VINUTES OF A MEETING OF THE BOARD OF ADJUSTMENT
SEPTEMBER 30, 1953 - 4:00 P.M. — COUNCIL CHAMBER.

The Chairman, Mr. L. M. Mc Goodwin opened the meeting at 4:15 P.M. After roll
call the Secretary read minutes of the meeting held September 4,-1953, which
was approved.
The variation of Frank & Maxine Wilkins was read by the Chairman. Mr. Lieberenz
stated that they requested permission to remodel and structurally alter a
grocery store building on Mission Boulevard, and which will either have to be
repaired or torn down as the supports on the building are giving away. It was
also mentioned that they wished to put in a concrete floor for the whole building.
Mr. Lieberenz read in part Section 13 Part 4 of the Ordinance. It was stated that
this application was in direct violation of the ordinance. The Chairman stated
that a person is entitled to the value of their property. The question confronting
the Board was the definition of structurally altered. Mr. Young,stated that it
was a matter of where maintenance begins and not altered. The Chairman set a
policy for the Board to discuss this particular matter and at the first opportunity
to spend time on discussing the alteration of non—conforming buildings in
residential zones. It was agreed by the Board that it should be a policy that
each case should be reviewed. Mr. Young made the motion that the application
be granted and Mr. Lewis seconded the motion. Roll was called:

Mr. J. E. McClelland request for variation was presented before the Board for
discussion. Mr. McClelland requests permission to build a porch on the front
of his home and by doing so will have to build 821 ft. closer to the street which
will bring him that much further to the street than the building line of the
existing dwellings adjacent.to"his^property. At present the house is located
461 back from the set property line. Mr. Lieberenz stated that he had inspected
the site and that a person would have to be 100 ft. down the street North or South
of his property to hide the view of both houses. It was proved that there would
be no obstruction in view if he built 8 £t. closer to the street and that he W uld
still have 37C 6" from the property line to the street, and that only 25' is required
by law and would not injure the property surrounding to build. There has been
no objections from surrounding property owners to his building closer to the
street. Mr. Lewis made a motion that the variance be granted and Mr. Crocker
seconded the motion. Roll.was called:

The application of Mr. Herndon G. Dowling.was read before the Board by the
Chairman. Mr. Dowling requests permission to build a new residence approx-

imate y six (6 ) feet closer to Markham Road than the existing dwelling to the
west of his property. Mr. Lieberenz pointed out that Mr. Dowling -Is home would
be about 50' from Markham Road, the house next to his is 56' from the property
line and Mr. Branigans house 65'. Mr. Lieberenz read a notice signed by the
adjacent property owners and the owner of a vacant lot. "Quote, "We, the
below -signed owners of lots numbered 6, 7 and 8 of the Hotz Addition, which
lots make up the remainder of the North half of the block west of Palmer Avenue
and South of Markham Road, hereby state that we have no objection, whatsoever,
to Herndon G. Dowling placing his house on lot number 5 as specified in his
corrected plans and as presently laid out on his lot, although the carport of
his house will extend beyond the frontage established by the two houses already"
built in this block.Signed by J. L. Lancaster, owner Lot #6, Mr. D. D. Lingelbach,
owner of Lot #7 and Mr. G. F. Branigan, owner of Lot #8. The top of Mr. Dowling's
house will be 1 ft. higher than street level and could not possibly obstruct
anyone's vision on Markham Road. Mr. Lewis made the motion that the application
be granted and Mr. Young seconded the motion. Roll was called:

Mrs. Pauline @coding requests permission to erect a dwelling on a 197 by 104
foot lot. This property is located on the SW corner of East Spring and Washington
Ave. Mrs. Gooding's application was read and Mr. Lieberenz followed with
discussion. He reported to the Board that he did not take measurements but
only investigated the possibility of attaching proposed dwellingtto present
garage dwelling. The ordinance states that for every dwelling there must 7000 sq. ft.
unless this lot was plotted and recorded prior to 1951 when this ordinance was
passed. This particular case is definitely stated in the ordinance as a violation.
The Chairman',made a suggestion that Mr. Lieberenz prepare a plat of the buildings
in.that block and submit it to the Board at its next meeting. He also made
an motion that the Board adjourn until Wednesday October 7, 1953, at 4:00 'P.Mo
to continue with Mrs. Gooding's application. Mr. Lewis seconded the motion.
