MINUTES OF THE MEETING OF THE BOARD OF ADJUSTMENT
March 25, 1955

The Vice -Chairman called the meeting to order and requested the
Secretary to read the minutes of the meeting held December 10,
1954, and they were approved.
An application for variance from the City Zoning Ordinance by Mr.
Vernon Anderson, 603 Vinson , was brought before the board. Mr.
Anderson desires to build a forty (40) foot extension to his res-
idence. The residence is only eight (8) feet from the property
line on Vinson Street due to the topography of the lot. There is
a drop of approximately thirteen (13) feet from the back of his
house to the property line on the west. A small back porch on the
south extends slightly into the alley, which has not been opened.
This porch is to be removed. Mr. Young made the statement that under
these circumstances, to follow the requirements of the ordinance,
which is a setback of 25 feet both front and back would deprive the
man of the use of his property. Mr Anderson was asked if any object-
ions were voiced by the neighbors. There were no objections.
Mr. Lieberenz read paragraph 3 in section 3 of the ordinance per-
taining to this type of situation. 11 To authorize a variance where,
by reason of exceptional narrowness, shallowness or shape of a
specific piece of property of record on the date of the passage
of this ordinance, or by reason of exceptional topographical con-
ditions or other extraordinary or exceptional situation or condition
of a specific piece of property, the strict application of any
provision of this Ordinance would result in peculiar and except-
ional practical difficulties and particular hardship upon the owner
of such property and amount to a practical confiscation of such
property as distinguished from a mere inconvenience to such owner,
provided such relief can be granted without substantial detriment
to the public good and without substantially impairing the general
purpose and intent of the comprehensive plan as established by the
regulations and provisions contained in this Ordinance."
A motion was made and seconded that the application be granted. Roll was calleds

wouldIt was agreed that the Board dispense with regular meetings and meet only
whenever there was an application for variance before the Board. Mr. Lewis
made a motion to adjourn and Mr. Young seconded.
