A. Please tum off all cell phones. B. Comments from the public on agenda items. None. ITEM #2 : Minutes of the May 9, 2067 meeting. A motion to approve the minutes was made by David Hollman and seconded by Tim McCarley. The motion carried. ITEM # 3: Receiving of Reports. • A. Chairman Nickle. Announced the Airport Board's next meeting would be on August 8'" and no meeting in July. B. Director Boudreaux report on airport activity. The Arkansas Aeronautics Commission meeting will meet on July 11 and we will be requesting funding for the Airport's Obstruction Study. About 1 ,000 people attended the Planes Trains and Automobiles event. The City Council approved the Resolution opposing additional taxes on general aviation, and we will forward it to the AAOP. The Council also approved the Walker ground lease. The Arkansas Department of Aeronautics has started a new program that grants will be based on the number of aircraft that is based at each airport, and we would like to apply for assistance with our HVAC system, and some other items. C. Financial Coordinator Nicholson report on budget and FBO. Operations are down by 1 ,000 from May last year. We think it is because of high fuel prices and if the trend doesn't change, it will eventually affect the tower count and the FAA's Benefit Cost Analysis. Trend has been down at surrounding airports and now operations are beginning to climb a little. Chairman Nickle said he thought we are in an Adjustment Period. B. Sharkey commented that in May and June of last year, . freight was being chartered out of this airport which resulted in some increase in fuel sales and operations. J. Nicholson said that we previously had the Airfest in June, which gave an increase. The fuel prices have dropped, we are the lowest around. The based tenant Jet sales were up in May. Regarding the Financial Report, we are doing a lot to keep expenses down. Rent for the ATCT building was included in this year's budget and then they canceled their lease and rent revenue has dropped. We ran an ad four times in Trade a Plane, the hangar is listed on the City's Website as available to rent. Director Boudreaux said it is listed on the Arkansas' Economic Development web page and we received one call that was not aviation related, and we will continue to work with Joe • Maynard about renting the facility. J. Nicholson reported the corporate hangar tenants will begin paying rent August 1 , 2007, it will go into the Airport Fund, and in June 2008 we will make our annual payment to the loan from the City. I D. Senior Secretary Powers report on T-Hangar Leases. We had one cancellation this week and have filled that unit, and another cancellation this morning and someone is coming tomorrow to see • about renting it. Chairman Nickle said for the year we had about a 3% vacancy, and that is not bad. E. Engineer Wayne Jones' report on construction projects. We didn't meet the goal to be finished with Hangar A by June 15`h, but should be through by end of June. We will go over the punch list next week. There were some issues with the heating system. Delivery of the light fixtures is three weeks late. Interior work has begun on Hangar B. McClelland' s has received a second proposal for the Airport' s aerial survey. F. Director Boudreaux report on maintenance activity. The staff is involved in relocating the Airport sign. Top has been removed and they are cutting the sign in half to move. ITEM #4 : Old Business A. Discussion: Wilma Walker's (Wilma's Restaurant) request to waive the 10% of gross payment for the first 90 days. The chart shows their growth each month. They are asking to waive the 10% for May, June and July. R. Greene said we need to do what we can to help. A motion to waive the 10% of gross was made by Richard Greene and seconded by David Hollman. The motion carried. ITEM #5: New Business. A. Discussion and vote, cancellation of the July Airport Board Meeting. Board Consensus was to cancel the July meeting. B. Approve utility easement cast of the light lane for Joe Maynard. Director Boudreaux explained this would be along the most eastern light lane north off of Willoughby Road. It would not destroy any trees. Vehicle access to their property, for a single family residence, would be the • first road north of the Quick Stop at top of the hill on Highway 71 . Chairman Nickle mentioned since the light lane easements were purchased by FAA Grant money, do we need to get the FAA's approval. The quickest way would be to call Fort Worth. Richard Greene said we need to be specific, list what the easement is for. A motion was made by Tim McCarley, pending research, having the easement described, what goes in the easement, what it is for, for instance a, water line up to "x" size, buried, for a single family residence, complies with FAA rules, and nothing above the ground. The motion was seconded by Richard Greene. The motion carried. ITEM #6: Other Business. A. Items from the Public. None. B. Items from the Airport Board. Director Boudreaux called attention to the article in the agenda about one of our based tenants, Flying Investments and also one of our Board Members: David Hellman. Meeting Adjourned at 4:40 p.m. David Hollman, Secretary Date • 2 • TayveeVle ARKANSAS AVIATION & ECONOMIC DEVELOPMENT FAYETTEVILLE MUNICIPAL AIRPORT • DRAKE FIELD August 7, 2007 MONTHLY REPORT Aviation and Economic Development Department Fayetteville, Arkansas July 2007 AVIATION: 1 Operations and fuel sales continue to trend downward. As soon as I return to work full time we will develop proactive corrective actions to tum the trend around. We grew the business for nearly five years straight under less than ideal conditions, we should be able to do it again. The main difference is the cost of fuel. We should consider this item for a strategic planning discussion. 