MINUTES OF THE BOARD OF ADJUSTMENT MEETING
Aug. 11, 1959 Council Chamber 3:30 p.m.

The meeting was called to order and the minutes of the laat meeting read
and approved.
The first application brought before the Board was that of Mrs. Henderson
who appeared before the Board July 30, 1959, at which no action was taken
on heiiapplication at that meeting.
Mr. McGoodwin, who was absent at the last meeting, brought out that actually
it was not for the Board of Adjustment to decide what width building would be
useable on this lot. They were only to decide what would be best as for as
the general public is concerned.
Mr. Young stated that this fact was brought out in the last meeting and it was
suggested that Dr. Butler be at the meeting to explain his view on this matter.
Dr. Butler was asked to present his views for the benefit of the Board. Dr.
Butler stated that he had contemplated buying this property from Mrs. Henderson,
but felt that he needed 35 foot space to build his clinic. He would have to pro-
vide parking space for his building and he felt that there wasn't much room
for parking off College Avenue. Also, the traffic problem off College would be
greater than in the rear. The type of patients that come to his office are such
that are unable to climb stairs, both he and Dr. Siegal have that problem.
They need parkigng space in the rear of the building for these type of patients.
They will have a few steps leading into the kbuilding from the side for service
purposes. The patients will enter from the front.
Mr. Young read Mts. Henderson's letter writtbn to him Aug. 5th, quote:
Dear Mr. Young:
• Not being sure that I can attend the next meeting of your City Planning Boa d, I
do want to submit another plea for the extra five feet asked for the clinic building

planned at 1041 North College Street.
• The restriction came as a complete surprise to me as I was notified by telephone
that the sale was made (subject to proper title and ett. ), but the purchaser
wanted fifteen days to get some matters attended to- I heard nothing further
for almost a week and then in regard to abstract which I knew could be easily
corrected.
Feeling secure in the contract, I at once made arrangements for my sister
to have a needed operation and just yesterday brought her home from the hospital.
This may not be the kind of hardship that is given consideration by a Planning
Board but it is certainly working a very definite one on me. 1 do ask you to
each place yourself in my position and see if a five foot increase would com-
plicate matters too much.
Mr. Young, I will certainly appreciate your boar&help in this matter- I am
losing at best over four thousand dollars in this property and haven't been able
to rent same for over four years on account of no parking space, or way to
get in at back,. Living out of town has made it hard to look after.

In order to find out the exact distance from the curb to the property line,
Mr. Mc Goodwin called his office and sent someone from there to measure the
distance from the curb to the house and also the width of the house.
Mr. Frank Lewis, Jr. stated that there is a rock wall on the north of the house.
There is five feet from the wall to the house. The roof of the house runs out
on his property to the south.
Dr. Butler stated that when the lot is cleaned off and with the new building
constnuction back 20 ft. from College Ave. , there will be less obstruction to
motorist there than as it is now.
The Assistant Building Inspettor, Mr. Poe, brought the measurements on the
building into the meeting. The existing house is 29 feet back from College
Avenue curb line.
Mr. Lieberenz stated that the Arkansas Court have ruled that where a corner
lot or a through lot fronts on a business street and residential street, the
building must front on the business street. Therefore, the front of the building
would have to come off College Ave.

asked if Mr.
Lewis opposed this application.
Mr. Lewis
• replied no, that
he personally
didn't have any objections, but
he did feel that
the set back from North Street hardly is adequate because it is
a "blind" corner.
Mr. McGoodwin asked Mr. Lewis if the east line of the house on the corner
is in line with his residence to the south. Mr. Lewis stated that the main part
of his house to the south was in line with the house on the corner but that an
eight foot porch projects closer to College than the house on the corner.
Dr. Butler wished to ammend this application and no action was taken.
The second application was that of Carl Tune. The variation requested by
Mr. Tune is for the use of the property located on the west side of North College
Ave. just south of Maple Street and next lot south from Conoco Service Station.
The C -Residential District divides his property at the present time and he re-
quests the Board to move the E -Commercial Zone back west 16 ft. to the west
end of his lot.
Roll was called and a vote indicated.

Mr. Tune wants to erect a business bldg. which will be closer to the North and
south property lines on the west sixteen (16) feet of his lot than permitted
by the Zoning Ordinance.
Mr. Lieberenz stated that because Mr. Tune's lot extends back into the C -
Residential zone and the ordinance requires that the building be built 4 feet
from the north and south line in this 16 foot projection.

The third application was that of Mr. K. E. Marvin requesting the use of the
property located on the west side of North College Ave. just north of IGA
Grocery Store. The C Residential Di:strict divides his property at the present
time and he requests thb Board to move the E -Commercial Zone back west 18
ft. to the west end of t.
• Roll was called and a vote indicated.

His next application to the Board was to erect a business building which will be

• closer to the north property line on the west 18 ft. of his lot than permitted
by the Zoning Ordinance,
Mr. Lieberenz stated that this is a similar case to that of Mr. Tune.
