Subsequent to the August 30, 2000 meeting which I attended with Dale Frederick in Ft. Worth
with Don Harris, FAA Ft. Worth, Ed Agnew, FAA ft. Worth and Charlie Kettler, FAA ft. Wortk
Fayetteville Drake Field was visited by Don Harris for the Airport Board Meeting of September 7.
2000. While Don Harris was here, we reviewed the data which is available regarding
obstructions. The following Monday I sent the attached letter and information. I sent copies of
the information to Dean Alexander.
Don Harris has requested that all contact on this project be directed through him. I tried today to
reach him and I understand that he is out until October 10. Contrary to my instructions from him,
I tried also to reach Charlie Kettler and was told that he is also out until October 10. 1 then, on
October 3, placed a call to Dean Alexander and received his voice mail.
Action Requested: Airport Board is requested to pass a resolution directing staff to write
* formal letter requesting a resolution to the continuing question of whether the FAA will grant
* 3/4 mile mm' u* num for the Runway 16 Approach and/or prescribing remedial actions which
would make the granting of same feasible.

Dear Mr. Harris:
Greetings from Fayetteville, Arkansas. We enjoyed visiting with you last week, especially your
spending time with us at the Airport Board meeting and on the field reviewing current and future
projects.
One of the items I promised to forward to you was data on the existing obstructions which remain
in the Runway 16 approach. The best source of data is a Runway Approach Obstruction
Location Study conducted for Drake Field by Garver Engineers and completed in April, 1999. 1
have attached two copies of the data for Runway 16, including the latitude/longitude information.
This data represents the existing condition at Drake Field. We do not have a profile view which
can be used to compare to the data to the Airport Layout Plan; however for ease of interpretation,
I will prepare the profile view and forward it to you. I plan to forward the profile view by the end
of the week (September 15, 2000).
1 trust this information will provide the data necessary for a determination by the FAA as to
whether the approach mmunums can be lowered from the current one mile visibility down to 3/4
mile visibility. Please let me know if there is any additional information (beside the profile view)
which would help in expediting your review. We are available to finmish additional information or
data and will gladly assist you in obtamimig a complete data picture. Please contact me if I can

SUBJECT: Amendment to Minimum Standards
At the September Board Meeting, it was discussed that there was a need to review the minimum
standards with a view towards allowing more flexibility in insurance amounts as some tenants
were not meeting the requirements in their strictest sense. The Board leaned toward granting the
Airport Manager this authority and the Mlimum Standards have been revised accordingly.
Action Requested: Airport Board is requested to pass a resolution amending the nuinninum
standards to allow the Airport Manager to revise required insurance amounts after first contacting
an insurance professional.
Staff Recommendation: Approval of the Resolution stated above.

Fire Department or the Airport Staff and as required by FAR 139.
8) Shall provide for the adequate and sanitary handling and disposal, in
accordance with State and Federal standards, away from the Airport, of all
trash, waste, and other materials, including but not limited to used oils,
solvents and other waste materials. The piling or storage of crates, boxes,
barrels, and other containers will not be permitted within the leased premises.
9) The operator must provide all security items required by Part 107 of the
Federal Air Regulations and the Airport Security Plan.
SECTION 9, Item B: MULTIPLE SERVICE PROVI DERS/COMBI NATION ACTIVITIES
At least one fixed base operator at Fayetteville Municipal Airport shall perform the services
and meet the requirements prescribed by the following sections:
ITEM A. Fuel and oil sales;
ITEM C . Aircraft charter and taxi service;
ITEM D. Aircraft engine, airframe and accessory sales and
maintenance;
ITEM E. Aircraft rental and sales; and
ITEM F. Flight training .
This is not to be construed as an exclusive right. No person shall be prohibited from the
service and maintenance of his or her own aircraft and equipment, as long as this service
or maintenance complies with all regulations set forth in this document and the applicable
State, Local and Federal regulations.
Said Fixed Base Operator shall abide by all rules, regulations and operating practices set
forth by these Standards, and all City, State and Federal regulations incorporated by
reference herein and all specific terms as provided in their Lease agreement.
Insurance minimums for a Fixed Base Operation shall be set at $2,000,000 Hangar Keepers
Liability and Public Liability Insurance, with the City of Fayetteville listed as an additional

