MINUTES OF. A MEETING.OF BOARD OF ADJUSTMENT
FRIDAY, DECEMBER 9, 1960, 4:00 p.m.

the
meeting to order. The Minutes of the last
meeting were approved as mailed to
the
memeber of the Board.
Mr, George M. Small of the Episcopal Church requested a variation from the require-
ments of the Zoning Ordinance for the use of the property located on the North sideof
Maple Street and on the West. side of the public alley running north and south between
Leverett and Storer Avenues. The property is located in a R-4 Residential Zone, and
is known as Lot 11, Block 1 of Leverett's Third Addition to the City of Fayetteville,
Arkansas. Mr. Small asked the Board to approve the erection of a student center on
this lot. The proposed building would have a chapel and a lounge and would accommodate
40 to 45 University students.
Mr. Small made the following requests for variances to be approved by the Board:
1. Approval of the use in this zone.
2. Front yard

of the depths of the
front yards
on both sides of the proposed
building.
3. To
supplement the required "off-street" parking on the
rear of their lot (Lots 4 and
5)
at 536 Storer
Avenue. The Zoning Ordinance allows

problem.

Mr. Lieberenz stated that, since the building would be designed to accommodate only
40 to 45 people, it would not be considered a public assembly, and therefore, would
require only the residential setbacks --25 feet in back and 5 feet on the sides. He stated
that the Ordinance would require the building to be set back the average setback of the
buildings on each side, which would be approximately 45 feet. He said that Mr. Small
would like to have the permission of the Board to build a close to the street as one of
these buildings, which would be approximately 35 feet.
Mr. Small stated that
his purpose was to find out if they
would be able to build a student
center on the lot. He
said that his church
had not yet purchased the property and wished
to know before purchasing if they would be
able to utilize
it. He said that he was a
one-man fact-finding
committee as far as
his bishop was
concerned. He stated that the
owner of the property
had agreed to sell it
to the church,
but that was as far as they
had gone.
Mr. Bowen stated that he did not believe that the people realized just how much good the
student centers did at the University. Mr. Smith stated that he believed there should be
a provision for student centers in the Zoning Ordinance. Mr. Schiewetz inquired about
the objections of the nearby residents. Mr. Small stated that the only problem had been

with a neighbor to the south --a sewer problem. He said that he believed it could be
worked out satisfactorily. He said that none of the neighbors had objected to .the
building of a student center on the lot. I 1 •
The Chairman.asked if there were any other questions for the applicant. There were
none, and the applicant was dismissed.. After a short discussion, the Board agreed to
vote on the problems as outlined above:
1. Student center use in the area - approved unanimously.
2. Setback requirement - changed to 35 foot requirement in front of the building -
approved on condition that the building would accommodate no more than 40 to 45
people.

There was no further discussion, and the Board adjourned.
