Mc Goodwin Mr. Clarence Young Mr, Witt Carter Mr. George Bowen Mr. Harold Lieberenz Mr. Lawrence Hicks Mrs. Herman Eason, Applicant Mr. and Mrs. W. G. Prater, Applicants Mr. Harry Lyons, Applicant Mr. A. D. McAllister, City Attorney Absent: Mr. J.R. Crocker, Sr. Mr. L. M. McGoodwin, chairman, called the meeting to order and roll was called. He then asked the secretary to read the minutes of the previous meeting held October 4, 1957, which were read and approved. Mr. McGoodwin asked Mr. A.D. McAllister to read the new State Law, Act 186, of 1957, adopted by the Legislature in effect. It proveded that the Board of Adjustment could be composed of 3 members present at the meeting or the Planning Commission could as a whble, act as the Board of Adjustment. Mr. Young stated that since their last meeting, the City Council repealed an ordinance, which allowed 3 members of the Board of Adjustment to act as a quorum of the Board. Mr. Young moved that due to this action, he felt that the members should re -vote nn the minutes of the previous meeting held on October 4, as there were only 3 members present at this meeting. Mr. McGoodwin second it. It was voted that four members constitute a quorum at the meetings of the Board of Adjustment in the future until such time that it can legally be changed by the City Council. Roll was called and a vote indicated: Mr. McGoodwin Yes Mr. Young Yes Mr, Carter Yes Mr. Bowen Yes Mr. McAllister stated that it be left Status Quote, Mr. McGoodwin then asked the Building Inspector, Mr. Harold Lieberenz, to present the applications before the Board. The first application was that of Mrs. Herman Eason of 508 Far est Avenue, which . was brought before the Board October 4, 1957. Her application was to remodel her residence by adding a room to the dwelling. Mr. McGoodivin asked Mr. Lieberenz to give any new information that he had pertaining to Mrs. Eason's application. lob J Page -2- Mr. Lieberenz stated that he did not have any additional information and asked Mr. Hicks if he had any additional information about the property • line. Mr. Hicks stated that he had 'checked on the abstract and the lot is 60 ft. down and 90 feet. wide. The lots the other way are very long and very deep. Mr. Young asked Mrs. Eason how many rooms -were upstairs'. Mr. Eason replied there were 2 very small room$, but no bath room up- stairs. Mr. McGoodwin stated that it was almost impossible in this case to keep 20 feet from the front and 25 feet in the back and have room for much of a house, as the lot is very shallow. Mr. Hicks stated that if you build on the north you would have to go to all the expense and build 2 rooms. Mr. Carter said that it appeared to him that because of the arrangement of the rooms in the existing building it wouldn't be such a good place to build it on the north. Mr. Young said it would be just as easy to build to the north as to the back. Mr. Hicks stated you would have to build an extra room. Mr. Young said it still looked like a matter of convenience to him. He didn't see why it would cost more to be built to the north than to the rear. • There being no further discussion, roll was called, and a vote indicated. Mr. McGoodwin Yes Mr. Young Yes Mr. Carter Yes Mr. Bowen Yes The application was granted. The next application was that of W. G. Prater of 1335 Vandeventer. His request was to build an extension to liis residence and enlarge his kitchen. Mr. McGoodwin asked him in what way he was to encrease his kitchen. He replied he wanted to extend it d feet to the north and to the west. Mr. Young stated it wouldn't be extending it closer to the property line than it is at this time. Mr. Lieberenz stgted that a Mr. Seamster camb by 111pe his office and stated that, as a property owner to the west of the property in question, he had no objection to Mr. Prater building this extension. There being no further discussion, a vote was indicated. Mr. McGoodwin Yes • Mr. Carter Yes Mr. Young Yes Mr. Bowen Yes The application was granted. t07 A Page -3- The next application was that of Mr. Harry Lyons of 228 S. Block. He has made application to enlarge his residence. He wants to add a section • on the south side. This is tO ft, by 10 ft, The section will be built in such a way that it will be built out flush to the existing wall of his residence. It will be closer to the property line than the ordinance will allow. Mr. Young wanted to know igrhat the Ordinance said. ,Mr. Lieberenz read the ordinance, which stated that a requisition of X20 feet from the street line the same as it would on a corner lot but only 5feet required for side yard for lots other than tke_c.est- on the corner lot.) Mr. Young wanted to know what the purpose was of the additional line. Mr. Lyons replied to build a room. Mr.. Mc Goodwin asked what is the width of the lot. Mr. Lieberenz stated 45 febt. Mr. Young asked if it was � ft, from the proposed corner to the Archibald Yell Blvd. line. Mr. Lieberenz answered yes. Mr. McGoodwin stated that this application for this extension and the diminsions and shape of the lot has changed since it was originally plated. The public took part of the lot away for public service, Mr. Young asked Mr. Lyons what was the difference in the ground elevation of his back yard and the street. Mr. Lyons replied there was a 2 ft. wall. Mr. McGoodwin stated that the lot was very narrow before part of it was • taken for street purposes, r� U MrYoung said he felt like it is an extension of his side line rathbrithan a street line as interperted by Mr. Lieberenz. Mr. McGoodwin stated that in his opinion, he felt that this be considered only as a side yard. Only 5 feet would be required by the Zoning Ordinance as long as he doesn't get any closer to the side property there.
