Little, Director TO: Airport Board FROM: Alett Little, Economic Development Director/Airport Manager DATE: December 4, 2000 SUB3ECT: Runway 16 Approach In following up on the letter that was sent as a result of the Airport Board resolution in October, I called Don Harris to check on the progress of the FAA in determining whether a reduction in the nummunis for Runway 16 was feasible. Particularly, I was interested in ascertaining the schedule of when we might have a determination. According to Don Harris, the group that Charlie Ketler works in is having to perform some mandatory tasks on other airports relating to non-precision approaches. Don Harris does not supervise that group, of course, but he indicated that since we already had an approved approach, that our work was not in the normal workload for the group. Don Harris was kind enough to write a status letter for the Airport Board, and it is attached. Action Requested: None - I believe that the FAA has been properly notified that we continue to be interested in reducing the mimmums for Runway 16. 1 will continue to monitor (and encourage) their progress and to keep the Airport Board informed. We have found no official record or documentation of three-quarter mile visibility minimums ever being established for Runway 16 at Drake Field. However, as requested in earlier meetings with members of your staff, we agreed to re-evaluate the possibility of establishing such minimums. In a 1998 Airport Improvement Program grant, the Federal Aviation Administration authorized the development of a study to cleterrindne existing condition obstruction information affecting the approach to runways at Drake Field. This Information was prepared by Garver Engineers and reported in the Runway Approach Obstruction Location Study (RAOLS). As you are aware, the data presented in the RAOLS concerning existing obstructions must be compared to previous obstruction information and other data in Airport Layout Plan drawings. This date forms the basis upon which potential revisions to approach minimums may be considered feasible. Previous obstruction data and changes thereto must be specifically identified and updated in FAA models to permit an accurate analysis. In addition, analysis by numerous specialties and offices within FAA must be coordinated to produce a determination. Paralleling our effort for Drake Field, FAA must also respond to agency mandatet; to develop and publish instrument approach procedures for other airports that do not already have existing published instrument approach procedures. It should be understood that while we are progressing on your request, a definitive determination date cannot be established. As each phase is completed we will be able to provide the status of the effort as well as what the next step involves. We will continue to work closely with airport management on this project. The plan will remain in draft stage until it has received the approval of the FAA and the National Weather Service. The Airport Board will need to give preliminary approval in order that the plan can be transmitted to the other agencies for their review and approval. After the recommendations of the FAA and the National Weather Service have been made, staff will re-present the plan to Airport Board for final approval. Action Requested: Resolution recommending that the Land Use Plan be forwarded to the FAA and the National Weather Service for approval. Little, Director TO: Airport Board FROM: Alett Little, Economic Development Director DATE: December 5, 2000 SUBJECT: Ernest Lancaster Drive, Change Order #1 Due to concerns about possible flooding from airport drainage along the extension of Ernest Lancaster Drive to the neighbor to the east, Mr. Arthur Miller, staff requested that the drainage be redesigned so that none of it is directed to the east. Currently, drainage flows to the east, and with the redesign, all drainage will be captured on the west side of the road and directed to the drainage outlets. The work to accomplish this change will cost $23,838.00, and funds are available in the project contingency. By telephone, on December 4, 2000, Don Harris gave a verbal approval for this work. It is expected that the FAA will fund 90% of this project from Airport Improvement Program (AIP) funds. Action Requested: Resolution recommending that the City Council approve Change Order # 1 to the contract with Harrison Davis Construction in the amount of $23,838.00 for drainage redesign and that staff pursue both federal and state funding to offset these increased costs. Staff Recommendation: Approval of the resolution as stated above. Additional Information: Staff has reserved a place on the December 19, 2000, City