Dear Mr. Harris:
Greetings from Fayetteville, Arkansas. At the October 2000 meeting of the Airport Board discussion
again centered on the re-establishment of a 3/4 mhuirnum for Runway 16 at Drake Field. As you
know, we have been addressing this issm rather seriously since the end of June when two of our
members visited with you and odbers in Ft. Worth. Subsequent to that meeting Dale Frederick and I
visited Ft. Worth and discussed the issue.
Also in early September when Bob Hutchins and you were at Drake Field, the data was again
discussed and actions taken by the Airport to date were reviewed. Our understanding is dot Highway
71 and the mountain to our north are obstacles. One deci min which has to be made is whether a
deviation from standards can be authorized for these two areas. At the base of the mountain is a light
pole and since the mounta is, itsel� an obstruction, it does not seem reasonable to remove the light
pole if the mountain continues to be considered an obstacle. Also there are two trees which can be
topped or cut; however, if the presence of Highway 71 will remain an obstruction (no deviation from
standards granted) theti, it is not logical to remove the trees as their removal will not gain us the
desired niminium.
Pleast: consider this a librinal request on the question of whether the FAA will grant a 3/4 mHe
minarrum R�r the Runway 16 approach. in the event that the FAA is unwilling to grant the 3/4 mile
approacl4 we request that a list of remedial actions be prescribed which would make the granting of
same feasible.
You will recall that we have firrinished the FAA data on the existing obstructions which remain in the
Runway 16 approach as recorded in the Garver Engineers report dated April, 19" as firrided by AIP
grant # 3-054)020-25. This data represents the existing condition at Drake FiekL
We are very amdous to have tins issue resolved and want to work with the FAA to reach a decistim.
As this issue has been outstanding for so long, we respectlully request that the FAA give us a
timetable of when we might expect to receive information.

SUBJECT: Response to Airport Certification Inspection
After the last Board meeting a copy of Mr. Robert Hutchins' letter transmitting the results of his
trispection trip to Fayettevifle/Drake Field was mailed to all Airport Board members. The purpose
of the inspection was to determine if the Airport was meeting the requirements to remain a
Limited Part 139 Certificated Airport. As can be determined from the report, he was mostly
complimentary and made very helpful suggestions. A copy of our responses to him is attached.
Action Requested: None.
Staff Recommendation: Familiarization of Airport Members with the details of maintammig our
Limited Part 139 Certificate.
Annual Airport Certification Safety Inspection
Drake Field

