HomeMy WebLinkAbout1961-09-11 Minutes• CI • 17-2 MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENT September 11, 1961, 4:00 p.m. Court Room Present: Mr. George Bowen, Mr. Tom Schiewetz, Mr. James A. Pennington, Mr. Harold Lieberenz and applicant Mr. H. C. Agee. Absent: Mr. J. F. Robinson and Mr. John I. Smith. Mr. Bowen presided as chairman in the absence of Chairman John I. Smith. The minutes of the last meeting were approved as mailed to the members prior to the meeting. The variation requested by Mr. H. C. Agee is for the use of property located at 333 East Sixth Street. This property is located in a R-2 Two-family Residential Zone. Mr. Agee tore down a building which was a partnership garage for his neighbor and a storage building for himself. The building was half on his property and half on his neighbor's property to the west. His neighbor did not want his part rebuilt, so Mr. Agee tore down the building and rebuilt the part on his property for a storage building. He rebuilt the building on his west property line and poured a concrete floor inside the building before he acquired a permit. The Zoning Ordinance states that the building has to be five (5) feet from the west property line before a permit can be issued. Mr. Schiewetz asked if the building was completed. Mr. Agee said it was almost finished. Mr. Agee said he was ignorant to the fact that a building permit was necessary when a structure was torn down and rebuilt. He considered rebuilding as remodeling and never thought about the permit. Mr. Schiewetz asked if there had been any complaints from the neighbors. Mr. Agee presented the signature of his neighbor to the west of his property. His neighbor did not object. Mr. Pennington asked Mr. Agee if he planned to build a garage at any time. Mr. Agee said no. There is not enough space. There was no further discussion, and the applicant was dismissed. Mr. Schiewetz made a motion to grant the variance. Mr. Pennington seconded and the motion passed unanimously. The Board members requested a combined meeting of the City Council, Planning Commission and Board of Adjustment.