Council agenda for this item, in the event that the Airport Board chooses to recommend approval. Hangar, $83,896 Task Order # 6, four 50' x 50' Corporate Hangars, $39,606 On March 7, 2000, the City Council approved an engineering contract with McClelland Engineers for capital improvement projects scheduled for Drake Field. The first two projects, Extension of Ernest Lancaster Drive and construction of two 8-bay t-hangars are already underway. Approval of four additional projects totaling $ 168,872.00 is requested: Task Order # 3, Large Scale Development Plan, Not to Exceed $ 15,000 Task Order # 4. Engineering and Construction Observation of an 80' x 80' Corporate Hangar, Not to Exceed $30,370 Task Order # 5, Engineering and Construction Observation of a 17,000 sq. ft. Hangar, Not to Exceed $83,896 Task Order # 6, Engineering and Construction Observation of four 50' x 50' Corporate Hangars, Not to Exceed $39,606 Completing the engineering for the above projects is key to additional growth at Drake Field as construction of these projects will create new rental facilities for aviation related businesses. Tenants for two of the facilities are identified; however engineering fees will not be expended unless the individual Task Orders are processed with Notices to Proceed. Action Requested: Resolution recommending that the City Council approve Task Orders #3, 4, 5, and 6 with McClelland Engineers and directing that staff pursue both federal and state ftmding to offset the associated costs of this work. Staff had hoped to deliver a completed letter to Airport Board, but in order to assure that all details have been properly addressed, Kelner has asked for additional information and more time - 2 weeks. Staff feels that it imperative that Airport Board be informed that Task Order #5 of the work with McClelland Engineers is tied to the final, negotiated lease with Kelner Turbine. As stated in the report relating to the Task Orders with McClelland, these task orders will not be initiated or any money expended unless a firm and binding commitment has been received from Kelner. Action Requested: Resolution endorsing the work with Kelner Turbine and calling for a Special Meeting to be set, if necessary, to address the Kelner Turbine lease. Staff Recommendation: Approval of the resolution as stated above. LETTER OF INTENT I Lessor: City of Fayetteville/Fayetteville Municipal Airport 2. Lessee: Kelner Turbine Inc. 3 . Premises: (Address) 4. Original Term: Thirty (30) years. 5 . Options: Two (2) options of ten ( 10) years each. 6. Rental: City constructs building for a maximum of Seven Hundred and Fifty Thousand Dollars ($750,000) excluding internal furnishings. Monthly lease based on Nine Percent ( 9%) rate of return with a clause to adjust the lease rate to compensate for inflation with adjustment periods in Five (5) year increments, or City will support an Act 9 Bond issue with a ground lease at Five Cents ( $.05) per sq. ft. per year.. 7. Taxes. Insurance and Maintenance: Kelner Turbine Inc. shall keep in full force during the term of the lease all required insurance. Kelner Turbine Inc. will be responsible for any ad valorem taxes on the leased property. The Fayetteville Municipal Airport shall be listed as additional insured on Kelner Turbine Inc. liability insurance. Kelner Turbine Inc. will be responsible for all expenses associated with normal building and grounds maintenance. S . Contingencies: A) The Fayetteville Municipal Airport will either own or control by letter of agreement to lease all of the property in question. B) Kelner Turbine Inc. shall have days from the date of Letter of Intent between Fayetteville Municipal Airport and Kelner Turbine Inc. to complete its due diligence as it relates to surveys, environmental audits and any other feasibility studies necessary for Kelner Turbine Inc. C) The Fayetteville Municipal Airport shall provide to Kelner Turbine Inc. after this Letter Of Intent is executed by all parties, copies of any surveys, soil tests, and environmental studies on the property. 9. Lease Agreement: The format of the lease agreement will be the standard contract, subject to mutual agreement of terms and conditions not specifically mentioned herein, whether it is a ground lease or a lease for the facility.. Kelner Turbine Inc. understands that certain provisions required by the Federal Aviation Administration must be incorporated in the final Lease Agreement. 