This was the'first meeting to be held under the New Zoning Ordinance No. 1239.
The first application was that of Mr. Merlin Horn of 930 Rush Drive. The
variation requested by Mr. Horn to the Zoning Ordinance is for the use property at
930 Rush Drive. He wishes to build an addition to the rear (east side) of his residence.
The roof of the new addition will be approximately 32 to 34 feet from the rear property
line, instead of the 40 feet required by the City Zoning Ordinance. Also, the roof of
the new addition will be approximately 4 to 5 feet from the existing garage building on
his property instead of the ten (10) feet required by the City Zoning Ordinance,
Mr. Smith asked the diemensions of the lot. The applicant replied that it was 65 x 114.
Mr. Lieberenz stated that his house was about 18 ft. from the house to the north's
property line and 15 ft. from the other house to the north property line. Mr. Smith
asked if the garage was 5 ft. from the property line. Mr. Horn replied that it�-was
5 ft. from both the north and east lines.
Mr. Robinson
asked if there was
an alley on the east.
Mr. Horn replied that there was
a fence attached to one corner of
the garage. He also
said that there was no alley now
but there was
a provision for one.
Mr. Robinson then
asked "How close is the house
on the east?"
Mr. Horn replied
that he would estimate that his garage was about 24 fts
from his line.
Mr. Lieberenz stated that he had heard a rumor that Mr. Horn had planned a beauty
shop in this addition to his house, and asked Mr. Horn if it were true. Mr. Horn
stated that it was not, and that this addition was to be used only for residential purposes.
Mr. Robinson asked the secretary to call the roll, and a vote indicated:
Mr. Robinson - yes
Mr. Pennington - yes
Mr. Smith - yes
The application was granted.

• The next application was that of Davis -Stanton Development Company, represented
by Mr. Bryce Davis, for the use of the property located at 11 West Ash Street.
Mr. Lieberenz asked Mr. Davis to tell the Board the details of his case. Mr. Davis
stated that the new sewer line went down the west property line and the pins were
lost: Therefore, in building the house, they went by the lot pins on thea_oqFA eb side
property line, which had been replaced by the sewer contractor. After the house
was built, it had to be surveyed in order to get a loan. In their surveying of the
lot, Mr. John Mahaffey's engineers discovered that the pins were 2 ft, off. As
a result the house was only 4. 2 to 4, 8 feet from this east line. Mr. Davis stated
that this had never happened to him before,
Mr. Pennington stated that he could see how it might happen to anyone. Mr.
Lieberenz stated that he did not think it was the fault of the applicant.
Mr. Robinson asked if the man on the east had made any objection. Mr. Davis
stated that, to his knowledge, none had been made,
The secretary was asked to call the roll, and the vote indicated:
Mr. Robinson - yes
Mr. Pennington - yes

The application was granted.
There being no further business, the Board adjourned at 4:00 p.m.
