Mr. L. M. McGoodwin called the meeting to order and asked the secretary to
read the minutes of the last meeting, which were read and approved.
Mr., Lieber.enizw"casked to present the applications. The first application was
that of Mrs:311enderson., who appeared at the last meeting of the Board Aug. 11th,
• 1959. Mr. Leonard Greenhaw who appeared in behalf of Dr. Butler reported
that Dr. Butler was unable to attend the Board meeting. Mr. Clay Yoe had
worked out a plat plan showing the location of the proposed building and the exist-
ing building and it was presented before the Board.
Mr. Robinson stated that to his estimation, it is a very hazardeous corner for
motorists and there would be very little space if any, to lay a sidewalk.
Mr. Greenhaw stated that the parking space would be out in front and obstructs
motorists vision. If the:building is set back to 40 ft. it will leave a hill in front.

second application was that of
Mr. W. B. Putman, which was presented
by
Mr.
Charles Morse. Mr. Putman
of 436 E. Prospect wishes
to build a car
port
onto
his home. This proposed car
port will be approximately
74/2 ft. from
the
rear
property line instead of the 25 ft. required by the Zoning
Ordinance.

"We, the undersigned, Noah Gabbard and Norma Gabbard, state that we
are the owners of Lot 5, Fritz Addition to the City of Fayetteville, which lot is
adjacent to and immediately north of Lot 4, Fritz Addition to the City of Fayette-
ville, owned by W. B. and Barbara J. Putman.
This is to certify that we have no objection to Mr. and Mrs. Putman
putting a car port immediately north of their present garage even though such
car port would be less than twenty-five (25) feet from our mutual property line,
which is the rear property line of both lots. "

Mr. Putman stated that he had turned his garage into a family room. He wishes
to erect a car port on the north side of the new family room. The property is
separated from the adjacent property by a rock terrace. There is a retaining
wall on the neighbor's property that divides their back yard in two levels. There
is approximately 60 ft. between the Gabbard's residence and Mr. Putmans,
Mr. Putman stated that he got a building permit to convert his garage and at that
time Mr. Lieberenz said that he would have to bring the car port matter before
• the Board. The height of the roof will be lower than the wall.
Mr. McGoodwin asked if in granting this application would it, in the owners
opinion, in any cut off anyone's view. Mr. Putman replied no. Mr. Stanton asked
if, in the owner's opinion, would it create.' a fire hazard. Mr. Putman replied
no.
Mr. McGoodwin asked if in granting this application would it redire the back yard.
Mr. Putman replied yes, it will have a passage way and the back yard will be
about 40 x 35 including the rock terrace. It will extend to the east propettty line.
The roof of the car port will be flat and will not be as high as the garage.

• The next application was that of Mr. J. C. McConnell of 726 W. Maple. Mr.
McConnell wishes to remodel his home by building a car port on the west side
of the structure. This house is located on a lot which does not have any frontage
on a public street, but is �ronting on a ten ft. alley.

Miss Suzanne Lighton represented Mr. McConnell. She stated that the house
faces on an alley that runs north and south from W. Maple to Douglas Street
between Whitham and Leverett Avenues. Mr. McConnell wants to put car port
on the west end of his house. Mr. Lieberenz stated that he had checked with his
assistant, and the alley to the east came in off Maple. Mr. McConnell had
been driving down the south side of his house. Miss Lighton reported that the
house had been there for 40 years on oris lot. The ordinance prohibits building
unless the lot fronts on a regular street. The neighboring property is not
crowded nor is the public affected.

The next application was that of Mr. Paul Bond. Mr. Bond wishes to build two
40 duplex houses on a lot that is smaller than the 14, 000 square ft. required by the
Zoning Ordinance. This property is located on the southeast corner of the
intersection of Leverett Ave. and Cleveland St. It will have less front, side and
rear yards than the minimum required by the city zoning ordinance.
Mr. Lieberenz presented some points as to Mr. Bond's application. Mr. Bond
has a lot of 9, 400 sq. ft. He wishes to erect two buildings on the lot. The
zoning ordinance requires a 14, 000 sq, fobt.lot before two residential buildings
could be built on a lot. The minimum street setback in this area is 20 ft. or if
forty per cent of block is developed then the required setback would be in line
with existing dwellings on both side of proposed lot. He stated that the ordinance
requires that a person must first have a minimum lot of 7, 000 sq. ft. However,
if his ]ot; is smaller than 7, 000 sq. ft. and was recorded in the Court House prior
to the date of the passage of the zoning ordinance, then one house could be built
on the lot provided the proper setbacks were maintained and it was a one family
residence.
Mr. McGoodwin asked Mr. Lieberenz to read the section of the zoning ordinance
which sets out the powers of the Board of Adjustment.
Mr. Bond was asked to present his reasons for erecting these apartments. He
stated that he planned to rent them to students. That students like to have some-
thing private. Mr. Bond stated that according to the rules and regulations there
• was room enough on the lot under the zoning ordinance ito build one building of
a two story design with four apartments.

However, he thought that his proposed buildings would add something to that
• neighborhood, also to that section of town. He stated that it would provide
parking in front and also provide a place in the center for children to play.
Mr. McGoodwin stated that under the circumstances Mr. Bond is asking per-
mission to build two buildings on a lot that is only 9, 450 sq. ft. when the zoning
ordinance requires 14, 000 sq. ft. He is asking for setback variance on Leverett
Ave. , which is not critical. He is asking for setback variance on Cleveland
which is a critical setback. If the Board allows this kind of variation through-
out the city there would be small apts. crowddd:on small lots and would tend to
create slum areas.
Mr. Young stated that the parking is obstructing the front. There is no rear
yard for parking and in view of this fact, he felt that there would not be ample
space for children to play.