SECTION 9, Item C: AIRCRAFT CHARTER AND TAXI SERVICE
Persons operating aircraft charter and taxi service shall provide:
1 ) Passenger lounge, rest room and telephone facilities.
2) Adequate table, desk or counter for checking in passengers, handling
ticketing or fare collection, and the proper handling of luggage.
3) Shall have available properly certificated suitable aircraft with properly
certificated and qualified operating crew, one of said crew shall be located at
the Airport and on an "on call" basis as may be necessary for on demand
charter.
4) Insurance coverage shall be required in the following amounts or in amounts
as may be considered reasonable by the airport manager who shall be
required to consult with an insurance professional prior to adjusting any

SECTION 9. Item E : AIRCRAFT ENGINE, AIRFRAME ,
ACCESSORY SALES AND MAINTENANCE
All persons operating aircraft engine, airframe and accessory maintenance facilities to the
public for hire shall provide:
1 ) In case of airframe or engine repairs, sufficient hangar space to house any
aircraft upon which such service is being performed .
2) Suitable inside and outside storage space for aircraft awaiting repair or
maintenance or delivery after repair and maintenance have been completed .
3) Adequate shop space to house the equipment and machine tools, jacks, lifts
and testing equipment to perform top overhauls as required for FAA
certification and repair of parts not needing replacement on all single engine
land and light multi-engine land general aviation aircraft.
4) At least one FAA certified air frame and power plant mechanic available
during eight hours of the day, five days per week and on an "on call" basis as
needed .

5) Facilities for washing, cleaning, and waxing aircraft if operator engages in
said business.
6) Suitable equipment (i .e. tractors, tow bars, jacks, dollies, and other equipment
as might be needed to remove the largest type of aircraft that normally could
be expected) to promptly remove from the landing area any disabled aircraft
as soon as permitted .
7) All current licenses and certificates issued by the F.A.A. for use in this
particular operation shall be kept current at all times by the operator until such
time as the operator's permit is relinquished or canceled .
8) Insurance coverage shall be required in the following amounts or in
amounts as may be considered reasonable by the airport manager who

SECTION 9 . Item F: FLIGHT TRAINING
All persons conducting flight training activities shall provide:
I All required F.A.A. certifications and licenses as appropriate for the training
which is proposed, i .e. single-engine, multi-engine, instrument rating, private
license or commercial license.
All current licenses and certificates issued by the F.A.A. for use in this
particular operation shall be kept current at all times by the operator until
such time as the operator's permit is relinquished or canceled .
2) A listing of the types of aircraft as may be required to give flight instruction.

3) Adequate office and classroom space for at least five students and proper rest
room facilities.
4) Adequate mock-ups, pictures, slides, film strips or other visual aids necessary
to provide proper ground school instruction, (instruction which will allow for
passing the written portion of airman training) .
5) Insurance coverage shall be required in the following amounts or in amounts
as may be considered reasonable by the airport manager who shall be
required to consult with an insurance professional prior to adjusting any
amount: bused o. a cuse by case revievy of proposed adivity .

SECTION 9 . Item G: CROP DUSTING AND SPRAYING
Persons seeking to conduct crop dusting or spraying of agricultural chemicals shall be
permitted to refuel planes at Fayetteville Municipal Airport, however, storage or transfer of
agricultural chemicals at the Airport is prohibited due to lack of adequate facilities which
meet EPA standards.
SECTION 9 . Item H : AVIONICS SALES AND MAINTENANCE
All persons conducting maintenance and sales of avionics equipment shall provide:
1 Suitable office space for operating and conducting sales and/or maintenance
and the keeping of proper records in connection therewith.

