Present: Kr. John I. Smith, Mr. George Bowen, Mr. Harold Lieberenz and applicants,
Mr. C. E. Yerton and Mr. V. F. Yerton and Mr. John Maquire who represented
the Evelyn Hills Shopping Center.
Absent: Mr. Tom Schiewetz and Mr. J. F. Robinson.

called the meeting to
order.
The minutes
of the
last
meeting,
October 27, 1961, were approved as mailed
to all
members prior
to the
meeting.
The first application was that of brothers, Mr. C. E. Yerton and Mr. V. F. Yerton.
The variation requested by Mr. C. E. Yerton and Mr. V. F. Yerton is for the use of
the property located on the west side of Highway 71 South just north of the air port
hill. This is located in a R -IA Single Family Residential area until it is rezoned by
the City Planning Commission.
Mr. Lieberenz stated that the applicants wish to erect one new dwelling behind each of
their existing homes. The City Zoning Ordinance generally prohibits a person building
in the rear of another house; however Section 3 of Article VI of the City Zoning Ordi-
nance No. 1239 does permit this under certain conditions if approved by the Board of
Adjustment.
Ns. C. E. Yerton and Mr. V. F. Yerton explained what they planned to do. At the present
they do not wish to subdivide their land. Incase they should want to subdivide in the
future they plan to build the two proposed houses in such a manner that no setback
problems would exist and they plan to leave room for a future fifty -foot street. The
two proposed houses would be about fifty (50) or sixty (60) feet west from the existing
houses.
Mr. Lieberenz said the setbacks of the proposed houses complied with the ordinance
except they are not located on a platted street.
There was no further discussion, and the applicants were dismissed.
The second applicant was Mr. John Maquire. The variation requested by Mr. quire to
the Zoning Ordinance is for the use of the property located in the Evelyn Hills Shopping
Center on North College Avenue. This property is located in a C-2 Thoroughfare Commer-
cial District.
Mr. Lieberenz told the members the applicant has asked the Board
of Adjustment
to study
and give a ruling on whether
or not a dry cleaning shop using non
flamable dry
cleaning
fluid could be placed in the
C-2 Thoroughfare Commercial Zone,
Ns. Lieberenz read from the Zoning Ordinance the uses permitted in C-1 and C-2. The
uses permitted in a C-1 Neighborhood Commercial District will permit only a "pick up
station" for dry cleaning. The uses permitted in the C-2 Thoroughfare Commercial
District are the same as the Neighborhood Commercial with some other additional uses.
There was no further discussion, and the applicant was dismissed.
• Mr. Bowen moved that Mr. Maquirefs application requesting to use non flamable liquid

in a dry cleaning shop be granted. The motion was seconded by Mr. Pennington
and passed unanimously. •
Mr. Pennington moved that the Board accept Mr. C. E. Yerton and Mr. V. F.
Yertonts application. Mr. Bowen seconded and the motion passed unanimously.
The meeting adjourned.
