Robinson Mr: George Bowen Mr. Tom Schiewetz Mr. James A. Pennington Mr. Harold E. Lieberenz Mr. D. L. Smart, applicant Mr. T. I.` Abshier, applicant Mr. Ben Jameson; appearing in behalf of Dr. R. E. Lingelbaugh, applicant appearing in behalf of Marjorie O. Budd, applicant Mr. John I. Smith, Chairman, called the meeting to order, and asked the secretary to read the minutes. The minutes were read and approved. There was a discussion about the length and detail of the minutes. It was decided that, since the meetings were very long and the reading of'the minutes required a considerable amount of time, the secretary would mimeograph and mail the Minutes to the members' of the Board prior to`the meetings. They would then be approved and/or corrected at the meetings after the Board had had an opportunity to read them. The first application before the Board was that of Mrs. Marjorie O. Budd, who wished to repair and remodela building at 600 South Government Avenue, in order that'a church group could use it as a temporary meeting place. The property is located in an I -'1B Industrial Zone of the City, and -church occupancy is noto allowed in that area. It was established that the church group would meeting in the building only through the winter, or until they could obtain another place to meet. ' There are about 25 people in the group. The question is in the use, not in the repair of the building. Very little work is actually to be done on the building, and it would have been done whether the church group had wanted to meet there or not. The neighbors did not object to the church people's meeting there temporarily. The water, lights; land gas are already'ixi the''buil'ding. There is room for about fifty cars to park. The Board agreed that there were no further questions, and the representatives were dismissed. --- 0 --- The-next applicant was Mr. D. L.' Smart; owner of the`Dairy'Queen Drive -In at, 700 North College Avenue. He wished to erecta 2' x 5'2" sign on existing steel sign posts. The, bottom of the sign would be about eight feet from the ground. The west edge of the sign would be only a few inches from the College Avenue proerty line, instead of the ten feet i required by the City Zoning Ordinance. The property/located in a C-2 Thoroughfare Commercial Zone of the City of Fayetteville. , The Board wondered how far the sign would be from the sidewalk. Mr. Lieberenz stated that the sidewalk was the College Avenue property line, and the sign would be only a few inches from it. It was also established that there was canopy covering the sidewalk in front of the building, which would be closer to the street than the proposed sign. Mr. Schiewetz asked the applicant if the sign would be difficult to move if College Avenue were widened. The applicant stated that it would be fairly easy to move, and that he would have to move his entire building if the highway were widened. There were no further questions, and the applicant was dismissed. 16q ' - 2 - The next application was that of Dr. R. E. Lingelbaugh of 510 Fallin Avenue. Dr. Lingelbaugh was represented by Ben Jameson. The applicant wished to `erect a 10' x 20' • + metal carport on the South side of his house, which would be even with the front of his house. It would be approximately three feet from the South property line at the Southeast corner and five feet at the Southwest corner, instead of the eight (8) feet required by the City Zoning Ordinance. The Board established that there had been no objections from neighbors. They also pointed out that the cement slab for the carport was already in place, since there were no regulations on cement construction. Mr. Lieberenz stated that the carport would be about 16. 5 feet from the property line on the South. There were no further questions, and Mr. Jameson was dismissed. The next applicant was Mr. T. `I. Abshier of 240 Oakwood Street, who wished to remodel his home, which is located on the edge of a C-2 Thoroughfare Commercial Zone of the City. The Boardcf Adjustment must approve any remodeling of a residence in a Commercial Zone. Mr. Abshier wished to build an attached carport which would extend 22 feet to the west of the house, and would leave about twenty feet to the side property line. He also plans a small addition to the rear of the house, but there would be much more than forty feet left after the proposed extension. Mr. Lieberenz pointed out that there would be plenty of setback for both proposed extensions. The question was remodeling a residential building in a Commercial Zone. Mr. Schiewetz stated that he believed only about 15 feet of the lot was in the Commercial Zone. Mr. Lieberenz agreed that this was about right. There were no further questions, and Mr. Abshier was dismissed. The Board voted unanimously to deny the application of Mr. D. L. Smart. The Board unanimously approved the application of Dr. R. E. Lingelbaugh. A motion was made by Mr. Schiewetz and seconded by Mr. Bowen to approve the application of Marjorie O. Budd, on the condition.that the church would be allowed to use the building for only one year. The Boardivoted unanimously in favor of the application with this condition. The Board voted unanimously to approve the application of Mr. T. I. Abshier. There was no further discussion, and the Board adjourned. a 165