2) Adequate facilities for servicing, repairing and sales of avionics equipment or
satisfactory arrangements with other operators licensed by the Airport/Moyor
on the Airport for such service, sales and repairs.
3) There shall be available, at least during eight hours of the working day, a
properly certificated service person capable of demonstrating equipment for
sale to the public and for repairing or servicing of avionics equipment.
4) The minimum stock of readily expendable spare parts, or adequate
arrangements for securing spare parts within a reasonable time, required for
the types of avionics supplied and sold.
5) Current up-to-date specifications and price lists for types and models of
avionics supplied, sold , or repaired .
6) Proper check lists and operating manuals on all radio/novigafional equipment
sold or repaired and adequate parts catalogued and stocked .
7) Any signs to be placed on Airport property shall be in compliance with all City
of Fayetteville codes and ordinances and then be approved by Airport
Management.
8) Insurance coverage shall be required in the following amounts or in amounts
as may be considered reasonable by the airport manager who shall be
required to consult with an insurance professional prior to adjusting any
amount:

2) All utilities are to be paid directly by the operator.
3) All building maintenance on Airport owned facilities is borne by the operator
except structural repairs or repairs which are enumerated in individual lease
agreements. Building maintenance on individually owned facilities shall be
borne by the owner or operator.
4) Any improvements made to the leased premises, must first be approved by the
Airport Manager and become the property of the Airport, unless otherwise
specified, upon completion but must be maintained by the Operator.
5) Maintenance of the leased area shall be that of the operator. A certain
amount of adjoining land is required to be leased as per plat drawings to be
provided .
6) Maintenance of pavements constructed by the Airport will be maintained by
the Airport. All others will be maintained by the operator.
7) All sublease agreements or assignments must receive prior written approval
of the City Council .
8) Lessee and Sublessee shall each be required to carry public liability insurance
as well as Hangar Keeper liability (or general liability if applicable) insurance,
and provide certificates of such insurance to the City. Such certificates shall
reflect the City as additional insured . Such public liability insurance shall be
in amounts not less than $ 100,000 per person bodily injury and $300,000
per accident property or in amounts as may be considered reasonable by
the airport manager who shall be required to consult with an insurance
professional prior to adjusting any amount. Such Hangar Keeper or general
liability insurance shall be of sufficient amount to cover the largest aircraft
expected to be serviced .
9) Operators, in their operation and use of the Airport, will not, on grounds of
race, sex, color, or national origin, discriminate, or permit discrimination
against any person or group of persons in any manner prohibited by the
Federal Aviation Regulations or any other low.

Contact with the US Forest Service in August, September and October has yielded no definite
information on their plans for constructing/acquirmig an Air Tanker Base. It is understood that

Action Requested: Approval of Fayetteville Fire Department Request to consider the present
ARFF Station as Phase One of the Fayetteville Fire Tramimig Center.
Staff Recommendation: Approval of the request with the provision that the Fayetteville Fire
Department shall make every effort to accomodate the needs of the US Forest Service, provided
the US Forest Service offers monetary compensation for use of the facility.

