MINUTES OF A MEETING OF THE BOARD OF ADJUSTMENT
JUNE 10, 1952 - 11:00 P.M., COUNCIL CHAMBER

After roll call, the Secretary read Minutes of the meeting held May 15,
1952, and they were approved. The Chairman stated the purpose of the
meeting was to hear applications for variations from the Arkansas Western
Gas Company and from Herbert Lewis, Jr., Ed Brooks and Bill Terry. There
being no representative present from the Arkansas Western Gas Company,
the Chairman explained their application for variation was to use the
property located on the southwest corner of Lot 6, Block 9 in County
Court Addition to the City of Fayetteville, a "Cn Residential 'Lone, for
an 8t x 81 square brick low-pressure regulating system for gas. The ele-
ment of safety was discussed the the Board concurred in the -:opinion that
danger was remote. Mr. Young moved that this application be granted. Mr.
Lewis seconded his motion and roll was called as follows:

The Chairman asked Mr. Herbert Lewis, Jr. to present his application for
variation. Mr. Lewis stated that he, Ed Brooks and Bill Terry were erect-
ing a miniature golf course on North College Avenue in Block 50 of Evelyn
Hills Addition to the City, a commercial zone, but sought the Board's con-
sent to put in a driving range, which would extend back in the "An Residential
'Lone. He assured the Board that the portion of the "All zone would only be
used where balls fell and their use would constitute mowing and erecting a
few signs showing yardage. All tees would be in the Commercial zone. He
said there would be no danger of hitting balls on the highway and that balls
could not be driven far enough to endanger surrounding property. In consid-
ering the application the Board was mindful of the fact that if later develop-
ments brought property into the danger area, such use would have to be abandoned.
Mr. Lewis informed the Board that since he had leased this property from Mr.
Abshier who held the balance of the tractthat as Mr. Abshier sold off lots
he no doubt would revoke his lease for the driving range and golf course. Mr.
Bryan then moved to grant applicants for variation a land use variance only,
non -transferable to any other lessee with no permit for any construction.
Mr. Lewis seconded his motion and roll call indicated the following vote:
