Vaughan, Applicants for Variation The meeting was a scheduled meeting, assembled to hear a petition for a variation. Notice of the meeting had been published according to law in the Northwest Arkansas Times, The Chairman, Mr. L. M. Mc Goodwin opened the meeting by ask- ing the Secretary to read the Minutes of the Initial Meeting of the Board held January 29, 1952. The Minutes were approved and it was noted that the meeting scheduled for February 26, 1952, was by-passed. For information of the group, the Chairman read pertinent ex- cerpts from the Zoning Ordinance. Oath was administered by the Chairman to the City Engineer, the Assistant City Engineer and the two applicants for a varia- tion to the 'Zoning Ordinance. The City Engineer then presented the request made by Mr. and Mrs. L. E. Vaughan for remodeling or building permit to make two apartments in the old Calvary Baptist Church located on the northeast corner of Leverett and York Streets. He explained that this property is in a "C" Res- idential zone. Two-family dwellings are permitted in this Zone, the exception to permission being the lot area which includes only 3500 square feet. The Zoning Ordinance requires 7000 square feet for a two-family dwelling in the "C" Residential zone. It also specifies a 20 -foot setback from the two streets for any new construction. However, the City Engineer explained that any building which is being altered comes under the same requirements. In presenting his plea, Mr. Vaughan stated that he had in mind to have the entrance to the building on Leverett Street. He bought the piece of property around the middle of February, 1952. It was determined that the property had been used as a church until the early part of January, 1952. The Zoning Ordinance was passed and became effective on the 8th day of November, 1951. Mr. Vaughan stated that buildings on either side of his set back twenty and twenty-five feet from the sidewalk and that his building is surr- ounded by residences, however, some residents are renting small apartments in their homes. It was noted again that the "C" area Q zoning permits multiple dwellings, but only on sufficiently 40 large lots for light and air. The Vaughans stated they did not know they had to have a building permit and stated fur- ther that they went into debt to purchase this building, in- tending ntending to rent it to partially make payments on it. They informed the Board they did not intend to live in the build- ing themselves but make it up into two four -room units with the thought of renting to University students. Members of the Board noted that the four -room units would have to be built into 600 square feet and it was pointed out that a single family unit might be made of the building for adequate income. Mr. Clarence Young moved that the Board of Adjustment, at the Chairman's call, inspect the site during the coming week and meet again at 4:00 P.M. April 11th, 1952, with the Vaughan to make their decision on the requested variation. Mr. Crocker seconded the motion and it was passed. The Chairman suggested he would phone the Board for the inspection trip around 3:00 P.M. Friday, April 11th. There being no further business, the meeting was adjourned at 4:50 P.M. 10 Approved April 18, 1952. s- N
