McCullough, applicant Absent: Mr. J.R. Crocker, Sr. Mr. Mc Goodwin called the meeting to order and asked the secretary to read the minutes of the last meeting, which were read and approved. He then asked Mr. Harold Lieberenz to present the applications The first application was that of Mr. O.V. McCullough of 231 and 233 Louise • Street. Mr. McCullough wishes to erect a double carport with small storage closets on the east side of the existing duplex. The proposed carport would be located closer to the east property line than the five feet required by the Zoning Ordinance. Mr. McCullough stated that there are two families attending the University living there "at the present time. They have to park their cars under a tree at the present time and they are damaged by the tree. The people need a carport there for protection of theirccars. Mr. Young stated that an appli- cation similar to this was presented before this Board for consideration for the adjoining property to the east. The Board denied this application because they felt that the structure would be too close to the property lines. It was brought out in the discussion that if both properties had built out to the property line, the houses would be touching each other and would be a fire hazard arid. undesirable. There being no further discussion, the roll was called and a vote was indicated. Mr. Morse wishes to • erect a one story masonnyybuilding on a lot smaller than the seven thousand (7000) sq. ft. required by the Zoning Ordinance to house more than one family. The proposed building would be closer to the property line on North Oakland Avenue than the 20 ft. required by the City Zoning Ordinance, Mr. Jim Greggory who appeared with Mr. Morse stated that there would only be one housekeeping unit. The rest of the house would be bedrooms with private baths, all having outside entrances. Mr. Morse stated that the University needs more housing units, as there are people living in basements, attics, etc. all around the University. There is a great demand for good houses. In this particular building, there would be a one -family unit with cooking and eating facilities, with a six additional rooms to house a maximum of 12 rooms. Mr. McGoodwin asked Mr. Lieberenz to give a report on the Zoning area as to what the different residences were allowed in building. Mr. Lieberenz read that the "D" Residential Zone allowed multiple family housing area plus dormitories, fraternities and sororities. In the "C" Residential Zone apartment houses, boarding houses and lodging houses are allowed. Mr. Young stated that the space requirements allowed in this area are 7000 • sq. ft. lot area per building and provide 2000 sq. ft. lot area for each family. In this case the lot is too small. Mr. Lieberenz stated that for this reason he could not issue a building permit becuase there would be more than 3 roomers, as a result the building would be classed as a lodging house and not a one -family residence. Mr. Morse stated that he would be building a concrete block masonry type building one story in height. Mr. Stanton Mated that the setback in that area is 20 feet from the street property line, five feet from side line, and 25 feet from the rear line. He asked if the main entrance is from Douglas. Mr. McGoodwin stated that the application is for a unit for more than one family. The sire and location is allright as it meets the requiremeiis of the City Zoning Ordinance. Mr. Lieberenz read the definitions of the different types of dwellings, such as lodging, boarding houses, and also what the term "family" means. Mr. McGoodwin classified this type of house as a "lodging house". Mr. Lieberenz then read the powers of the Board of Ajustment after Mr. McGoodwin asked about this particular situation being a matter for the Board to consider or for the City Council. Mr. Greggory asked when the ordinance was passed and Mr. .Lieberenz-Cel . in Sept. of 1950. (97 -3 - Mr. Hugh Bond and Bert Patterson appeared in behalf of the Cumberland • Presbyterian Church with a petition of 26 signatures of property owners, friends and members of the church to protest against the erection of the building as the lot is smaller than the 7000 sq. ft. fequired by the Zoning Ordinance and thought it would be a traffic hazard. The University is considering buying the church property for a sorority house. Mr. Young asked if all the people that signed the petition live in the immediate neighborhood of the church. Mr. Bond replied that 5076 lived in the vicinity. 11 • Mr. McGoodwin moved that the Board delay any action before granting this application and give those who havenit looked over the situation a chance to see it. It was decided that a meeting would be held on April 3, 3:30 p.m. to continue any action taken on this application. There being no further business, the meeting was adjourned. APPROVED: DATE Mr. Charles Morsels application was to have been presented at a meeting on April 3rd. The meeting was called off, as the Board members had talked the matter over among themselves. It was decided they would present it at the next regular meeting of the Board of Adjustment for a vote. 128
