BOARD OF ADJUSTMENT MINUTES
• The Board of Adjustment met on Friday, April 27, 1962, at 4:00 p.m. in the Police
Court Room in the City Administration Building.
Members present: Mr. J. I. Smith, Mr. T. M. Schiewetz, Mr. G. Bowen and Mr. J.
Pennington.
Members absent: Mr. J. F. Robinson.
Others present: Mr. James A. Wilson, Assistant City Inspector, Dr. John G. Sugg and
Mrs. Exie Hardy, applicants. Also present were Mr. and Mrs. C. B. Wiggins and Ar. C.
C. Blair.
The meeting was called to order by the chairman. The minutes of I -arch 23, 1962, were I
approved as corrected and mailed to the members of the Board. The minutes of April 13
1962, were approved as written and mailed to the Board of Adjustment members. ,
The first applicant to appear before the Board was Dr. John G. Sugg. In the absence
of the City. Inspector the secretary of the Board of Adjustment explained Dr. Sugg's
request to the Board. The variation requested by Dr. Sugg to the zoning ordinance
was for the use of property just south of Mr. C. B. Wiggins' residence at 935 Sunset
Drive and on Mr. Wiggins' property.
Mr. Wiggins and Dr. Sugg own the land jointly. Mr. Wiggins has a guest house on his
property just south of his house. Dr. Sugg wants to erect a new residence and attach
• it to the existing guest house. Only one house is permitted on each lot unless there
is enough lot area and street frontage for two houses. There is not enough street
frontage to comply with the requirements of the zoning ordinance. Dr. Sugg wants to
construct the proposed house in this location because of the view he will have from
the location.
Dr. Sugg said there was about 62 feet from the car port on the south side of the
Wiggins} residence to the north property line. The lot frontage should be 75 feet.
Dr. Sugg added that he needed a larger house because of the size of his family.
Mr. Schiewetz asked Mr. Wiggins if he had any objections to the proposed arrangement.
Mr. Wiggins did not have any objections.
There was no further discussion, and the applicant was dismissed.
The second applicant was Mrs. Exie Hardy. The variation requested by Mrs. Hardy to
the zoning ordinance is for the use of the property located at 573 North Walnut Avenue.
This property is located in a R -1B Single Family Residential District.
The applicant requests permission to erect an open car port in the front yard and to
attach the car port to the front of her house. The proposed car port will only be
approximately five (5) feet from the front property line instead of the twenty-five
(25) feet required by the zoning ordinance.
A petition was presented to the Board members. The petition stated that Mrs. Hardy's
neighbors to the north and south and across the street did not have any objections to
• the construction of the proposed car port.
Mrs. Hardy said her lot was very deep. The drive goes back to a double garage at the
rear of the lot. To use the drive and the garage was not convenient, especially in

the winter. Yrs. Hardy said her health was not good and when she had to
walk in the weather, it did not help her health. She added that she had had an •
experience similar to the women living in the University of Arkansas area who
had been attacked. She also said that there are several children in the neighbor
hood and it was difficult to see the children when backing out of the drive
because of the location of the drive way. She said she wanted to make her home
as convenient as possible.
i:r. Bowen asked the applicant if the car port could be built behind the house.
Mrs. Hardy said she and her carpenter had discussed this problem, but she did
not want the car port behind the house. Mr. Pennington suggested that if the
garage were put behind the house, a drive with a turn -around be constructed.
Mrs. Hardy did not want the lawn -ruined by making a'turn-around in the back*
yard as suggested by hr. Pennington.
T:r. Pennington asked if there was a porch or rear entrance. Mrs: Hardy stated
that there was no rear entrance, but there was no rear entrance, but there was

Kr. Schiewetz wanted to know -who -owned and used the other part of the double
garage. t:rs. Hardy said she owned the entire garage, and the renters used
their part of the garage for storage since they did not have a car. 1-trs. Hardy
said she owned lot 13 and part of lot 14.
Yx. Pennington asked Frs. Hardy if the drive sloped. Pars. Hardy said no; the
drive was level and was on the north side of the house. She said that the ice
and snow did not melt quickly during the winter.
Mr. Schiewetz asked if there were any street lights in the area; if so, where •
was the light located. P•rs.• Hardy said there was a street light on'Johnson
Street and TJalnut Avenue.
Mr. Bowen wondered if the street frontage of•the houses in the area was about
the same. The map:showed that the houses in the area have about the same street
frontage. .
Kr. C. C. Blair who owns property which abutts Mrs. Hardy's property requested
that Ers. Hardy be required to comply with the ordinance. Kr. Blair mentioned
that Ers. Hardy had two homes on her lot. -The little house is below -the -sewer
level and causes trouble. She has a garage which is used for storage and now
she wants to build onto the.front of her house.
There was no further discussion, and the applicant was dismissed.
Mr. Bowen moved that the Board of Adjustment grant Dr. 'John'G.-Suggts appli
cation for a variation from the city zoning ordinance. The motion was seconded
by Kr. T. Schiewetz and passed unanimously.
Mr. Schiewetz moved that the Board of Adjustment deny Mrs. Exie Hardy's
request for a variation from the city zoning ordinance. The motion was seconded
by Kr. Pennington and passed unanimously.
