The Chairman, Mr. L. M. McGoodwin called the meeting to order and asked
the secretary to read the minutes of the last meeting held August 16,
1955 which were read and approved.
Mr. Bill Shaffer of 712 South College Avenue had made application for a
building permit to repair a Commercial Garage Building on South College
Avenue. He was refused a permit because this building is in a "Cu
residential area which does not allow retail and commercial buildings
and because Mr. Shaffer wants to structurally change this non -conforming
building.
Mr. Shaffer had asked permission of the City Council to repair the build -
and had been referred to the Board of Adjustment.
Mr. Lieberenz was asked if the building was dangerous as it stands. He
said it was dangerous, that the building leans to the south, out of plumb,
the rock veneering is falling off the east side. The wooden framing is
rotten from termites and water. Mr. Lieberenz had written a letter to
Mr. Shaffer telling him the building was a hazard to public safety and
would have to be repaired or torn down entirely. Mr. Shaffer has been in
business at this location since before the passing of the zoning ordinance.
Mr. Young stated that to him it did not seem feasable to repair the
building, that it was beyond repair.
The
question was
asked as
to whether
the building
could be repaired to be
made
useful and
would it
change the
outline of the
building.
Mr. Shaffer said that circumstances beyond his control have caused the
building to be in its present condition. When the street was repaired it
was raised above the floor level of his building. The water draining
from the street ran into the building causing the frame work to rot.
Mr. Shaffer stated that the ceiling height would be the same, and there
would be the same number of square feet of floor space. He wishes to
impair rep -_L the building with 81, concrete blocks and raise the entire
structure to street level.
When asked if there were any objections to the application by anyone, Mr.
• Owen Carnes, who was present, said he had no objection to the building
being repaired, but he did object to the old wrecked cars sitting about.
Mr. Carnes lives just south of Mr. Sha£fers Building. The discussion led
to matters not pertinent to the decisions of the Board of Adjustment.

Mr. Harlan Hanna was present to say that they in that neighborhood
would be glad to have the building repaired, and would welcome the
addition of more businesses. Mr. McGoodwin stated that there was no
expansion of businesses in that area by ordinance. ,,Duro,
Mr. Leonard Pratt, a former Councilman, reminded the Board that Mr.
Shaffer had asked the Council for permission to repair the building
while he, Mr. Pratt, was on the Council. He thought Mr. Sahffer should
be granted permission.
Mr. George Caudle was present, not because he objected to the building
being repaired, but in the interests of his Aunt, who owned some pro-
perty in that area and his interest was whether or not there would be
a hazard,with an increase in insurance rates.
A vote was indicated and roll was called.

Mr. Crocker made the statement that"If the ordinance was construed
strictly I would have to vote in the negative, but giving it a liberal
construction I will vote aye.'
The application was granted.
There being no further business, the meeting was adjourned.