SUBJECT: Lease of Airport Property for Fayetteville Fire Department Training Station
A request has been received from the Fayetteville Fire Chief to designate the present ARFF
Station as the Fayetteville Fire Department Training Center (Memo Attached). The request states
that the Fire Department recognizes that the ARFF and its equipment was purchased with Federal
Funds and that ownership is vested with the Fayetteville Municipal Airport; however, the request
contains a request that the Fire Department have primary control over the station prior to the Fire
Department investing additional fimds in developing the fitcility . An airport layout plan with a
sketch of expansion area shown in yellow is attached as well as some information on the
additional facilities the Fire Department would like to construct.
This request was precipitated by marketing efforts which drew a federal agency to review our
facilities at Drake Field. It is our understanding that Fayetteville is under consideration for the
location of their fitcflity; however this process is in its infimcy. For example, it is not known
whether the federal agency would prefer to locate in the existing facility or to build one of their
own. It is known that a similar facility required the investment of about S4 million of US
taxpayer's money. A preliminary proposal has gone out to agency, and in the proposal, estimated
(incentive) first year revenues in excess of$25,000 would be expected.
Discussions about the use of the ARFF Station have been ongoing throughout the transition
period of commercial air service leaving Drake Field. Minutes from the Airport Meeting of June,
1999 and October, 1999 contain references to the ARFF Statiom Subsequent to the October _
meeting, the ARFF station was decommissioned and a NOTAM was issued'that ARFF protection
required 24 hour notice.
Action Requested: A request has been received from the Fayetteville Fire Chief to designate the
present ARFF Station as the Fayetteville Fire Department Training Center. The Airport Board
will make a recommendation for consideration by Mayor Fred Hanna. It is not known at this time
0 whether the Mayor will forward this item to the City Council for finther input.
Staff Recommendation: Staff recommends balancing the needs of the Fayetteville Fire
Department which has a specially trained ARFF team for Airport duty with the ability of the
Airport to generate revenue from a group which may be able to share the facility. In order to
accomplish this recommendation, staff believes that the most prudent action would be to delay
making a recommendation on the request until October when information about use of the fficility
by the federal agency should be more firm. It is not possible to determine the best course
of action with the current outstanding issues and lack of data. This delay should not be an
extreme inconvenience to the Fire Department as their anticipated ftinding occurs in 2004, well
after we would expect to have firmer information from the federal agency.
Items which could be resolved include:
Control of the facility - who will be responsible for scheduling events and notification of airport
staff and tower of same.
Specifics about the request - agreement that the height of tower will not exceed 34', amount of
land to be conunitted, public involvement in the development of the facility, etc.

The Fayetteville Fire Department TraiBiny Cente
Since shortly after the Fire Department occupied the new fire station at the airport ffire
Station #Y), we began working on plans for this to be our future Department Training Center.
The location was good, in the City, but still removed from developed areas where training
activities could be carried on without disnipting or being disrupted by other aviation. After
moving out of Station 3 upon loss of commercial air service by the airport, we continued (and in
fact, stepped up somewhat) those plans.
The� airport fire station is a rather ideal place for our training center to be developed. In
fact, the station itself, with its classroom, office facilities, apparatus bay, and livirig space is so
conducive to what we want to do, we have informally dubbed it as 'Thase On&" of the planned
center. Our five year capital improvement program budget contain fanding to develop phase two
in 2004 (currently $378,000). Phase two would most likely consist of extension of the water main
and installation of one or two additional fire hydrants, construction of a four or five story drill
tower, construction of a concrete burn building, and development of an applicant agility test
facility if the flinding would go that far. Later phases would include a drafting pit for testing
pumpers, possibly a bum pit, confined space rescue scenario fitcilities, HazMat scenario fiLcilities,
and others as would be identified by our rapidly changing field.
Recent discussions have indicated there is something of an "ownership" issue related to
the fire station and surrounding property which could present a major obstacle to our plans. Alett
Little presents a convincing argument that the airport is the owner of everything on it and may
have other plans for some of the property we planned to develop into the training center,
We both believe that agreements could be worked out for another agency to use "our"
facilities on the airport but of course, the Fire Department would be reluctant to invest large sums
of money to develop the center without some assurance that we would maintain control over who
uses it and how it get used. We seek that assurance from you at this time. Though I'm not sure
of the best way to accomplish what we need, it's clear that we need come kind of commitment or
assurance that we would have significant "say" about any use of the current fire station or any

fiAure facilities we might develop on the airport. It is not our intention to eliminate airport
management from having a say into this also. We're not asking for exclusive power here, just the
right to maintain primary control over our investment.
I might add in closing that our Department is using the station currently for frequent
fire/rescue training classes and for ARFF review training for our ARFF Team members. The
Fayetteville Police Department is also using it for various training functions, as is Central EMS.
There is an EMT school going on there now on Tuesday and Thursday evenings from 6 to 10
p.m. This course takes four to five months to complete. Every use of the facility by anyone,
however, is being coordinated by Terry Lawson, our Department Training Officer, whom I
consider to be 'in charge" of the facility. Our Department pays the utility bills for the station, and
operates and maintains the ARFF truck there. Perhaps from all these things we have incorrectly
assumed we had the ownership/occupancy rights we now pursue. Again, we're not seeking
exclusive power over the station, just an assurance that we can be in charge of it. Any help you
can give will be greatly appreciated. If you need anything finther from me on this, please do not

