MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENT
Council Chamber Dec. 3, 1959

the minutes of the
last meeting, which were read and
approved.

Mr. Lieberenz was asked to present the first application of Mr. & Mrs. Billy
R. Horne of 940 Rush Drive. Mr. & Mrs. Horne wishes to make an extension
to the residence to the west. This extension will be closer to the west property
line than allowed by the zoning ordinance.
Mr. Lieberenz stated that the Horne's residence is back 33-1/2 ft, from the
street as are most of the houses on that street.
Mr. Stanton asked if there were any objections from the neighbors. Mrs.
Horne said she talked to the neighbors immediately south and there weren't
any objections. Mr. Lieberenz stated that prior to the meeting he was
asked how he felt about this particular addition to the Horne's residence. He
stated that because of the distance between the two houses, he did not feel
that the extension of the 8 ft. to the west could harm the people to the south.
Mr. Young stated that he didn't believe this would cause a traffic problem
at this corner. Mr. Horne stated they wanted to enlarge one room and this
was the only way they felt that this could be done satisfactory.

The second application was that of Mr. Pothast of 1140 N. College Avenue
Is (Vet View Motel). Mr. Pothast wishes to construct an addition to the motel
and this extension would be closer to the north property line and closer to the
street property line than allowed by the zoning ordinance.
Mr. Bowen asked the reason this block of the street was the only one east
of College not zoned as the other blocks north of North Street. Mr. Lieberenz
stated that he hasn't heard the reason for it being zoned that way.
Mr. Bowen wanted to know how far the proposed building would be from the
north property line. Mr. Lieberenz reported four feet. Mr. Young wanted to
know how close the existing building to the north is from the side property
line. Mr. Pothast stated approximately 8 feet.

Mr. Young read Section 16 of the Zoning Ordinance pertaining to Building
Lines. He stated that the purpose of this ordinance is to prevent building too
close to the street in the First Fire Zone along College Avenue,
Mr. Robinson asked who owned the house to the north, and is it occupied.
Mr. Pothast stated that he did not know who owned the building, but one apart-
ment is occupoed and one empty. He stated that he could cut the room down
to 15 ft. and make the room smaller. He wants to build five rooms ants
have -t+rws&terieson-theaxewv on the new proposed addition to have two stories.
• Mr. Young stated that if the Board voted against this application that Mr. Pothast
could either wait until the Planning Commission decides if this particular
area will be iezoned or take his problem to the City Council for their action,
or wait for the zoning ordinance to be passed. The secretary was asked to
read the Powers of the Board of Adjustment.
Mr. Robertson, who appeared with Mr. Pothast, asked if they alter their
application to 15 ft, from the street property line, would it make a difference
in their building. Mr. Pothast stated that it would.
Mr. Robinson stafdd'. that he would have to check with the Planning Board or
City Council about the zoning problem. He stated that Mr. Pothast could
make an immediate relief to approach the Council to rezone that area, or could
appeal that that particular section on zoning in the ordinance be amended.