10. Right of Entry: Fayetteville Municipal Airport upon execution of this Letter of Intent will grant to Kelner Turbine Inc. the right to enter upon the property to conduct all surveys, soil tests and all other studies deemed necessary for Kelner Turbine Inc. to review the property. Kelncr Turbine Inc. and Fayetteville Municipal Airport will be indemnified against all claims arising from this activity. This clause shall not be construed to waive that tort immunity as set forth under Arkansas law. Kelner Turbine Inc. agrees to provide copies of all such surveys, tests, studies, etc. to Fayetteville Municipal Airport. 11 . Fayetteville Municipal Airport upon execution of this Lease Agreement will grant to KelnerTurbine Inc. the right to use the Sound Barrier at no charge until such time as there might be another tenant which desires to use the Sound Barrier, or to use the ground under the Sound Barrier. If another tenant desires to use the Sound Barrier or the ground on which the Sound Barrier is located, then a separate Lease Agreement will have to be negotiated. 12. Acknowledgment: Please be advised that this Letter of Intent does not constitute a legally binding contract and is subject to a fully executed Lease Agreement between Kelner Turbine Inc. and Fayetteville Municipal Airport. 13 . Ingress and Egress Easement: The City of Fayetteville agrees to grant reciprocal ingress and egress easement to Kelner Turbine Inc. allowing for traffic flow across their respective adjoining properties. 14. Minimum Standards: This Letter of Intent and any Lease Agreement entered into will be subject to the Fayetteville Municipal Airport's Minimum Standards. We have a new business in the incubation stage on the airfield. This operation has the potential to grow into a large business on our airport. We have attended meetings with building contractors and future tenants gathering information on cost estimates and size requirements of buildings. Alert and I have received inquiries from aircraft owners in the area referencing hangar availability, and in general, seeking additional information about our airport. This is a clear signal that our growth plan is getting out to the aviation community. The Drake Field video, produced by the City's Economic Development Office and the Fayetteville Government Chanel, has been running on Chanel 3 about twice a week Alett and I have been to Tulsa working with Barnard and Dunkelberg Company, Inc. on our final Land Use Plan. Although the plan can be amended as needed, we feel we have a good plan to begin moving forward with the Large Scale Development, engineering, and bid specifications for six facilities which could house aviation related businesses or an aircraft with office space. We do have one tenant on the field that is anxiously waiting for a larger facility and that is part of the Large Scale Development. We are looking forward to completing our Land Use Plan. It will be helpful to explain to the public and those interested in Drake Field (possible tenants) where and how the new aviation industrial park will fit in with our existing facilities and how access to the roadways, runway and taxiways would be achieved. Other marketing visits include three follow-up road visits and a visit to a company that is scheduling a tour of the airport in December. In November we had one new company visit the airport and two companies that revisited the airport. The USDA Forrest Service visited the airport for a second time in November and is considering Drake Field, as well as three other locations, for their air-tanker base. Alett arranged for a Welcoming Committee of Fayetteville 's business leaders and personnel from the Fayetteville Chamber of Commerce and the City Administration to give a presentation and be available to answer questions about Drake Field and the community. Lunch and a tour of the facilities was provided and everyone believed the information was well presented and well received. They expect to make their decision after the first of the year. We would like to thank everyone that was involved in the preparation meetings and the actual presentation. The tower has reported the airport operations are up for the month of November. Please compare the "Local Traffic" column in the months on September, October, and November for the year 1997 to the same months in the year 2000. Year 2000 shows substantial growth in the local airport operations count. As of this date, we have six tenants in T-hangar "G". Four are new to the field and two were cur-rent tenants. T-hangar "17", when completed, will have two tenants, one new to the field, one a current tenant. The three current tenants are moving from single engine T-hangars and we are currently working the single engine waiting list for new tenants to replace those just vacated. This airspace proposal is initiated in the interest of safety, The following services wiH be provided in the new Northwest Arkansas Regional Airport Class C airspace and outer linuts; a.
