
property is located in a R-2 Two Family Residential Zone. The zoning ordinance
does not permit separate house trailers to be set on individual lots in this
zoning district.
In reply to a Board member's question, Mrs. Hay said there are 20 acres in the
whole tract of their property. Mrs. Hay presented a picture which showed how
far back the house set from Huntsville Road. She said they plan to build on
the east side of the existing attached garage. A trellis would be erected to
conceal the trailer from the street. The trailer will be put on cemet block
foundation and the wheels will be removed. Mrs. Hay told the Board that her
retired parents would live in the trailer.
Mr. Lieberenz reported he had received no objections to the proposal of Mrs. Hay.
The Chairman dismissed the applicant as there were no further qulstions:
George Bowen moved that the Board of Adjustment approve the applicati-on of
Mr. 0. V. McCullah who requested a variation to the zoning ordinance in behalf
of Annie B. Spurlock. The Board members were of the opinion that the new garage
would be a lesser encroachment on the property line. The motion was seconded
by James Pennington and passed unanimously.
A motion was made by James Pennington and seconded by George Bowen to deny the
request of Adlai F. Arnold for a zoning variance. The motion passed unanimously.
The Board felt that the carport would be too close to the property line.
James Pennington stated that Mrs. Robert D. Hay's request would not be objectionable
because of the large amount of land owned by the Hays and once the wheels were re-
moved from the trailer the structure would become stationary. Mr. Pennington moved
that the Board grant Mrs. Hay's application requesting a variance to the zoning
ordinance. The motion was seconded by George Bowen and passed unanimously.
The meeting was adjourned.
