HomeMy WebLinkAbout1963-03-08 Minutes91-2 BOARD OF ADJUSTMENT MINUTES • The Board of Adjustment met on Friday, March 8, 1963, at 3:30 p.me in the City Council Room in the City Administration Building. Members present: J. I. Smith, J. F. Robinson, George Bowen and J. A. Pennington. (Also present were Harold E. Lieberenz, City Inspector, and F. F. Nonnamaker, appli- cant. ) Members absent: T. M. Schiewetz. The meeting was called to order by Chairman J. I. Smith. The minutes of January 15, 1963, and February 1, 1963, were approved as written and mailed to the members prior to this meeting. Mr. Smith asked Mr. Lieberenz to explain the problem of F. F. Nonnamaker. Mr. Lieberenz told the Board that the variation requested by tire Nonnamaker to the zoning ordinance was for the use of part of his property located on Nonnamaker Drive adjacent to 312 and 326 Nonnamaker Drive. This property is located in a R-2 Two Family Residential District. The applicant has a large tract of land on which he has been building rent houses. This tract has not been subdivided and made of record in the court house, but he has a proposed plat showing lot lay outs which has been used in past years. Lot 2 on his proposed plat has only a 41 -foot street frontage and has over 12,464 square feet in area. Mr. Nonnamaker has requested permission to build a residence on this lot; how- ever the zoning ordinance requires a 60 -foot lot frontage in this zoning district. After telling the Board what We Nonnamaker had requested permission to do, Mr. Lieberenz reviewed the past history of the plat. Mr. Lieberenz said that he had been issuing building permits to Mr. Nonnamaker for 8 or 9 years according to this proposed plat. Mr. Lieberenz explained recent action taken by the Planning Commission and City Council concerning the plat. J. I. Smith inquired about the size of house to be erected upon the lot. Mr. Nonna- maker said the house would be 24 by 43 feet with a detached garage. He said that he and Mr. Harold Lieberenz had designed the house to fit the lot. He mentioned his plans of building upon lots 1 and 2 a larger house, but the house trailer on lot 1 hindered these plans. The zoning ordinance, without Board of Adjustment approval, does not permit two buildings on one lot. Mr. Nannamaker said that the reason, in case the members were wondering, he had not filed a plat was because the land on the highway was zoned for commercial uses and he had had a couple of opportunities to sell. He did not know exactly how he wanted to divide the property. Mr. Nonnamaker felt that he had presented the facts and that he could give no inform- ation which would be beneficial. The Chairman, therefore, dismissed the applicant. The Board members carefully considered the request before them. Following a lengthy and detailed discussion, George Bowen moved that the Board of Adjustment deny the requested variation of the zoning ordinance to build a residence on lot 2; but since • the trailer on lot 1 is not a permanent structure and therefore can be easily and 92-2 quickly moved, that Yx, F. F. Nonnamaker be permitted to build one large house on lots 1 and 2 provided he meet the requirements of the zoning ordinance. The • motion was seconded by J. A. Pennington and passed unanimously.