Terry Lawson and I will be at the August 3, Airport Board meeting to discuss this matter

department has not completed their final closing entries for the month of September and
considers releasing reports with information after August 31 , 2000, as premature. It has been
three months (an accounting quarter) since we issued financial reports to the Airport Board, so as
to address your request of quarterly reports, we are releasing reports but with information
available through August 31 , 2000.
The accounting department has provided airport staff with an approved government reporting
fonnat in which to present the financial information. Two important differences in this report
and our last report are the amounts of net loss and the loss in operations. This report deducts our
interest income and other income after depreciation instead of immediately from the total
operating expenses. If the interest income and other income are considered as operating, the total
deficit from operations would amount to $ 12,039.00 ($ 140,898 - 128,663 - 196 = 12,039) The
total net income on the new report reflects the cost of depreciation. When the total amount of
accumulated depreciation for this year ($658,773) is deducted from the total, an amount of net
loss would be $ 122, 120.00. This net loss does include the disbursements made for the cost for
our Capital Improvements Projects.

SUBJECT: Disadvantaged Business Enterprise (DBE) Program
As the airport's sponsor, the City of Fayetteville is obligated to comply with all Department of
Transportation(DOT)/Federal Aviation Administration (FAA) grant assurances including #37,
Disadvantaged Business Enterprise (DBE). Entities receiving development grants from
DOT/FAA must comply with all the assurances as the assurances are considered an integral part
of the grants. Under the DBE assurance "the recipient shall not discriminate on the basis of race,
color, national origin or sex in the award and performance of any DOT-assisted contract or in the
administration of its DBE program or the requirements of 49 CFR (Code of Federal Regulations)
Part 26." The DBE program 's objective is to remedy past and current discrimination against
disadvantaged business enterprises and provide a "level playing field" for these business
enterprises in competing for DOT-assisted contracts.
New rules and regulations concerning DBE participation were published in the Federal Register
on February 2, 1999. CFR 49 Part 26 replaced 40 CFR Part 23 published April 30, 1992. The
new regulations were in response to the Supreme Court's decision in the Adarand v Pena case of
1995 . Previous to this decision, DOT had set a 10 percent target goal for all contracts involving
DOT assistance which the court ruled as setting a quota. DOT was required to develop new rules
and regulations for DBE goal setting and to provide the grant recipients with the necessary
information to develop a program based on information available on DBE's in each recipient's
area.
Airport staff has worked closely with the FAA since July 1999 in developing this program and
goal. Our DBE goal was calculated at 1 . 12% which is very low, however, this goal is based on
the number of DBE's located in our area and the past participation of DBE's in our DOT-assisted
contracts. The reason for our low percentage is that very few certified DBE's live in our area and
most of our contracts have not been large enough to encourage DBE's to travel long distances to
participate in our projects.