2 We received the RSA determination from the FAA with Kelvin Solco and Ed Agnew signatures. This is major as when we checked on the status of this new determination, we were told that the FAA could not make a new determination until something had changed. This is thanks to all who attended the day trip to Dallas and to Don Harris, our project manager who made it happen for us. • Thanks much! 3 The Corporate Hangar Construction Project should close out in the very near future. We are holding a significant portion of the money until everything is fixed to our satisfaction. SkyVenture is ready to occupy Hangar A. The Board will consider a small rent rebate for SkyVenture to get the building set up for their business. They have signed an Amendment to their Lease. The other hangar will not be ready until next month. There are still many punch list items to correct. The heating systems are still waiting parts. The local contractor identified a problem which the manufacturer agreed to fix. We are still planning to fix the . floor in the FBO hangar when Million Air is able to move into their new hangar. James is working hard to get the best reasonable price. Both tenants remain anxious to move in. 4 . The State Aeronautics approved our Grant request and the City Council approved our application for the project to complete the Runway Approach Obstruction Survey. This project is fully funded by Grant revenue and is the first step in our project to improve the Runway 16 Safety Area. 5 We received our Airport Certification Inspection from the FAA last month and a copy of the Letter of Correction is provided for you. All items have been corrected or in process. She asked that we not charge the 10% on the first $5K since her base rent is 10% of $5K. James came up with a new formula that will help Wilma as she continues to grow the business. We would like to have a restaurant in the terminal long term. The Board will consider this request at the August meeting. 7 The Arkansas Air Museum and the Ozark Military Museum continue preparations for the Canadian Snow Birds for Wednesday, September 26, 2007. We have received our waiver from the FAA. We will be responsible for compliance with the regulations and will administer those that have been waived. 8. Airport employee Chad Wilson has resigned, and we are in the process of hiring a new employee. ECONOMIC DEVELOPMENT: 1 The Smith Two Way cell tower Lease was approved by the Council. The Planning Commission must still approve the Conditional Use. 2 Steve Rust conducted a meeting of the City Council explaining Economic Development to the Council members. Harris Sr. Program Manager Arkansas/Oklahoma Airports Development Office Enclosure c LOEWED JUL 2 7 2001 • RUNWAY SAFETY AREA DETERMINATION �� � Runway 16/34 Fayetteville Municipal Airport, Drake Field Fayetteville, Arkansas BACKGROUND: Fayetteville Municipal Airport (Drake Field) is a Part 139 Class IV general aviation airport located on the south side of Fayetteville, Arkansas. Until 1999 the facility served the Northwest Arkansas region as the only commercial service airport. The Northwest Arkansas Regional Airport opened 25 NM north of Fayetteville and now serves the commercial service needs of the region. Drake Field Airport Reference Code is C-II requiring standard Runway Safety Area dimensions of 500 feet wide by 1000 feet long. Fayetteville maintains its Part 139 Certification in order to serve frequent aircraft charter flights. Runway 16/34 is the only runway at the airport and is 6006 feet long and 100 feet wide. Declared distances as published in the Airport Facilities Directory are: TORA TODA ASDA LDA RWY 16 6006' 6006' 6006' 6006' RWY 34 6006' 6006' 6006' 6006' Runway 34: The RSA at the Runway 34 approach endcomplies with ARC C-II standards. Runway 16: Runway 16 approach end RSA does not comply with ARC C-ll standards. US Highway 71 converges with the extended runway centerline at the north end impacting the RSA on the west. Runway 16 safety area length is 902 feet on the runway centerline and 325 feet wide at the north end where it narrows due to the convergence of HWY 71 and Earnest Lancaster Rd., the • airport service road. The Federal Aviation Administration's (FAA) 1999 Runway Safety Area Determination indicated that the non-standard RWY 16 RSA was acceptable