Marking: Changes in marking standards in revised Advisory Circular 150/5340- 1 H were to be
implemented by August 2000. AD marking now meets the standards, however, please insure that
any future re-striping includes reflective beads on the paint as required by FAR 139 and the
marking standards.
Current marking which meets standards will be maintained. A plannedprojecl to repair
pavement will necessitate that some marking be replaced and care will be taken to include
reflective beads as required by FAR 139.
Lighting: Uniforrnity of brightness of runway, taxiway lighting and sign fixtures are very good and
daily maintenance appears effective. Some housekeeping work is needed in the electrical
equipment room, including a new sump pump to get water out of the electrical manhole.
Work has been performed in the electrical room. A new sump pump has been installed and a
copy of the specificationsfor that pump is attached.
Safety Areas: We conducted an inventory of objects in the runway safety areas (RSA) for a
national FAA program several months ago. We remeasured the south RSA and found that the
fence is located about 965 feet (average of two measurements - 967 feet and 962 feet) south of
the runway end, meaning that the full I 000-foot safety area was not completed as intended. At
1000 feet, one is past the fence and within the side slope of the relocated creek.
The engineeringfirmfor the creek relocation was contacted and asked to verij� the distance
from the end of Runway 34 to thefence. The engineer sent a certi ication letter veri)�ing that
the distance in question is 1010feet, per the plans. Airport staff used the wheel to measure and
did not arrive at the 1010foot measurement, so we then used a 100foot tape. Themeasurement
with the I 00foot tape was 100 7feet. A copy of the engineer 's certification letter is attachedfor
yourfiles.
The south RSA is very difficult to inspect because more than half is not mowed, hampering access
and increasing the difficulty of search and rescue. Airport management agreed to start mowing
the entire safety area out to the south fence/property boundary.
The RSA has been mowed and staff has added the area to the regular maintenance schedule.
Vehicle control: No vehicle or pedestrian deviations have been reported in the last year. Continue
working with tenants on driver traimig and defining the aircraft movement area. Be sure that
airport and FAA personnel are aware of the prohibition on vehicles in the RSAs during aircraft
operations.
Staff will continue to stress the importance ofpreventing aircraft movement area incursions,
Aircraft Rescue and Firefighting: The response trial met all requirements for the alarm system,
route taken, radio communication, and agent discharge. Some time could be gained by better
dress-out procedures - 30 seconds from alarm to vehicle movement is a common capability. The
station is well equipped and firefighters are knowledgeable about their responsibilities and the
vehicle.
Because of the change in certification status on year ago, we urged city fire department personnel
to continue the ARFF training program that resulted in so may gains in capability over the years
that this airport had scheduled service. Charters are still expected; use these as an opportunity for
firefighters to continue aircraft and airport familiarization tramimig while these aircraft are on the
airport. They should also drive the runways and taxiways on a regular basis to insure they know
the airfield status and construction areas that might affect an emergency response.
Staff will continue to work with the Fayetteville Fire Department and will pass on these
comments.
Wildlife Hazards: A few attractants remain on the airport, including the re-routed creek on the
south side. It is very difficult to maintain or clear this creek bed of vegetation due to the rip-rap
used to deter erosion. Standing water encourages vegetation growth, fish, reptiles, and other
wildlife. One deer was seen on the airport during the night fighting inspection inside the property
boundary but outside the perimeter fence. Implement the recommendations made by the USDA
wildlife biologist during a recent visit.
Staff will add the clearing of vegetationfrom the creek to their regular maintenance schedule
with work to be performed in the channel twice yearly - once in the spring and once in the fall.
A program is already in place to clear underbrushfrom adjacent parcels to discourage wildlife
habitat close to the airport. Mowing of the south RSA will also operate to discourage wildlife,
especially birdsfrom congregating there.
Obstructions: We reviewed the 1996 Obstruction Chart and could verify that some stands of tees
in the Runway 34 approach have been removed. The NOS survey and the recent contractor
report should provide enough detailed information for the FAA to determine if instrument
approach nuinina can be reduced; please continue coordination with the Flight Procedures Office.
Staff will continue to work on the resolution of the lowering of the minimafor Runway 16
Aimort Certification Specifications: Revisions are to be submitted as agreed during the inspection,
including an improved Sign Plan (larger scale) and a more readable Exhibit depicting the aircraft
movement area in the Letter of Agreement with the Control Tower.

not change any runway categories affecting obstruction criteria, right, or marking.

constructed from field staked control points and verified upon completion of the
construction.

9 . Safety Ameas . Safety areas are designated areas abutting the
edges of a runway or taxiway and are intended to reduce the risk of
damage to an aircraft inadvertently leaving the runway or taxiway .
Runway and taxiway safety areas available for air carrier use shall
be maintained as follows :
a . Each safety area shall be cleared and graded , and shall
have no potentially hazardous ruts , humps , depressions , or
other surface variations .
b . Each safety area is drained by storm sewers to prevent
water accumulation .
C . Each safety area is capable under dry conditions of
supporting snow removal equipment , aircraft rescue and
firefighting equipment , and supporting the occasional passage
of aircraft without causing major damage to the aircraft .
d . No objects are located in any safety area , except for
objects that need to be located in a safety area because of
their function . These objects are constructed , to the extent
practical , on frangible-mounted structures of the lowest
practical height with the frangible point no higher than 3
inches above grade . Nonfrangible objects within the safety

Taxiway marking Yellow centerline and holding position
markings are at least six inches wide on all taxiways . Yellow
exit lines from the runways are in place on all taxiways and
double yellow edge marking is in place where appropriate .
There are no displaced or relocated thresholds .
b . The Fayetteville Municipal Airport is responsible for
movement area marking maintenance . Striping is contracted on
an as needed basis and is inspected by Airport Management for
conformance to the above listed requirements .
C . Guidance Signs - The sign system meets FAA standards
described in A . C . 150 / 5340 - 18C and 150 / 5340 - 44E , ( see Exhibit
H ) . The sign system consists of lighted runway holding
position signs at all taxiway- runway intersections . These
holding position signs are lettered in white on a red
background mounted frangible .
Lighted taxiway location signs are sited at the initiation and
intersection points on Alpha , Bravo , Charlie , Delta , Echo , and
Foxtrot . These Signs are lettered in yellow on black
backgrounds . Lighted taxiway direction / runway exit signs are
lettered in black on yellow background .
Lighted distance remaining signs are installed on the east side
of the runway . These signs are lettered in white on black
backgrounds . They are doubled sided to enumerate the correct
distance for each runway and are frangible mounted .
e . Lighting - The Airport owns and operates a 36 " rotating
beacon . The colored panels alternate a white and green light .