The DBE goal will be reviewed and updated annually, but the DBE program will not change
unless new regulations are implemented or if the City of Fayetteville or the Fayetteville
Municipal Airport has a change in their policies which conflict with this program. Our previous
DBE program was approved by Resolution No. 81 -88 passed and approved on November 1,
1988.

corrections, and changes. Your overall DBE goal of 1 . 12 percent for Airport Improvement
Program (AIP) projects covers the period October 1 , 1999, through September 30, 2000.
You are not required to submit regular updates to your program as long as you remain in
compliance. However, if you do make significant changes to the program, please submit a
revised program to our office for review.
Since an annual review of your overall goal (FY 2001 ) was required on August 1 , 2000,
please submit an updated goal and methodology as soon as practicable if you have not already
done so. This submission should include steps I and 2; breakout of race-neutral and race-
conscious participation with a supporting rationale on how the breakout was derived; and
evidence of public participation. All of the above steps must be taken even if you determine

DBE Financial Institutions. (26.27)
The City of Fayetteville utilizes the publication, "Report ofthe Bank Commissioners of Arkansas," as a source of
financial institutions. This register is published yearly by the Off-ice of State Bank Department. The DBE Liaison
Officer will investigate the availability of any DBE Financial Institutions listed in [his register and recruit other
interested DBE financial institutions by running advertisements at least once a year in a statewide newspaper. The
Fayetteville Municipal Airport will use these mediums to initiate the investigation to the full extent of ser-vices
offered by financial institutions owned and controlled by socially and economically disadvantaged individuals in
our community and make reasonable efforts to use these institutions. We will also encourage prime contrac(ors to
use such institutions which we have identified.
To date we have identified no such institutions in our area, but will continue to search.

The Fayetteville Municipal Airpori-Drake Field will maintain and make available to interested persons a directory
identifying firms eligible to participate as DBEs in our program. The directory lists the firm's name. address. phone
number, and the types of work the firm has been certified to perform as a DBE. The directory will be revised in
least annually. The airport uses the Arkansas Highway Department's directory of certified DBEs as the airport 's
DBE directory. The directory will be available to contractors and the public on request and will be maintained at
the Fayetteville Municipal Airport-Drake Field located at 4500 S_ School Ave., Suite F, Fayetteville, AR 72701 or
by calling 501 -718-7640 ext. 5. Copies may also be obtained by calling the Arkansas State Highway and
Transportation Department at 501 -569-2259.
Required Contract Clauses. (26. 13, 2629)
Contract Assurance. (26.13)

The contractor or subcontractor shall not discriminate on the basis of race, color, national origin. or sex in
the performance ofthis contract. Me contractor shall carry out applicable requirements of49 CFR Part 20
in the award and administration of DOT assisted contracts. Failure by the contractor to carry oil( these

requirements is a material breach of this contract, which may result in the temimation of [his contract or
such other remedy as (he recipient deenis appropriate.
Prompt Pavoicrit. ( 26. 29)
The Fayetteville Municipal Airport-Drake Field will include the following clause in each DOT-assis(ed prime
Contract:
Tire prime contractor agrees to pay each subcontractor tinder this prime contract for satisfactory
performance of its contract no later than 30 days from the receipt ofeach payment the prime contractor
receives from the City of Fayetteville. The prime contractor agrees further to return retainagc payment it)
each subcontractor within 30 days after the subcontractor's work is satisfactorily completed. Any delay or
postponement of payment from the above referenced time frame may occur only for good cause following
written approval of the City of Fayetteville. This clause applies to both DBE and non-DBE subcontractors.
Before any written approval for delay or postponement for payment is issued, both tire prime contractor and (lie
subcontractor will be invited to discuss the disputed issues. The Airport will fully investigate our options with the
City of Fayetteville 's Legal Department and the Federal Aviation Administration in the most expeditious time
possible before written approval for delay or postponement of payment is given.
Sanctions for Noncompliance:
In the event of tire contractor's noncompliance with any terrins of a DOT-assisted prime contract, (he City
of Fayetteville shall impose such Contract sanctions as it or the Federal Aviation Administration may determine to
be appropriate, including, but not limited to:
(A. ) Withholding of payments to the Contractor under the Contract until the
Contractor complies, and/or
(B. ) Cancellation, termination, or suspension of the Contract in whole or in part.
Monitoring and Enforcement Mechanisms. (26.37)
The Disadvantaged Business Enterprise (DBF) program for the Fayetteville Municipal Airport-Drake Field will be
incorporated as part of the Specifications and Contract Documents on all DOT-assisted contracts. The inclusion of
this program in the Specifications and Contract Documents provides the same sanctions for noncompliance to the
DBE program as any other terim of any DOT-assisted contract.
Submission of a bid on any federally assisted work advertised by the airport will obligate the Contractor who
submitted the bid to use good faith efforts to meet the DBE goal published in the bid document. The Contractor will
be required to submit the names, addresses, telephone numbers, E[Ns (Employer Identification Number), DBE
Certification Numbers, the kind of work performed, and the amounts to be paid to all subcontractors participating as
DBEs in the project at the time of contract execution. If no DBE participation is expected in the contract, the
Contractor must submit proof at the time of contract execution of good faith efforts to obtain DBE participation.
The Fayetteville Municipal Airport-Drake Field will bring to the attention of the Department of Transportation any
false, fraudulent, or dishonest conduct in connection with the program which is evident to airport staff DOI' can at
their discretion take steps (c.g , referral to the Department of Justice for criminal prosecution, referral to the DOT

