Pryor, Chairman, City Planning Commission Ruth Anne Grisso, Secretary The Chairman called the meeting to order and asked the Secretary to read Minutes of the last meeting held August 28, 1952. The Minutes were approved. The Chairman asked Assistant City Engineer, Tom Everett, to present Mr. Boyd Shafer's.request-for a variation to the 'Zoning Ord- inance. Mr. Everett explained that Mr. Shafer desired to erect a car- port 11' x 20' on the north side of his house at 629 Gray Street eleven and one-half feet from the front property line because of the contour of his land. Mr. Shafer's property is in the "A" residential zone which requires a 25 foot front, line for any buildings. Mr. Everett explained that to set his carport back 25 feet would make it completely inaccess- ible. Mr. Young contended that a car could not be placed in the driveway if there was a car in the carport. The Engineer said the street was 40 feet wide with a 5 -foot parkway. He said this section of the City was not.built up heavily at present and from the type of lot to the north of Mr. Shafer he doubted if there would be a house built there. Due to the topography it was felt extremely unlikely that a walk would be erected on Mr. Shafer's side of the street. Mr. Shafer's house was erected about two years at an approximate cost of $10,000 to' $12,000. It was again pointed out that his lot lay on the hill in such a manner as to prohibit any other possibility of a carport other than the one he asked permission to build. Mr. Young called the Board's attention to the situation existing on Skyline Drive where garages or carports had been erected closer than 25 feet to the street and said it was a dangerous arrangement. Most buildings are set back thirty to forty feet. The Chairman pointed out that to deny Mr. Shafer's request was actually prohibiting him from making reasonable use of his property, however, he reminded the Board that only by their critical attitude of any varia- tion did the Board support the Zoning Ordinance. Mr. Pryor, who had made a close examination of the site said he could see no other way for Kr. Shafe n, to erect his carport and unless he had one he would be'forced to keep has car in the street at all times. He assured the Board it would not affect the value of any adjoining property. He also said there would be no obstruction of any of his neighbor's views if a carport were erected in the proposed place. Mr. Pryor told the Board he did haat know of any similar situations in the City. l3 W Mr. Lewis then moved to grant Mr. Shafer's application for variation. Mr. Crocker seconded the motion and the Chairman asked for roll call: L. E. McCoodwin Aye Heydon Lewis Aye Leland Bryan Aye J. R. Crocker Aye Mr. Young did not vote.
