HomeMy WebLinkAbout1962-11-23 Minutes75-2 BOARD OF ADJUSTMENT MINUTES • The Board of Adjustment met on Friday, November 23, 1962, at 4:00 p.m., in the City Council Room in the City Administration Building. Is Board members present: Mr. T. M. Schiewetz, Mr. J. F. Robinson and Mr. George Bowen. Board members absent: Mr. J. I. Smith and Mr. J. A. Pennington. Applicants and others present: Applicants present were Mr. E. E. Phillips and Mr. Morse Craig of The Sport Center. Mr. Harold E. Lieberenz, City Building Inspec- tor, was also present. Mr. T. M. Schiewetz was in charge of the meeting in the absence of Chairman J. I. Smith. Mr. Sbhiewetz called the meeting to order. The minutes of the last meeting had not been mailed to the members prior to this meeting; therefore there were no minutes to be approved. The first application to be considered by the Board was that of Mr. Morse Craig of the Sport Center. The variation requested by Mr. Craig to the Zoning Ordinance was for the use of the property located at 39 East Mountain Street. This property is known as lot 2 of the Subdivision of Block 29 of the Original Plat to the City of Fayetteville, Arkansas, and is located in a C-3 Central Commercial Zoning District. The City Zoning Ordinance limits the size of a sign erected on the business building to four (4) feet if the sign projects out from the building. The applicant wanted to erect a sign on the front of The Sport Center which would project approximately five and one-half (5J) feet out from the building. Mr. Schieoietz asked Mr. Craig 1f he had already purchased the sign. Mr. Craig ax- plained that he had obtained the sign. While the.Sport Center was being operated on North College Avenue he had an opportunity to purchase the sign for a reasonable amount. He stated that he..was not aware of the ordinance requirement on signs. Mr. Craig said that the sign he wanted to erect was 5 feet in length (.51. feet includ- ing all the brackets) and 4 feet in width. Mr. Craig pointed out that his sign would not protrude any farther than other signs on the street. He stated that his advert- ising was handicapped in the respect that the building was not only located on a one- way street, but also was almost the last building on the street. Mr. Harold E. Lieberenz, City Building Inspector, said he had received no complaints or objections to the applicant's request to erect the sign. Since there were no further questions, the applicant was dismissed. The last application to be considered was that of Mr. Emery Be Phillips. The vari- ation requested by Mr. Phillips to the Zoning Ordinance was for the use of the pro- perty located at 418 West Meadow Street. This property is located in a R-4 Multi- family Residential and Dormitory District and is known as part of lots 5 and 6 of the subdivision of Block 9 of the Original Plat to the City of Fayetteville, Arkansas. The applicant's property is in a multi -family district; however the lot area is approx- • imately 7,260 square feet. The Zoning Ordinance requires a lot area of 7,500 square feet inorder to put 3 apartments in a residence located on this lot. This lot is short 236 square feet of this requirement. 76-2 The applicant is remodeling the building and has two families in it at the pres- ent time. He would like to create another apartment in the building. The present roof line, however, will not be enlarged as the proposed apartment • would be in the basement. Also Mr. Phillips has ample area for off-street parking. Mr. Lieberenz said he had received no objections from the property owners in the area. Mr. Phillips stated he had no additional information to furnish; therefore he was dismissed. Mr. J. F. Robinson moved that the Board of Adjustment grant Mr. E. E. Phillips' request for a variation from the zoning ordinance. The motion was seconded by Mr. George Bowen and passed unanimously. Mr. George Bowen stated that Mr. Morse Craig did have a problem of advertising since his building is located on a onemway street and there already being several signs in the area which protrude out farther than required by the ordinance; therefore Mr. Bowen moved that the Board of Adjustment approve the variation from the zoning ordinance requested by Mr. Morse Craig.