a family illness to which I must devote my full time and efforts .
It has been an honor to serve on the Airport Board over the last ten
years . I will continue in whatever capacity I can to help Drake
Field become an excellent general aviation airport . Drake Field is
where I received my private license from Ray Ellis back in the 50 ' s
under the University Pilot Training Program .

SUBJECT: Ozark Charter and Tours Lease for Terminal Space
Attached is a draft lease between the Airport and Ozark Charter and Tours of Fort Smith.
Arkansas. The owner of the business is John Mankin. Ozark Charter and Tours proposes to
lease 156 square feet of terminal space for the purpose of operating tour buses. They will station
two employees in Fayetteville and additionally will have bus drivers who will operate the tour
buses. Currently, the major contracts that the operators have are with the University of Arkansas,
and they are contacting other schools which play the University of Arkansas teams in an effort to
direct air traffic to Drake Field with direct bus connections to the University.
As stated, the company is currently based in Fort Smith. Another one of their customers is the
US Forest Service, so having the transport company available in Fayetteville may be a plus in
helping us to land the Air Tanker Firefighting Facility.
Terms of the Lease:
Rent at $ 11 .00 per square foot for 156 square feet yielding $ 1 ,716 annual revenue.
Lease term of one year with four additional options. Options carry the ability for the Airport to
increase rent by no more than 5% per year.
Operators plan to base three buses at the Airport, and the bus parking at the south end of the
terminal area is the designated area for bus parking.
Action Requested: Airport Board is requested to recommend the attached lease for approval by
the Mayor.