since no extension of the runway had occurred since the December 31 , 1987 date listed in Part 139, which required RSA standards to be maintained. The 1999 determination also found that there were "no plans to extend Runway 16/34 at Drake Field as the current runway length was sufficient to accommodate existing and future aircraft fleet mixes." Aircraft operations forecasts and fleet mixes have changed since the 1999 determination which warranted an update to the Airport Master Plan. The FAA accepted the MasterPlan in December 2006, Basis of Determination: The Master Plan Update evaluated five alternatives to achieve a standard RSA for the Runway 16 approach end: Alternative No. 1 : Displace the Runway 16 threshold south 800 feet. The estimated cost to implement this alternative is $ 800,000, but would impose an unacceptable reduction in landing distance available (LDA) to both runways and the Available Stop Distance (ASD) to Runway 34. Alternative No. 2: Relocation of the entire runway 800 feet to the south would eliminate the non-standard RSA and would maintain the current effective runway length for all but the Landing Distance Available (LDA) to Runway 34. While this would achieve Runway 16 RSA standards compliance, the estimated cost is $16,800,000. Alternative No. 3: Extend the runway 1000 feet to the south, displace the Runway 16 threshold • south 800 feet, and use declared distance to eliminate the Runway 16 RSA non-standard condition. This alternative would improve TODA and TORA by 1000 feet in both directions, increase ASDA for Runway 16 by 1000 feet and for Runway 34 by 200 feet, improve LDA for Runway 16 by 200 feet, but reduce LDA for Runway 34 by 800 feet. Runway 16 RSA is in full compliance. The estimated cost would be $20,000,000.00. J U L 2 7 2007 r ZPORT 2 Alternative #4: Install EMAS in the Runway 16 RSA and extend the runway south 1000 feet. This option resolves the non-standard condition of the Runway 16 RSA, but requires that the Runway 16 threshold be displaced south 400 feet as required by AC 150/5220-22A to achieve the 600 feet of standard width RSA to provide for adequate undershoot protection prior to the landing threshold. There is currently only 200 feet of standard width RSA for Runway 16. This option improves TORA, TODA, and ASDA for both runways by 1000 feet and LDA by 600 feet for Runway 16. LDA for Runway 34 remains unchanged. Runway 16 RSA would be in full compliance. The estimated cost would be $27,3007000.00. Alternative #5: Relocate Highway 71 to the west and enable the Runway 16 RSA to be in full compliance. This option eliminates deficiencies associated with previous alternatives. The estimated cost would be $3,700,000.00. Alternatives Analysis: Any alternative that imposes departure or arrival performance penalties must carefully weighed. Thus alternatives #1 , #2 and #3 are unacceptable for operational purposes. Both alternatives #4 and #5 will provide a Runway 16 RSA that complies with design criteria. When considering only the RSA improvement, Independent of long-term overall development objectives, the cost of either Alternative #4 or #5 is similar, but favors the Highway 71 realignment option. EMAS would cost approximately $4.5 million dollars, but additional runway length (400 feet at approximately $.4.0 million) must be added to the south end.concurrently in order to maintain the existing runway length and to avoid departure and landing penalties. If additional runway length were added to the South end to keep current runway length, EMAS would still be.required as the RW34 safety area would • then be 400 feet short of standard, increasing cost by another $5.8M. Alternative #5 would cost approximately $3.7 million and will improve the Runway 16 RSA and retain current runway length without incurring departure or arrival penalties. Determination: This determination is made based upon the criteria set forth in FAA Order 5200.8, "Runway Safety Area Program", paragraph 8.b.2. Based on the preceding analysis, I have determined that improving the Runway 16 RSA is reasonable and consistent with safety to alleviate the current RSA deficiency. I have further determined that Alternative #5 is the preferred action by realigning Highway 71 and airport access road to bring the RSA into full regulatory compliance. This action reflects the updated Airport Master Plan. This determination is subject to revision upon receipt of relevant supplemental information. Edward N. The inspection revealed that the airport is not in full compliance with all of the requirements of Federal Aviation Regulation Part 139, the Airport Operating Certificate, and the Airport Certification Manual. The following discrepancy was found and, as agreed, should be corrected by the following dates: 139.201(a)(1) General Requirements: The certificate holder failed to comply with their Airport Certification Manual (ACM) by failing to properly maintain airfield markings, signs, and failing to meet the ARFF response requirements. Correction Date: October 1, 2007 139.311(d) Airfield Signs: The