The City of Fayetteville 's overall goal for FY2000 is the following: 5% of the Federal financial assistance we will
expend in DOT-assisted contracts.
Method

code for the estimated project costs for the year.
2. The second factor used in the formula for calculating our base figure was derived as follows: the numerator is
the number of DBEs located in our four county area (Benton, Crawford, Madison, and Washington Counties) that
can perfionn the kinds of work needed which were identified front (lie Arkansas State Highway and "t-ransportation
DepartmeriCs directory for DBE. The denominator was derived using the number of individuals listed by the
Census Bureau 's County Business Pattern database on the Internet.
This calculation produced the relative-weighted availability ofDBE participation of .50 percent.
Adjusted Base Goal:
-Me airpon staffmade inquires at the Chamber ofConumerce and the Small Business Administration as to studies or
records maintained on DBEs. No records are assembled to represent this group as a minority. A data search of the
Census Bureau on the Internet revealed a minority population not including women in our four county area of
approximately 3 .07 percent in 1990. A review of our recent let contracts for 1997 through 1999 indicate that with
advertising outside of our immediate area, the airport can expect a participation of DBE activities as subcontractor�
at a rate of at least 1 .74 percent ( 1997 accomplishment = 3. 16%, 1998 accomplishment= 0. 1999 accomplishment
2.06 % equals a 1 .74% yearly average)(Attachment A15). The average percentage of our base goal and the average
ofour last three years accomplishments would indicate an achievable overall goal of 1 . 12% ((.005 +
.0 1 74 )/2 = 1 . 1 2 )�
After evaluating the above information, the City of Fayetteville[Fayetteville Municipal Airport's initial base rate
goal has been adjusted to 1 . 12% to reflect as accurately as possible the DBE participation the airport staff considers
obtainable.
Process
The Fayetteville Municipal Airport/Dralke Field will submit its overall goal to DOT on August I of each year
Before establishing the overall goal each year, the airport staff will review the Disadvantage Busincss Enterprise
Directory for changes in the number of available DBEs in our area. Staff will also review the contracts let for tile
previous year, contact other airports in our vicinity. and any other persons or groups who might have knowledge
concerning the availability of disadvantage and non-disadvaniaged businesses, [lie effects of disc rinii na tion oil
opportunities for DBEs, and the airports efforts to establish a level playing field for the participation of DBFs.
Following this process of determining our new goal, the airport staff will publish a notice of tile proposed overall
goal in a statewide newspaper, informing the public that tile proposed goal and its rationale are available for
inspection during normal business hours a( the airport office for 30 days following the date of the notice. and
informing the public that the airport and DOT will accept comments on the goals for 45 days from the date ofthe
notice. The notice will include addresses to which comments may be sell( and addresses where the proposal may be
reviewed. All comments will be reviewed by tile anpoi t staff-, and if cornments warrant, changes will be nladc to
the proposed goals.
The overall goal submission to DOT will include a summary of information and comments received during this
public participation process and the airport 's responses.
Ihe airport will begin using the overall goal on October I of each year, unless other instructions have been teceived
from DOT.
Breakout of Estimated Race-Neutral and Race-Conscious Participation
We estimate that, in meeting an overall goal of L 12%. we will obtain 0% from race-neutral participation and 1 . 12%
through race-conscious measures. Since the Fayetteville Municipal Airport has not been able to reach our overall
goals with race-neutral measures, we will continue to use contract goals in meeting our overall DBE goals.
All ofour DOT-assisted contracts for the Airport include tile requirement ofgood faith efforts to meet our goal for
DBE participation. Because of the few DBEs in the area, we receive very little response to the bids advertised and
let. We do require the engineers to include DBE language in both specifications and advertisements that they
initiate. We also place ads in newspapers encouraging DBE participation in our projects. I believe that the DBE
participation that we do receive usually is a result of our efforts, the engineers, and the contractors in recruiting
DBEs.
Contract Goals
The Fayetteville Municipal Airport-Drake Field will use contract goals to meet any portion of the overall goal the
airport does not project being able to meet using race-neutral means. Contract goals are established so that, over the
period to which the overall goal applies, they will cumulatively result in meeting any portion of our overall goal that
is not projected to be met though the use of race-neutral means.
The airport will establish contract goals only on those Dar-assisted contracts that have subcontracting possibilities.
We need not establish a contract goal on every such contract, and the size of contract goals will be adapted to the
circumstances of each such contract (e.g., type and location of work, availability of DBE 's to perform the particular
type of work ).
We will express our contract goals as a percentage of the Federal share of a DOT-assisted contract.