LEASE AGREEMENT
This LEASE is executed this day of., 20_, by and between the
City of Fayetteville, Arkansas, 113 W. Mountain St., Fayetteville, AR, 72701 , hereinafter called
"Lessor" and Ozark Charter and Tours of 7517 South Zero, Fort Smith, Arkansas 72903 hereiriafter
called "Lessee".
1 . Leased Premises. Lessor leases to Lessee, and Lessee leases from Lessor, the property at 4500 S.
School Avenue, Fayetteville, Arkansas, as reflected on Exhibit "A" attached hereto and made a part
hereof Leased Premise shall be for Lessee's exclusive use. Bus parking shall be as depicted on Exhibit
"B", attached hereto and made a part hereof. The Leased Premises shall be used only for the purpose
of a sales office for bus charter and no other services shall be offered without prior approval of Lessor.
2. Lease Term. The term of this Lease shall be:
A. Initial Term. A period of one ( 1 ) year commencing on the date of this Lease, and expi mig at
midnight unless otherwise terminated, canceled or extended.
B. Option to Extend. Lessee shall have the option to extend the Lease Term for four (4) consecutive
one ( 1 ) year terms, provided:
( 1) Lessee has complied with and performed all conditions, covenants, and terms of this Lease
without any uncorrected defaults if known to Lessee, or any defaults that are not otherwise in the
process of being resolved.
(2) Notice of Lessee's intent to renew has been made in writing to Lessor at least thirty (30)
days prior to the expiration of the term.
3. RentAmount. During the imitial term of this Lease, Lessee agrees to pay Lessor for the use of the
Leased Prentises, facilities, rights, and privileges granted hereunder the sum of $ 1 ,716.00 for
two offices located within the terminal building at 4500 S. School, Fayetteville, Arkansas, totaling 156
sq. ft. at a rental rate of$ 11 .00 per sq. ft. Should the lease term begin on a day other than the first day
of a calendar month, or should the Lease end on a day other than the last day of calendar month, such
partial month lease payment shall be a prorated share of the monthly lease payment. The entire lease
payment is due and payable upon execution of this Lease. If the option to extend is utilized, rental
amounts may increase no more than 5% per annurn.
4. Independent Contractor. This Lease shall not be deemed or construed to create any relationship or
joint venture or partnership between the parties, to give the Lessor any interest in the business of Lessee,
or to grant to Lessee any powers as an agent or representative or the City or Airport for any purpose
or to bind the City or the Airport. Lessee shall be an independent contractor owning and operating its
business as herein described.
5. Use of Airport. Lessee is granted the use, in common with other airport terminal tenents, of the
airport terminal building and grounds landside of the airstrip, together with all facilities, equipment,
improvements, and services which have been or may hereafter be provided. Lessee agrees to observe
and obey all ordinances, rules and regulations promulgated by Lessor with respect to use of the Leased
Premises in a manner consistent with the rulings of the Federal Aviation Administration. Lessee agrees
to use the premises only for a sales office and staging area for their passengers, and materials and
equipment necessary related to the operation of a bus charter and that no vehicles, equipment or
supplies shall be stored on the premises unless expressly agreed to by Lessor. Lessee further agrees not
to store any flammable material on the premises or in any way endanger or violate the provisions of
Lessor's property insurance policy or the requirement of same. Such violations shall constitute a
material breach of this Lease. Upon termination of Lease, Lessee will leave all premises used in like
condition.
6. Rights of Inizress and Epress. Lessee shall have full and free right of ingress to and egress from the
Leased Premises for Lessee, its employees, customers, passengers, guests, and other invitees except as
reserved below. Such rights shall also extend to persons or organizations supplying materials or
furnishing services to Lessee. Lessor reserves the right to close any means of ingress and egress, so long
as other reasonable means of ingress and egress to the Leased Premises are available to Lessee. Lessor
may enter the Leased Premises at any reasonable time for any purpose necessary or incidental to the
performance of the Lessor's obligations hereunder.
7. Utilities, Maintenance and Janitorial Services
A. By Lessor: Lessor shall be responsible for the payment of the utilities associated with lights, heating
and cooling . Lessor shall maintain and keep in good repair so much of the Airport premises as is not
under the exclusive control of individual lessees. Lessor shall provide janitorial services for all areas
used in common by Airport terminal tenants. The Lessor shall not be responsible for, or pay for any
expense which might arise due to, the installation and/or removal of antennas, towers, or signs.
B. By Lessee: Lessee shall be responsible for the installation, relocation, modification and maintenance
of all utility services other than that necessary to provide tight, heat or air to the Leased Premises. Lessee
shall maintain Leased Premises in a clean and attractive condition; not allow the accumulation of
rubbish, trash, or other waste material on the Leased Premises and provide for and supply a janitorial
service for their exclusive use area. Lessee shall place any materials or trash in proper trash receptacles.
Written approval from the Airport Manager must be obtained prior to any improvements or additions
to any part of the Leased Premises, or the installation of any attachment to the budding (i.e. antennas,
towers or signs) on the budding. Any signs installed shall meet all City of Fayetteville Sign Regulations,
and furthermore, any sign erected on or attached to the Leased Premises must have the prior written

