McGoodwin Mr. George Bowen Mr. Clarence Young Mr. Loris Stanton Mr. J. F. Robinson, temporary member Mr. Harold Lieberenz Mr. Bill Murphy, applicant Mr. Ellis Burgin, applicant Mr. T. W. McKinney, applicant Mr. Warren Segraves Mr. L. M. Mc Goodwin, chafiman called the meeting to order and asked the secretary to read the minutes of the last meeting, which were read and approved. Mr. Lieberenz was asked to present the applications. The first application was that of Mr. T. W. McKinney, whose property is • located between Whitham and Leverett Avenues, and north of Douglas and south of Cleveland Street. He wishes to erect three, six (6) unit apartment buildings on this 30, 100 sq. ft. lot. The Zoning Ordinance limits the number of apartments that can be placed on this lot to 15 units. Mr. J. F. Robinson, temporary member of the Board of Adjustment, stated that he is a member of the First Federal Savings and Loan Co. , and that they have made a loan to Mr. McKinney, and requested that he not vote on this application. Mr. Lieberenz reported that there is a proposed zoning ordinance that states there must be 6, 500 sq. ft. for two family residence. All above two families would require 1, 000 sq. ft. for each additional apartment. Under the new zoning ordinance you would need 10, 500 sq, ft. for each six units. He has three buildings. Mr. McKinney stated that each building is designed for two stories with a basement. Hecrequiistsiitlrat&esbaiahle to construct two apartments on each level of the building. If the application is not denied, he will have to con- struct four apartments on first and second floor and four rooms in the base- ment to rent to single students. Mr. Young wanted to know if Mr. McKinney planned to have off street parking • area. Mr. McKinney replied yes, that he plans to have a circle drive with plenty of parking area. 131 J Mr. McGoodwin asked the building inspector if in his opinion, granting this • request would congest this area. Mr. Lieberenz stated that if the Board did not grant the request, Mr. McKinney could build a lodging house and rent to students. In hia opinion, because the lot is such that there is a public alley located on the west side and that the proposed building is more than one story in height, Mr. McKinneydrequest would not congest the area. Also, if Mr. McKinney had single students in the basement, there wouldOmk ore people in each bui1ding and this might be undesirable to the people in the area. Mr. Lieberenz stated that the new ordinance is designed to more or less set aside this area for university apartments and dormhtories There being no further discussion roll was called and a vdte indicated. Mr. McGoodwin Yes Mr. Young Yes Mr. Bowen Yes Mr, Stanton Yes the application was granted. • The second application was that of Mr. John Wm. Murphy and Ellis Burgin. They wish to erect a building on the property located on the north side of Cleveland Street between Lindell and Garland Avenues, using non -continuous land as consideration for a 12 unit apartment building. Mr. Lieberenz denied them a building permit for a 12 unit apartment building because the lots were separated by a public alley. Mr. Murphy said they had already started constructing the apartment building: they have adequate off street parking area for 24 cars. They have 23 feet set back and an existing home which they will tear down later. The alley has never been opened and they felt that they could get it closed and then the building inspector could issue them a building permit for 12 units according to the zoning ordinance. However, they would not prefer to do it this way, but would rather leave the alley open for city trucks to service the adjoining property. Mr. Murphy stated that they might build another apartment house on the other part of the property at a later date: Mr. Young brought out the point that Mr. Murphy and Mr. Burgin would have to obtain a building permit for this future construction and comply with the city ordinances in effect at the time and that the Board's action at this time would not have any bearing on • any future buildings. 13D Mr. Murphy stated that they were in competition with the university housing • and that the university did not have to comply with the provisions of the zoning ordinance at this time.
