MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENT
July 18, 1961, 3:00 p.m. City Council Chambers
• Present: Mr. John I. Smith, Mr. J. F. Robinson, Mr. Tom Schiewetz, Mr. James A.
Pennington, Mr. Harold E. Lieberenz and applicants: Mr. H. P. Merritt,
representing Safeway Stores Incorporated; Mr. and Mrs. R. L. Jeske;
Mr. 0. H. Gamble; Mr. King Wheeler; and Mr. Cy Carney, Jr., accompanied
by Mr. Carl Tune and Mr. Barnes.
Absent: Mr. George Bowen
The meeting was called to order by Chairman John I. Smith. The minutes were
approved as written and mailed to the members prior to the meeting.
The first application was that of Mr. Cy Carney, Jr. A variance is requested for
the use of property on South School Avenue. The property is in an I-2 Industrial
Zone.
Mr. Carney wants to build an addition on the front and on the south side of the
existing sheet -iron building. The proposed addition will be closer than fifty (50)
feet from the street property line (existing building is forty-five (45) feet from
street) and closer than twenty-five (25) feet from the north property line.
Mr. Lieberenz said that Mr. Carney proposed to move the existing frame sheet -metal
building to another place on the lot and leave a space between the concrete section
and the new proposed building. The same set backs would be retained.
Mr. Smith asked if there were any objections to this application. Mr. Lieberenz said
• that no property owners in the area had complained to his office. There were no
further questions, so the applicant was dismissed.

The second application was that of Mr. 0. H. Gamble. Mr. Gamble requested a
variance for the use of the property located at 617 North College Avenue. The property
is in a C-2 Thoroughfare Commercial Zone.
The applicant wants to remove an eight (8) feet concrete front porch and build an
addition on the front of the existing building. This addition will extend approxi-
mately fourteen (14) feet toward College Avenue and will be closer to the College
Avenue street widening line than forty (40) feet. Therefore Mr. Gamble is asking for
a five (5) or six (6) feet variance from the east.
Mr. Gamble asked permission
to use beams that are eight
(8)
inches longer than the
fourteen (14) feet.
There were no further questions. The applicant was dismissed.

The third application was that of the Safeway Stores, Incorporated. The Safeway
Stores, Incorporated was represented by Mr. H. P. Merritt. A variance is requested by
the Safeway Stores, Incorporated for the use of property at 612 North College Avenue.
This property is in a C-2 Thoroughfare Commercial Zone.
A proposed addition is to be built on the south side of the existing building. The
roof overhang of this proposed addition will be fifteen (15) feet and three (3) inches

from College Avenue property line. The roof of the new addition will be •
approximately five (5) feet farther from College Avenue than the existing
west wall of the building.
Mr. Smith wondered if it would be possible to pull the proposed building
back from North College more to the east than to the west. He felt that the
building was too close to the street.
Mr. Merritt explained that if the building were to be pulled back more to
the east, then it would present a drainage problem due to the slope in the
area.
The applicant was dismissed.

The last application was that of Mr. R. L. Jeske. A variance is requested
for the use of property at 129 Boles Street. The property is in a R-4 Residential
(Multi -family) Zone.
Mr. Jeske wants to build two new apartments in his basement. This will make
a total of three apartments in the building. The lot is 60 feet by 80 feet or
4,800 square feet, and the ordinance states that a building with three apart-
ments should be on a lot not smaller than 7,500 square feet in this residential
zone. There will be no outside additions to the building.
Mr. Jeske explained what he had planned to do within his building. He stated •
that he had plenty of parking space. He plans to rent the apartments to
couples instead of ten or more boys that he could put in the building under the
City Zoning Ordinance.
No one

Jeske or to the
City Building
Inspector.
There
were
no further
questions,
so the
applicant was
dismissed.

Mr. Schiewetz made a motion to defer action on Mr. Cy Carney's:application until
the members had a chance to discuss the situation further. Mr. Robinson seconded
and the motion carried unanimously.
Mr. Robinson made a motion to grant Mr. Gamblets application. Mr. Schiewetz seconded
and the motion carried unanimously.
Mr. Robinson made a motion to grant Mr. Merritt (Safeway Stores, Inc.) application
after a lengthy discussion. Mr. Schiewetz seconded. The motion passed unanimously.
Mr. Schiewetz made a motion to grant Mr. Jeske's application. Mr. Pennington.
seconded. The motion passed unanimously.
The Board members asked if the minutes of the meetings could be shortened because
they did not have the time to read long minutes. The meeting wwaa�sy adjourned.