approval of the Lessor.
8. Insurance Requirements
A. By Lessor: If the Leased Premises are partially damaged by fire or other casualty which is not due
to the negligence or fault of the Lessee, said premises shall be repaired with due diligence by Lessor at
Lessor's expense, up to the limit of insurance on the structure. If the damage is so extensive as to render
such building untenable, the rent payable hereunder shall be proportionally paid up to the time of such
damage and shall thenceforth cease until such time as the premises shall be fidly restored. If the Leased
Premises are completely destroyed, Lessor may reconstruct the facility at the Lessor's own cost and the
rent payable hereunder shall be adjusted as set forth above, or Lessor may, at its option, cancel this
Lease, such cancellation to be effective as of the date the budding was destroyed, and the rent adjusted
as set forth above.
B. By Lessee: Lessee shall provide the following:
( 1 ). Workman's Compensation Insurance, as required by Arkansas Law.
(2). Insurance on the contents within the offices at all times during the term hereof, in amounts
approved by the Airport Manager.
(3). A Certificate of Insurance shall be fitmished to the Lessor, naming the Fayetteville
Municipal Airport as additional insured. The Lessee shall indemnify, protect, defend and hold completely
harmless, the Lessor and their trustees from and against all liability, losses, suits, claim judgements, fines
or demands arising from mijury or death of any person or damage to any property, including all
reasonable costs for investigation and defense thereof (including attorney fees, court costs, and expert
fees), of any nature whatsoever arising out of or incident to this Lease, Lessee's use or occupancy of
the Airport premises, the rights, licenses, or privileges granted Lessee herein, or the acts or ornissions
of Lessee's officers, agents, employees, regardless of where the injury, death or damage may occur. The
Lessor shall give notice to Lessee of any such liability, loss, suit, claim or demand, and Lessee shall
defend same using counsel reasonably acceptable to the Lessor. No word, sentence, paragraph or phrase
shall be construed to waive that tort immunity as set forth under Arkansas Law.
9. Hazardous Substances. Lessee shall not cause or permit any Hazadous Substance to be used,
stored, generated or disposed of on or in the Leased Premises, or in any Airport drainage system without
first obtamimig the Airport Manager's written consent. If the Airport property becomes contaminated
in any manner due to Lessee's actions, Lessee shall indemnify and hold Harmless the Airport fi7om any
and all claims, including a decrease in value of the Airport property. This inderm-iffication includes,
without Iffinitation, any and all costs incurred because of any investigation of the Airport or any remedial
actions mandated by a federal, state or local agency. If Lessee or its agents has caused the Airport
property to become contaminated, Lessee shall promptly, at its sole expense, after obtaining approval
from the Airport, take any and all necessary actions to return the contaminated premises to the condition
existing prior to the presence of any such Hazardous Substance. Hazardous Substances include but are
not restricted to asbestos, polychlorobiphenyls (PCBs"), and petroleum and petroleum related products.

10. Events of Default. The following shall be events of default under the Lease, and include any one
or more of the following:
A. Non payment of the rental amount.
B. If Lessee transfers, subleases or assigns, either voluntarily or by operation of law, any portion of its
interest in this Lease.
C. Lessee voluntarily abandons, deserts, or vacates the Leased Premises.
D. Lessee shall fad to comply with insurance requirements.
11 . Termination.
A. Lessor or lessee may terminate this lease at any time by giving the other party thirty (30) days written
notice of termination.
B. On the expiration or other termination of this Lease, Lessee's right to use the Leased Premises shall
cease, and Lessee shall vacate the premises without unreasonable delay. All property installed, erected,
or placed by Lessee in, on, or about the premises leased hereunder shall be deemed to be personalty and
shall remain the property of Lessee. Lessee shall have the right at any time during the term of this Lease,
or any renewal or extension hereof, and for an additional period of fourteen ( 14) days after the
expiration or other termination of this Lease, to remove any or all of such property, subject, however
to Lessee's obligation to repair all damage, if any, resulting fi7om such removal. Any and all property
not removed by Lessee prior to the expiration of the aforesaid fourteen ( 14) day period shall thereupon
become a part of the premises on which it is located and title hereto shall thereupon vest in Lessor or
Lessor may require removal and restoration by Lessee.
12. Assigning, Subletting and Encumberin . Lessee shall not sublet the Leased Premises, nor permit
other persons to occupy the Leased Premises, nor grant any license or concession for any part of the
Leased Premises, or assign its rights under this Lease without the written consent of Lessor. No such
subletting or assignment shall release Lessee fi7om its obligations to pay the rental set forth herein.
13. Mailing and Notice. Any notice or consent required by this Lease shall be sufficient if sent by
Certified Mail, return receipt requested, postage paid, to the following address:

14. Governmental Requirements
A. Governmental Requirements - General. Lessee shall comply with all Governmental Requirements
applicable to Lessee's use and operation of the Leased Premises. Without limiting the generality of the
foregoing, Lessee shall at all times use and occupy the Airport in strict accordance with all laws, rules,