certificate holder failed to comply with the regulation by not properly replacing approximately one dozen airfield signs that had faded beyond acceptable limits. During our inspection we identified several runway exit signs, taxiway location signs, taxiway direction signs, and one delaminated runway holding position at Runway 34 and Taxiway B that did not meet acceptable standards. All sign panels that have faded beyond acceptable limits must be replaced. See comments and recommendations for additional information. Correction Date: August 27, 2007 • • 139.311(d): Airfield Markings: The certificate holder failed to comply with the regulation by not properly maintaining the runway holding position markings at the west side of Runway 16/34, runway lead-on lines, and runway centerline markings on portions of Runway 16/34. All faded markings must be repainted. See comments and recommendations for additional information. Correction Date: October 1 , 2007 139.319 (h)(1)(ii) Aircraft Rescue and Firefighting (ARFF): The certificate holder failed to demonstrate compliance with the 3-minute response drill. Procedures were changed during inspection and subsequent ARFF drill met time requirements. See comments and recommendations for additional information. Correction date: Corrected During Inspection We have given consideration to all available facts and concluded that this matter does not warrant legal enforcement action. In lieu of such action we are issuing this letter that will be made a matter of record. We will expect future compliance by the airport with the regulations. Dougherty Airport Certification Safety Inspector Enclosure cc: Arkansas Department of Aeronautics, I Airport Drive 3`d Floor Little Rock, AR 72202 alit, 0 6 tool COMMENTS & RECOMMENDATIONS AyyrukT ANNUAL CERTIFICATION INSPECTION FAYETTEVILLE MUNICIPAL AIRPORT-DRAKE FIELD JULY 23 -25, 2007 Runway Safety Area: As noted in last year' s inspection, it appears that the supplemental windsocks are located within the runway safety area (RSA). We encourage Fayetteville to work with your FAA Program Manager to include relocation of the windsocks be relocated outside of the RSA. Airfield Signs: Our 2006 letter notified the certificate holder that airfield signs were showing signs of fading and nearing the need for replacement. This year's discrepancy identified a dozen failed signs but there are additional signs that, although still providing adequate visual cues to pilots, will need to be replaced in the near future. We commend Fayetteville for the establishment of a budget line item for sign replacement and encourage the certificate holder to ensure timely replacement of fading sign panels in the future. Airfield Markings: Our 2006 letter notified the certificate holder of obscuration of portions of the runway centerline and loss of reflectivity on some of the runway holding position markings. From this inspection we observed that the west side runway holding • position-marking paint was in good condition but there was a significant loss of glass beads reducing their nighttime reflectivity. It was suggested that the repeated snow removal operations might have impacted these markings. Additional attention should be given to maintaining the nighttime reflectivity of airfield markings. Aircraft Rescue and Firefighting (ARFF) Response: After the ARFF vehicle failed to meet the regulatory response time, investigation revealed that the primary issues were with the city' s dispatch office. Although this department regularly dispatches structural fire department and police department vehicles and personnel, they infrequently dispatch airport ARFF vehicles. We believe this resulted in the time delay and dispatching of the vehicles to the wrong location. New procedures were put in place and an additional timed drill was successful. The new procedures included ARFF notification to the tower when they arrive and depart from the airport and ARFF personnel's active monitoring of the assigned aviation frequency for emergency callouts while on Part 139 standby at the airport. Tower personnel will continue to make mutual aid notification during actual ARFF emergencies and ARFF callout when ARFF personnel are not positioned on the airport through the current dispatch office. Closing Comments: In closing, we wish to thank you and your staff for the cooperation • and courtesy shown me during the inspection. Walker This Addendum to the Lease will replace the terms of the rental payment for the restaurant area in the terminal as set forth in Item 4, paragraph 2, on page 2 of the Lease, and is hereby made a part of the Lease. Background: On October 14, 2000, the Fayetteville City Council approved the Fayetteville Municipal Airport's revised Disadvantaged Business Enterprise Program. The Airport's DBE Program is federally mandated under 49 CFR Part 26 for all Department of Transportation (DOT/FAA) grata recipients which anticipate receiving more than $250,000 in federal funds in the fiscal year. Drake Field anticipates receiving approximately $ 1 ,000,000, "Correct Runway 16 Safety Area Deficiency Phase I" from the DOT/FAA in FY 2008. The DBE Program assures that Minority & Women-owned businesses, and other economically disadvantaged small businesses have an equal opportunity, or "level playing field," in competing for • Airport procurement contracts. 