HomeMy WebLinkAbout1963-02-01 MinutesIis I E RID BOARD OF ADJUSTMENT MINUTES The Board of Adjustment met on Friday, February 1, 1963, at 3:30 p.m. in the City Council Room in the City Administration Building. Members present: J. I. Smith, T. M. Schiewetz, J. F. Robinson, J. A. Pennington and George Bowen. 8,000 square feet per lot was the minimum requirements. Applicants and others present: Joe Garrison; Reverend Terrel Gordon and Glen Nelson were present in behalf of the Immanuel Baptist Church; Flossie Thurmants daughter and Mrs. Forrest Scarbrough who is interested in purchasing Mrs. Thurman's property were both present; and Harold E. Lieberenz, City Inspector. J. I. Smith called the meeting to order. The minutes of January 4, 1963, were approved as written and mailed to the members prior to this meeting. Joe Garrison was the first applicant to be heard. Mr. Garrison who lives at 1786 North Leverett Avenue requested a variation from the zoning ordinance for the use of property known as the west 141.63 feet of lot 4 of Block 10 in Parker's Plat of Valley View Addition. Harold Lieberenz said that the applicant had purchased a large platted lot which he wanted to divide into smaller lots. The two lots facing Ash Street had been approved by the Planning Commission; however the lot fronting on Leverett Avenue and the lot on the northeast corner of Leverett Avenue and Ash Street will not have the amount of street frontage required by the zoning ordinance. T. M. Schiewetz asked what the minimum lot area requirements were in the R -1B zone. The City Inspector replied that 8,000 square feet per lot was the minimum requirements. Mr. Lieberenz mentioned that Mr. Garrison had recently hired a surveyor to survey his property. After the survey was made, it was learned that the house in which Mr. Garrison now resides (1786 North Leverett) was closer to the south line than what Mr. Garrison thought. Mr. Garrison said that under the circumstances he would rather the lot on the corner have the required 70 foot street frontage and that the lot which his present house is located upon have a 54.42 foot street frontage. The Board members had no additional questions, so the applicant was dismissed. j The application of the Immanuel Baptist Church was the second one to be considered by the Board. Reverend Terrel Gordon and Glen Nelson were at the hearing to represent the church and answer any questions the Board members might have. The variation requested to the zoning ordinance was for the use of the property located on the southwest corner (church building location) and the northwest corner (another lot owned by the church) of Duncan and Stone. This property is located in a R-3 Multi- family Residential District. Harold Lieberenz said there were several problem involved: In this 33 zone the Board of Adjustment must approve any remodeling of a church structure; the lot area is less than that required by the zoning ordinance; the setbacks will be much less than those required under the ordinance; and the number of parking speces will be less than the number required by the zoning ordinance. George Bowen asked about parking across the street. Reverend Gordon said that the church owned a lot on the northwest corner of Duncan and Stone. A house is on this lot; however parking could be provided on the rear of this -lot. Reverend Gordon pointed out that only a limited number of cars could park on the lot; he did not have any idea just how many spaces could be provided. T. Pi. Schiewetz wanted to know if the area shown on the sketch mailed to the members was now used for parking. Reverend Gordon replied yes. Also, Reverend Gordon said that even more cars parked in. the area than were indicated on the drawing. When asked if any comments had been trade by the neighbors in the vicinity of the church, Mr. Lieberenz'said he had not heard any. There being no further discussion, the applicants were dismissed. The third application was that of Flossie Thurman. Mrs. Thurman could not be present; however her daughter and the party who planned to purchase the lot (Mrs. Forrest Scarbrough) were present. The variation requested to the zoning ordinance was for the use of the property located behind 222 Pall Avenue. This property is located in a C-2 Thoroughfare Commercial Zone, 0I Harold Lieberenz explained to the Board members that from the information he had been given the applicant owned all of lot 8 in Block 2 in Boles Addition after the city had adopted zoning regulations in 1951. In 1955 she had sold the front part of the lot to someone else and retained a part of the property in the rear • adjacent to a public alley. Now she requested permission to erect a residence on this 75 by 100 foot lot which was the retained portion of the original lot. The ordinance requires that a piece of property must have a frontage on a street before a permit can be issued. Mrs. Thurman's daughter told the Board that the lot was vacant; and the alley offers an entrance and exit. She felt it would be better to make use of the lot and in her opinion no damage would be done to her neighbors. The future builder had building plans which she displayed for the benefit of the Board members. T. M. Schiewetz inquired if there were any objections from the neighbors. Mr. Lieberenz said that Captain Hardin and another property owner (property south of 222 Mill Avenue) had stated their objections. There was no further discussion, and the applicant and interested person were dismissed. T. Me Schiewetz moved that the Board of Adjustment deny the request of Flossie Thurman to build upon a lot with no street frontage. The motion was seconded by J. F. Robinson and passed unanimously. 0 g9-2 After a brief. discussion, T. M. Schiewetz moved that the Board of Adjustment grant the application of Mr. Joe Garrison provided lot B (as per sketch attached hereto) has a street frontage of 70 feet. The motion was seconded by J. A. Pennington and passed unanimously. �A motion was made by J. F. Robinson and seconded by George Bowen that the application of the Immanuel Baptist Church be granted and that as much off-street parking as possible be provided on the lot on the northwest corner of Duncan Avenue and Stone Street.