regulations, mi 'mum standards, and security plans that may be imposed by the FAA, the Airport, the
state, federal or city government with respect to the Airport and operations thereof, including but not
limited to procuring all licenses, franchises, certificates, permits, and authorizations necessary to conduct
business.
B. No Liability for Exercise of Powers. The Lessor shall not be liable to Lessee for any dmi *motion or
deprivation of its rights which may result from the proper exercise of any power reserved to the Lessor
in this Lease or by reason of governmental requirements; Lessee shall not be entitled to terminate this
Lease by reason thereof, unless the exercise of such power shall interfere with Lessee's rights hereunder
so as to constitute a termination of this Lease by operation of law.
C. Nondiscrimination. Lessee agrees that it will not, on the grounds of race, color, or national origin,
discriminate or permit discrimination agamst any person or group of persons. Lessee will assure
compliance with all regulations in regard to Non-discrimination and Affirmative Action. The Lessee
acknowledges that it is the policy of the Fayetteville Municipal Airport that it shall not discriminate on
the basis of race, color, notional origin, or sex in the award and performance of all Airport contracts.
15. -Miscellaneous
A. Severability. In the event any provision of this Lease is held invalid or unenforceable by any court
ofcompetentjurisdiction, the remainder of the Lease shall remain valid and enforceable, unless the rights
of either party as set forth are materiaBy affected by the court order.
B. Entire Lease� Modification. This Lease expresses the entire understanding of the Lessor and Lessee
concerning the Leased Premises. This Lease may be modified only by a written Lease of subsequent
date hereto signed by the Lessor and Lessee.
C. Non-Waiver. Neither the waiver nor any forbearance of remedy by the Lessor of any breach of
Lessee of any provision hereof shall operate as a waiver for any other breach by Lessee.
D. Choice of Law. This Lease shall be construed and enforced in accordance with the laws of the State
of Arkansas.
E. Force Maieure. Neither the Lessor nor Lessee shall be deemed in violation of this Lease if it is
prevented from performing any of the obligations hereunder by reason of embargoes, shortages of
material, acts of God, acts of the public enemy, acts of superior governmental authority, weather
conditions, floods, riots, rebellions, sabotage, or any other circumstances for which it is not responsible
or which are not within its control, and the time for performance automatically shall be extended by the
period the party is prevented from performing its obligations hereunder.
F. Bindinp, Effect. This Lease shall be to the benefit of and shall be binding upon the Lessor, Lessee
and their respective successors and assignees, if such assignment shall have been made in conformity
with the provisions of this Lease.

SUBJECT: Lease with the Air Museum
During the budget process, we were determining how much to budget for the Air Museum, and it
came to my attention that the current lease with the Air Museum does not accurately reflect the
current set of operating conditions. The lease as currently drafted contains the following:
1 . Lease is a 30 year agreement with the second option for 10 years ( 1997-2007) having been
executed.
2. Air Museum is to pay $ 1 .00/ year to Airport for Leased Premises
3. Air Museum is responsible to "make all necessary exterior and mechanical repair at Le&see's
expense" Airport paid for first two years, then Air Museum was to take over these expenses.
Airport continues to carry the costs for exterior and mechanical repairs.
4. For the first six months, Airport was to pay utilities; then, Air Museum was to pay all water,
sewer, sanitation, electricity and natural gas expenses. Airport pays all utility expenses with the
exception of telephone.
In the agenda is a budget performance report. The report dated 10/23/00 shows that for the year
2000, the Air Museum was budgeted in the amount of$3,000. The report also shows that as of
October, $6,221 .62 had been spent on the Air Museum. Also attached is a report showing a
break-out of the 1999 expenses. The Airport is paying the utilities as well as the maintenance for
the Air Museum. Expenses for the year 2000 are expected to be in the same range as those for
FY 1999 with the exception of a large repair bill for the sprinkler system (estimated $50,000).
Action Requested: Review of the lease with the Air Museum with a view toward recommending
changes to reflect current operating conditions. Any changes in the lease will have to be
presented to the City Council for adoption and approval. Staff specifically requests that the
Board address the question of whether the Airport staff should adhere to the budgeted amount for
expenditures for the Air Museum (Le. consider the budgeted amount a maximum not to be
exceeded).
Staff Recommendation: Staff has included $ 10,000 in the Airport Budget for the Air Museum
for FY 2001 , and that amount is subject to approval as a part of the City's budget process. Staff
requests that the Airport Board approve changes to lease to indicate their present level of support.
Staff suggests that the Airport Board extend their philanthropy to the Museum through the
second term, but allow the original terms of the lease to prcvail for the third term (the period
2007-2017).
