MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENT
• September 22, 1961, 4:00 p.m. City Council Room
Present: Mr. John I. Smith, Mr. Tom Schiewetz, Mr. J. F. Robinson and Mr. George
Bowen; Mr. Harold Lieberenz and the applicant, Mr. J. V. Wilson.
Absent: Mr. James A. Pennington.
The meeting was called to order. The minutes of the last meeting were approved as
mailed to the members prior to the meeting.
Mr. J. V. Wilson is requesting a variance for the use of the property located on the
corner of Lindell Avenue, Mt. Comfort Road and North Street. This property is located
in a C-1 Nieghborhood Commercial Zone.
The property owner requests permission to erect a commercial building with off -the -
street parking on three sides. The parking will be angle parking and will be counter -
clock wise.
Ms. Lieberenz said according to the Zoning Ordinance, the front of the building must
be back 15 feet with no parking or 40 feet with parking. In regard to the intersect-
ing streets the building has to be set back 10 feet from the existing street right-of-
way or from the future widening line required by the Major Street Plan if no parking
is permitted between the building and the side intersecting streets. However, if park-
ing is permitted between the building and the side intersecting streets, the setback
must be 40 feet from the street right-of-way or the proposed widening line.
• Under the Major Street Plan, Mt. Comfort Road and North Street will be widened. Both
streets if widened will take 10 feet of Mr. Wilson's property. Mr. Wilson said he had
already given 20 feet of his land for North Street should the street be opened, and
now he may have to give another 10 feet for this street. He felt that giving another
10 feet of his property would be unfair.
Mr. Lieberenz told the Board members that he had directed Mr. Wilson to the Planning
Commission and the City Council before the Board of Adjustment had its meeting.
Mr. Lieberenz had hoped that the Council or the Planning Commission could have given
the Board some relief on this problem by removing either North Street or Mt. Comfort
Road from the proposed Major Street Plan.
Mr. Wilson explained to the members what he planned to do. He plans to put a sixteen -
foot drive on the east side of the proposed building and have parking on the remaining
three sides. He said there would be no special frontage to the building since there
would be doors on three sides and the three sides would be enclosed with glass.
Mr. Schiewetz asked Mr. Wilson where the entrances would be. Mr. Wilson said he eventu-
ally would build a wall. to put him level with the floor of his building so that people
would come off Mt. Comfort Road. Lindell Avenue and North Street would also be used as
entrances and exits.
Mr. Smith saw no reason to have two main streets

He was referring to North Street and
• Mr. Schiewetz was concerned about the angle parking. He said he did not see how the
people could back out of a parking space within 22 feet without backing onto the street.

Mr. Smith thought perhaps Mr. Wilson could move the proposed building •
more to the south (closer to North Street) with no parking on the south
aide. This arrangement would give more distance from Mt. Comfort Road,
and there would be more room for parking.
There was no further discussion, and the applicant was dismissed.
After a very long discussion, Mr. Robinson moved the the application be
granted as follows: A variance of ten (10) feet be given on North Street from
the proposed widening line and no parking be permitted between the building
and North Street. A variance of twenty-six (26) feet from Lindell Avenue
be granted and a thirty-seven (37) -foot variance from the existing property
line on Mt. Comfort Road. Or, should the City Council choose to eliminate
Mt. Comfort Road from the Major Street Plan and Mr. Wilson choose to move
his building toward Mt. Comfort Road, then the Board would approve a variance
in such a way that the building be ten (10) feet from Mt. Comfort Road with
no parking between the building and Mt. Comfort Road and a twenty -six-foot
variance from Lindell Avenue and a thirty -seven -foot variance from the
proposed North Street widening line be granted.
The meeting was adjourned.
