BOARD OF ADJUSTMENT MINUTES
40 The Board of Adjustment met on Friday, March 22, 1963, at 4:00. p.mo in the City
Council Room in the City Administration Building.
Members present: J. I. Smith, J. F. Robinson and T. M. Schiewetz. Others present
were Mr. Thomas Comley, applicant, and Mr. H. E. Lieberenz, City Building Inspector.
Members absent: J. A. Pennington and George Bowen.
J. I. Smith, Chairman, called the meeting to order. The minutes of March 8, 1963,
were approved as written and mailed to the members prior to this meeting.
Mr. Harold Lieberenz told the Board that Mr. Thomas Comley's application was the only
one to be considered by the Board at this meeting. Mr. Lieberenz explained that
the variation requested by Ns. Comley to the zoning ordinance was for the use of
property located on the northwest corner of the property which is known as lot 1 of
Block 2 of Bel Air Acres Subdivision to the City of Fayetteville, Arkansas, and is
located in a R -1B Single Family Residential Zone.
Mr. Lieberenz pointed out that the proposed new residence which Mr. Cowley wants to
build will be closer to the west property line, Sycamore Street and Oakland Avenue
than permitted under the ordinance. The City Inspector explained why the house to
the west was 14 feet from the east property line. He and Mr. Comley felt that the
visible distance between the two residences would be the same as between other houses
• in the area. Mr. Lieberenz continued; he said that the proposed house has a 30 inch
overhang on the rear and front and the house would be approximately 22.5 feet from
Oakland Avenue and approximately 15 feet from Sycamore Street. If the house faced
Sycamore Street, it would have to setback 25 feet from the street. As far as actual
property line is concerned, the proposed house would only be 2.5 feet from the west
property line.
Mr. Comley said that this subdivision was in existence before the City adopted the
Subdivision Regulations. He mentioned that the lot had the required amount of lot
area required by the zoning ordinance; however due to the irregular shape of the lot
a house with the footage required by the covenants could not be erected without
asking for a variation from the zoning ordinance. Mr. Comley said that this proposed
house would be the same size as the other houses in the area.
The approval of the

A., according
to Mr. Comley's report,
had been
given along
with the suggestion
that
shrubs 3 or 4
feet apart be planted to
provide
a screen.
Mr. Lieberenz reported he had received a telephone call from people who live south
across Sycamore Street. The party felt that the house was too close to Sycamore
Street. The party said he did not wish to make an issue of the problem because he
realized that the lot was of unusual size and shape.
Mr. Smith dismissed the applicant as there was no additional information to be
given.
Mr. J. F. Robinson moved that the Board of Adjustment grant the application of
• Mr. Thomas Comley in which variations from the zoning ordinance were requested;
that the application be granted due to the unusual size and shape of the lot. The
motion was seconded by Mr. T. M. Schiewetz and passed unanimously.

The City Inspector gave the Board members a copy of material taken from
the zoning ordinance on home occupations. He told the Board that a future
application to be considered by the Board would deal with home occupations,
and the material contained beneficial information.
The meeting was adjourned.
