MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENT

The Chairman opened the meeting by asking the Secretary to read the minutes
of the meeting held July 22, 1952, which were approved. There being no un-
finished business to come before the Board, the Chairman asked the City En-
gineer to present the application for variation to the Zoning Ordinance
made by R. F. Carnes and Olen Rich. Mr. Mahaffey explained that Messrs.
Carnes and Rich owned property known as part of Lots 8, 9 and 10, Block 3
in the Jennings Addition to the City of Fayetteville at 407 South College
Avenue.. He stated that the owners share a common double garage and drive
and wish to erect a new garage which they will continue to share. The
'lotting Ordinance does not cover this particular question, however the erec-
tion of a common garage would mean going over the five foot side line. It
was called to the Boards attention that if one man owned all the property
there would be no question about the erection d the garage, and inasmuch
as both property owners asked for such permission on their building permit,
they were acting theoretically as "an owner."
It was pointed out that Mr. Karnes alone signed the application for a
building permit, however he acted as Mr. Rich's agent, explaining to the
Board that Mr. Rich was out of the city most of the time. The City Engineer
informed the group that many building permits were issued in the owner's
names, but were applied for by some one other than the actual owner.
With this information in mind, Mr. Young moved that the application for
variance be granted Mr. R. F'. Carnes and Mr. Olen Rich enabling them to
erect a common garage between their adjoining properties. Mr. Bryan seconded
the motion and roll was called:

Mr. Pryor complimented the Board of Appeals, stating their clear-cut decisions
on applications for variations to the Zoning Ordinance had further strengthened
the purposes of the City Planning Commission.
There being no further business, the meeting was adjourned to Thursday, Septem-
ber 25, 1952 at 4:00 P.M.
