Lieberenz, Building Inspector Mrs.Shirley Santifer, Secretary The Chairman, Mr. L. M. McGoodwin, called the meeting to order and asked the Secretary to read the minutes of the previous meeting, held December 15, 1955, which were read and approved. Mr. Harold E. Lieberenz, City Building Inspector, was asked to present Mr. • Greenwood's application for variance and explain what the applicant wished to do. The variation reqrested by Mr. Greenwood was to repair a grocery store building on Mission Boulevard which had been damaged by fire. This building was a non -conforming building in a residential area. This property was located on the corner of Gunter Street and Mission Boulevard known as the East portion of Lot six (6) of Block Eight (8) in Gunter's Addition, the same being zoned as a "B" residential area. Mr. Lieberenz stated that they had had an application some time ago for a permit to remodel the same building, but about five months ago the building was damaged by fire and the roof was destroyed. Mr. Greenwood had previously written a letter to the Building Inspector saying that it was his intention to repair the roof and ceiling of said building to replace damage by fire on June 27, 1955 and to decorate building making it suitable for occupancy, the intended use to be for the conducting of a retail grocery business. Mr. Lieberenz stated that he was undecided as to whether or not he could issue a . permit for fire damage to a non -conforming building if the damage was less than 60% of its total value. Mr. Greenwood stated that the estimated repairs were $3, 247. 38, the amount of loss settled upon and collected from the insurance claim. The total replacement cost of the building was estimated by the General Adjustment Bureau adjuster as being over $18, 000. 00 therefore the repairs would be less than 60%. Sb Mr. Crocker asked Mr. Greenwood if he planned to change or alter the outline of the building in any way, and Mr. Greenwood replied that he did not. 40 During the course of discussion it was brought out that the building had been used as a grocery store, and that the provision of the ordinance was that under no circumstances could its' use be changed. Whenever and if the use of this non -conforming building is changed it must be changed to a more restricted use or to a conforming use, and the use shall not hereafter be changed to a less restricted use. It was understood between the applicant and the Board of Adjustment that if a variance was granted that this provision would be adheared to. Mr. McGoodwin asked Mr. Greenwood if the refusal of the Board to grant his request for variation would constitute a confiscation for the use of his building. Mr. Greenwood stated that it definitely would because it could not be used until the roof had been repaired. Mr. McGoodwin asked if there were any questions or any further discussion, and there was none. A vote was indicated and roll was called: Mr. McGoodwin Aye Mr, Young Aye Mr. Crocker Aye Mr. Carter Aye The application was granted. There being no further business the meeting was adjourned.
