McGoodwin requested that the Secretary read the minutes of the meeting held September 14, 1954, and they were a- pproved. The special meeting was called to act upon the application of Lks. Floyd Pierce which had been delayed because Mr. Young and Mr. Crocker requested thatthey have time to look at -Mrs. Pierce's property. They did not have an opportunity to see the house in question before the September 14, 1954 meeting, to determine if there was room on the lot to relocate the garage. Mrs. Pierce's application for variance to the zoning ordinance asks for permission to rebuild her garage which is located on the North property line at her residence at 732 ':lest Maple Avenue. Mr. Harold Lieberenz, City Building Inspector explained that the zoning Ordi- nance requires that the garage be at least five (5) feet from the, property line in question. Mr. Lewis asked why the garage location could not be changed. Lir. Lieberenz stated that if the garaCe was moved more than five (5) feet East that it would be too close to the rear property line. Also, if the garage was moved tow rd the house and away from the North property line, the downstair windows on that side of the house would be blocked and that the existing concrete drive;.ay would have to be changed. 11r. Crocker made the statement that the plot showed at least thirty- three (33) feet from the North Property line to the nearest residence north of Lrs. Pierce. Lir. Cohea stated that if Krs. Pierce wanted to lengthen the garage about two feet on the west end. He stated that the old garage was in pretty bad condition but could be repaired if Lars. Pierce could not build a nevi garage. After some discussion about moving the 7arage closer to the dwelling, the Board indicated it was ready for a vote. Lieberenz City Building Inspector Margaret Griffith Secretary The Chairman, Mr. Mc¢oodwin requested that the Secretary read the minutes of the meeting held October 15, 1954, The minutes as read did not explain as fully as was desired, the postponement on the request of the application of Mrs. Floyd Pierce to rebuild her garage. It was suggested that the minutes include more specific information. The first application for variance to the zon&ng ordinance to come before the board was that of Mr. Leonard Preston, of 519 South College Ave. Mr. Preston desires permission to enclose a small six by eight (b by 8) foot back porch on the College Street Grocery Store. Harold Lieberenz, City Building Inspector explained the variance before the Board, stating that the grocery store is located in a C -Residential area and is clasedd as a non -conforming structure. It was also stated that a residential building located on the same property as the store is only six (b) feet from the porch in question. Mr. Mc Goodwin asked the building inspector if the porch was covered with a roof and the inspector said it was. Mr Young inquired if the building line would be extended in either direction and Mr. Lieberenz stated that, according to Mr. Prestons application, the area of the building would not be increased. It was agreed that if the roof and floor areas were not enlarged, there would not actually be a change in the building, and the Board indicated they were ready for a vote. Mr. Crocker Aye Mr. Lewis Aye Mr. Young Aye Mr. McGoodwin Aye The second application for variance to the zoning ordinance to come before the Board was that of Mr. William Combs of 509 Huntsville Road. Mr. Lieb- erenz explained the variance before the Board, stating that Mr. Combs desires to build a car port which would be only three and one half feet (32) from the street property line on Woods Avenue instead of the twenty (20) feet required by the zoning ordinance. It was further stated that Mr. Combs had the car port completed before discovery. It was brought out in the dis- cussion that Mr. Combs had built the house prior to the zoning ordinance and it is only two (2) feet from the property line. The ownersooiiginaly plan was to build a car port in this location as he had gone to the expense of filling a portion of his yard and constructing a concrete slab. Mr. McGoodwin stated that it appeared that the basic reason for #bw building so close to the street was the concrete slab. The slope of the lot would cause quite an expense to the owner of he had to move the car port to the other side of the house. This would involve quite a fill, a -much larger concrete slab and moving the car port. After further discussion on the size of Mr. Combs front and rear yards, the Board indicated that they were ready for a vote. 37 _s 0 0 .Mr. Crocker Aye Mr. Young Aye Mr. Lewis Aye lir. McCoodwin Aye The Board requested that Mr. Lieberenz write ldr. Combs a letter stating that the Board had granted permission to build the car port because of the terrain of the lot and on the merits of the case, rather than the fact that it was already built, otherwise permission would have been refused.
