MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENT
October 27, 1961, 4:00 p.m. City Council Room
• Present: Mr. John I. Smith, Mr. James A. Pennington, Mr. Tom Schiewetz, Mr. Harold
E. Lieberenz and the following applicants: Pr. Paul Bond, Mr. Charles
Clinehens and Mr. Dick Johnston.
Absent: Mr. George Bowen and Mr. J. F. Robinson.
The meeting was called to order by Chairman John I. Smith. The minutes of the last
meeting were approved as mailed to the members prior to the meeting.
The first applicant was Mr. Paul Bond. The variation requested by Mr. Bond to the
Zoning Ordinance is for the use of the property located on the southeast corner of the
intersection of Leverett Avenue and Cleveland Street. This property is located in a
R-3 Multi -family Residential District.
The applicant wants to build two duplex residential buildings on this lot. The vari-
ances requested by Mr. Bond are: He has 9,187.5 square feet of lot area. The Ordinance
requires 14,000 square feet for the two buildings to be on this lot. These buildings
would only be 8 feet from the side property lines and 2 feet from the rear property
line. Also, the applicant wishes to have "off -the -street" parking in the front which
is prohibited by the Ordinance.
Mr. Bond said he could pull the buildings to the north back south a few feet from
Cleveland Street. It would cut down on the play area. The reason for designing the
buildings as they are is that it makes a nice play area between the buildings.
• Mr. Lieberenz said the Ordinance requires 15 feet from side intersecting streets. The
north building needs to be 15 feet from Cleveland, 20 feet from the east property line
and 5 feet from the south property line.
Mr. Smith was in favor of pulling the building back 3 feet to the south; therefore the
requested variance from the north (Cleveland Street) property line would be 4 feet
instead of 7 feet.
The Zoning Ordinance requires parking to be in the rear or on the sides. All of Mr.
Bond's parking will be "off -the -street" parking in the front of the buildings. Mr. Hord
said the parking area will slope towards the street. There will be a retaining wall
between the yard and the parking area.
Mr. Schiewetz asked Mr. Bond if he had talked to the neighbor to the south. Mr. Lie-
berenz said the neighbor, Mr. Baker, had been in the Building Inspector's office.
Mr. Baker was concerned about his sewer line which runs across the rear of Mr. Bond's
lot.
There was no further discussion, and the applicant was dismissed.
Mr. Charles Clinehens was the second applicant. The variation requested by Mr. Clinehe

to the Zoning Ordinance is for the use of the property located at 245 Louise Street.
The property is in a R -1B Zone.
Mr. Clinehens wants to build a front porch on his house. This front porch roof will
• be approximately 24 feet from the street property line or about 1 foot closer than per-
mitted by the Zoning Ordinance. He, also, wishes to erect additional living space on
the rear (south) of his house. This addition will be approximately 1421 feet from the
alley line instead of the 30 feet required by the City Zoning Ordinance.

Mr. Clinehens said the porch would extend out more than his neighbors porch. The
porch will have a roof but wil' not be enclosed.
There was no further discussion; the applicant was dismissed.
The third applicant was Mr. Dick Johnston. Mr. Johnston acted on behalf of the Farm
Bureau Cooperative. The variation requested by Mr. Johnston to the Zoning Ordinance
is for the use of the property located on the southwest corner of the intersection
of Highway 71 South and Highway 62 West. This property is located in a C-2 Thorough-
fare Commercial District,
The Farm Bureau wants to remodel the building and install another gas pump island
fronting Highway 71. The pump island will be in line with the existing pumb island,
but it will only be 11 feet and 8 inches from the street property line. The zoning
regulations require a 15 -foot setback.
The
applicant
has obtained permission from the State
Highway Department in
the
form
of
a written
permit to erect the new pump island in
line with the existing
pump
island.
There were no further questions, and the applicant was dismissed.
Mr. Schiewetz made a motion to reject Mr. Paul Bond's application unless Mr. Bond, after
conferring with the Building Inspector, is able to work out another proposal. Ns. Penn-
ington seconded and the motion carried unanimoulsy.

Mr. Lieberenz read a statement signed by the property owners stating they had no objections
to Mr. Clinehens' proposed addition.
Mr. Schiewetz made a motion to approve Mr. Clinehens' application. Mr. Pennington •
seconded. The motion carried unanimously.
Mr. Schiewetz
made a
motion to grant Mr.
Johnston's application.
Mr. Pennington
seconded the
motion.
The motion carried
unanimously.
Mr. Smith brought before the members of the Board Dr. Butler's tentative building
problem. No official application was made by Dr. Butler. The Board did not wish
to make any preliminary opinions.
The meeting was adjourned.
