McGoodwin, Chairman Mr. Heydon Lewis, Member Mr. J. R. Crocker, Sr., Member Mr. Clarence Young, Member Mr. Harold E. Lieberenz, City Building Inspector Mrs. Shirley Santifer, Secretary Mr. Ivan M. Mayes, Applicant Absent: Mr. Witt Carter, Member The Chainman, Mr. L. M. McGoodwin called the meeting to order and asked the Secretary to read the minutes of the previous meeting held February 28, 19579 which were read and approved. The Board then asked Mr. Lieberenz to report what he had found out about adding members to the Board of Adjustment. him prior to the last meeting Mr. Lieberenz reported that he had checked with the Chairman of the Planning Commission, and the City Attorney and they had advisdd him that more members could be added to the Board, but9iat the present ordinance would have to be changed. The City Building Inspector, Mr. Lieberenz, was then asked to present the applications for variance and explain each. The first application was that of Mr. Ivan M. Mayes. Mr. Mayes appeared before the Board at this time due to the fact that it had been impossible for the Secretary to get in touch with him prior to the last meeting held Feb. 28, 1957. Mr. Mayes felt that the Board should reconsider his application due to the fact that he had been unable to be present, and he did not feel that the Board understood all the circumstances about his application. The Board was undecided as to whether or not they could re -open an application once it had been voted on or not. The Board agreed to re -inspect Mr. Mayes' property and see whether or not it would be legal for them to re -open his application. The Next application was that of Mr. H. L. Mathias of 221 South Block Avenue, which was held over from the previous meeting held Feb. 28, 1957, thereby giving the members of the Board ample time to inspect the property. After establishing the fact that the property had been inspected a vote was indicated and roll was called: McGoodwin No Crocker No Lewis No Young No I� L Page -2- April 3, 1957 The application was denied. The next application was that of Mrs. J. L. Stone at 528 North Lindell. The variation requested by Mrs. Stone to the Zoning Ordinance was for the use of the property located in the rear of 528 N. Lindell. This property is located in a "D" Residential Zone and is known as lot 4 and part of lot 5, Block 3 of Oakland Place Addition to the City of Fayetteville, Arkansas. The applicant had three residential buildings on the property. During the war, she converted part of her garage into one of these dwellings. A year ago she had some plumbing put into the other part of this garage building, with the idea of making another apartment until she found out about the zoning ordinance and she dropped her plans. Now she requests permission to enlarge her present apartment by using the balance of the garage building. • This building does not conform to the zoning ordinance because she has three dwellings on this lot now and does not have the r equired 7, 000 sq. foot per dwelling. Mr. Crocker asked Mr. Lieberenz if Mrs. Stone would alter the structure of her building on the outside. Mr. Lieberenz replied that she would not, but that she would be altering the inside structure. Mr. Young asked Mr. Lieberenz to read the definition of the term structurally alter from the zoning ordinance. substantial " STRUCTURAL ALTERATIONS: Any change in the supporting members of a building, such as bearing walls, columns, beams or girders, or any substantial change in the partitions or in the roof." page -7- (zoning ordinance # 1002) Mr. McGoodwin asked Mr. Lieberenz if Mrs. Stones' enlarging the garage in this manner would eliminate an off-street parking area. • Mr. Lieberenz stated that Mrs. Stone did not use the garage for this purpose. page -3 - April 3, 1957 is Mr. Crocker asked if Mrs. Stone planned to make this one apartment or two. Mr Lieberenz stated that it was his understanding that she was to convert in into one larger apartment, however, Mrs. Stone had installed two sets of plumbing. Mr. Crocker made a motion that the Board hold over this application until Mrs. Stone had submitted a completed plan of her proposed building which would definitely show that she would have only one larger apartment. This set of plans was to be attached to her building permit. The motion was seconded by Mr. Lewis, and passed unanimously by the Board.
