Prior to the meeting time, the Board agreed to elect Mr. John I. Smith as
x�permanent chairman of the Board. Mr. Smith presided at the meeting. - d

The first a plication was that of Mrs. J. Turner Brown, who wished to petition
the Board to allow her to install a kindergarten at 408 West Lafayette Street.
This property is in a R-4 Residential Zone, and a kindergarten could be installed
there only on approval of the Board of Adjustment.
• Mrs. Brown stated that she had taken out her permit to enlarge the building at
the first of the year in order to meet a time deadline - the opening of school.
Mr. Lieberenz stated that the question was not enlarging the building, only the
kindergarten use in a Residential -Zone.
Mr. Smith asked how much of itkKxax1d6bm=±s the house would be used for the
kindergarten.. Mrs. Brown stated only the addition and the basement would be
used in the kindergarten, and that she would have two assistants.
Mr. Schiewetz asked if the location mt be ng�rous�ch�en because of
the motorcycle repair shop nearby. ( iia rou t ou at she had ordered
a fence, which would be placed around the entire lot before the school opened).
Mr. Robinson asked if. it would be considered a place of assembly. Mr. Lieberenz
stated that. according to the Zoning Ordinance, it is not a place of assembly.
Mr. Smith asked if there had been any complaints since the sign had been posted
on the property. Mr. Lieberenz stated that there were none. The Chairman
asked if there were anymore questions for the applicants. There were none
and Mrs. Brown left the -room.

• The.aext application to be considered by the Board was that of Mrs. Earl Stewart
at 325 South School. Her property is located in a C-2 Thoroughfare Commercial
Zone. She wishes to enlarge a back porch and glass it in. This is a residential
building in a commercial. zone, therefore, it cannot be remodelled without the
approval of the Board of Adjustment.

Mr. Lieberenz stated that Mrs. Stewart's residence was at the intersection of
the Bypass and South School Avenue. Mr. Smith asked if that was just south S
of the hospital. Mrs. Stewart answered that it as. Mr. Schiewetz asked if
part of the addition had already.been constructed. Mrs. Stewart answered that
the supports and roof had been run out a little bit. She added that the roof had
to be repaired and she had decided to go ahead and extend it while.she was having
the work done.
Mr. Schiewetz asked if there were other residences in that area. . The applicant
stated that there was an alley to the west, a house on the north, and an apartment
house on the south. Mr. Schiewetz asked how far the C-2 Thoroughfare Commercial
Zone ran on South School and if there were other residences also. in the Zone.
Mr. Lieberenz checked this and said, in his opinion, there were several other
residences in that Zone. Mrs. Stewart stated that what she really was trying
to do was improve the looks of the house in the back. She said that the addition
would be constructed of cement blocks.
The Chairman asked if there were any
additional
questions for
the applicant.
There were none, and the applicant was
excused.

The next application was that of Mr./Arbuckle, whose ¢ome on the extension of
Eastern Avenue just south of West Sixth Street (Highway 62 West) was destroyed •
by fire. He requested permission to rebuild his home or move in another
residentiall building and place it on the foundation which remained. This
property is located in an I -Z Industrial Zone of the City and cannot be rebuilt
without the approval of the Board of Adjustment. This case was referred to
the Board from the City Council on August 8, 1960,
Mr. Smith asked if there were other residences in the territory? The applicant
stated that it was mostly open land except for a little shed where the belongings
he had were now stored. Mr. Smith then asked what type of building he wished
to construct. Mr. Bowen asked if the old foundation was still there. The applicant
stated that he was not certain what type of building it would be. He said that he
knew of a building he -might be able to purchase and move in on the old foundation.
If not, he.would bURI another house on the same foundation. Mr. Schiewetz asked
if the permit would specify the kind of building to be constructed. Mr. Lieberenz
stated that it would require certain types of joists and studs on a new building,
but did not specify any on a building that was moved there from another location.
Mr. Smith asked if the applicant was on a sewer line. The applicant said no. Mr.
Schiewetz asked if the location was near his employment. The applicant.said that
he had no permanent employment. Mr. Schiewetz then asked if he was renting his
present home. Mr. Arbuckle stated that he was living in a brick house located north
of the Phillips 66 Station, and that it was rented. Mr. Robinson asked if he had
insurance on the house. .The applicant stated that the house was insured, but its
contents were not.
The Chairman asked if there were any further questions. There were none and
the applicant was excused.

The Chairman asked if the Board was ready to vote on the first application,

The Board then discussed the application of Mr. J. V. Arbuckle. They discussed
the type of building Mr. Arbuckle should be allow to construct on the property.
They decided to take the vote, providing a condition that the building moved in or
constructed be approximately the same size and no closer to Eastern Avenue
than the building which burned. The vote indicated:
Smith - yes
Robinson - yes
Schiewetz - yes
Bowen - yes
Pennington - yes
The application was granted on the above condition.
There being no further business fhe Board adjourned at 5:00 p.m.