49 CFR Part 26 requires that our DBE Program Goal be updated annually, and its acceptance acknowledged by the sponsoring city's executive body. The Updated Goal describes the overall DBE participation percentage and value of procurement contracts targeted for award to DBE contractors in the fiscal year. The regulation provides the methodology to be used to set contract DBE participation goals. Discussion: The purpose of this item is a new resolution approving the updated annual percentage goal established by Fayetteville City Council Resolution No. 143-06 and previous annual updates for DOT/FAA grant assisted contracts entered into by the City of Fayetteville Municipal Airport. The Airport Board has reviewed the update goal and recommended at their meeting of August 8, that the document be forwarded to the City Council for approval. The new resolution will accept and approve the airport's updated DBE participation goal for FY 2008. Budget Considerations: No budget effect. The Contract with the engineering firm includes a specific Disadvantaged Business Enterprise DBE Assurances clause stating the firm's responsibility to offer DBE' s the "maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds under this agreement." Considerations in selecting Market Area Correct RW 16 RSA Deficiency Phase I, Engineering, Land Acquisition, Environmental: The project phase consists of preliminary design, engineering, geologic investigation, environmental assessment, survey and appraisal, and property acquisition. Excepting the necessary field work, many of the tasks to be accomplished need not be performed on site. It is desirable, but not essential, to enlist skilled personnel who are experienced and knowledgeable of local conditions. However, professionals certified by the State of Arkansas are presumed to have the qualities necessary to perform the work adequately. While no document specifically described as a disparity study could be located for the region or state, the U.S. Department of Commerce / Minority Business Development Agency has published a two-page document titled "The State of Minority Business in the State of Arkansas", which offers some comparative analysis of minority percent of population vs. share of business ownership and percent of sales. In broad terms, the brief suggests that minority business ownership in the state remains significantly less than proportional with population. There is no specific breakout of businesses engaged in professional consulting services, design or engineering. However, it may be inferred from the overall data that a similar discrepancy likely exists in that business sector. Interestingly, Hispanic and American Indian & Alaska Native categories participate in business ownership as a percentage of population of the category at a level greater than the national rate. Taken with the dramatic increase in Hispanic population in the state over the last decade, this greater business ownership rate may be indicative of the perceived opportunities Arkansas offers to Hispanic minority emigrants, and of the permanence of their settlement. • Financial Research was conducted to determine the number of, and the services provided by, DBE-owned financial institutions in the state. A listing from the U.S. Federal Reserve of all minority-owned banks in the U.S., sorted by state, indicates that there are no minority-owned banks in the State of Arkansas. Census Information The latest U.S. Census Data for Hispanic population in the Northwest Arkansas Regional area indicates an increase of 55% since the US Census in 2000. This is indicative of the continuing influx of Hispanic emigrants to the area. According to the 2002 US Census Survey of Business Owners, there are only 143 Hispanic professional, scientific, & technical services firms in Arkansas. Again, no breakout of firms engaged in Engineering or Real Estate is provided by the data. The greatest percentages of all Hispanic-owned firms appear to be concentrated in the service industries. However, it maybe conjectured that the Hispanic-owned service industry business base could be parlayed into better opportunities for higher education in succeeding generations and thus establish the foundation for future growth in the professional sector. None of the factors described above were determined to warrant an adjustment to the calculated Goal percentage. The information does provide insight into the conditions of the local and regional business environment for DBE's. If any conclusion can be drawn, it is that added • validation is given to the choice of Race-Conscious measures in order to promote DBE participation in our AIP projects. FYV did not have any DBE participants in Professional Services contracts on any AIP projects for the last six years.