Good Faith Efforts. (26.53

The obligation offlic bidder/offeror is to make good faith efforts. The bidder/offeror can demonstrate that it has
done so either by meeting the contract goal or documenting good faith efforts.
The Airport's Financial Coordinator will be responsible for determining whether a bidder/offeror who has not met
the contract goal has documented sufficient good faith efforts to be regarded as responsible.
The DEB Liaison Officer will ensure that all information is complete and accurate and adequately documents the
bidder/offeror's good faith efforts before the City of Fayetteville/Fayetteville Municipal Airpori-Drake Field
commits to the performance of the contract by the bidder/offeror.
Administrative reconsideration
Within 5 days of being informed by The City of Fayetteville (hat it is not responsible because it has not docurrierned
sufficient good faith efforts, a bidder/offeror may request administrative reconsideration. Bidder/offerors must
make this request in writing to the following reconsideration officials: The Airport Board, 113 W. Mountain,
Fayetteville AR 72701 , phone number 501 - 718-7640 Ext. 5. The reconsideration officials will not have played any
role in the original determination that the bidder/offeror did not document sufficient good faith efforts.
As part ofthis reconsideration, the bidder/offeror will have the opportunity to provide written documentation or
argument concerning the issue of whether it met the goal or made adequate good faith efforts to do so. The
bidder/offeror will have the opportunity to meet in person with our reconsideration officials to discuss the issue of
whether it met the goal or made adequate good faith efforts to do so. We will send the bidder/offeror a written
decision on reconsideration, explaining the basis for finding that the bidder did or did not meet the goal or make
adequate good faith efforts to do so. The result of the reconsideration process is not administratively appealable to
the Department ofTransportation.
Good Faith Fffoils when a DBE is replaced on a contract.
We will icquire a contractor to make good findi efforts to replace a DBE that is terminated or has otherwise falled it)
complete its work on a contract with another certified DBE, to [lie extent needed to meet the contract goal We %vIII
require the prime contractor to notify the DBE Liaison Officer immediately of the DBE*s inability or unwillingness
to perform arid provide reasonable documentation .
In this situation, we will require the prime contractor to obtain our prior approval of the substitute DBE arid to
provide copies of new or amended subcontracts, or documentation of good faith efforts. If the contractor fails or
refuses to comply in the time specified, our contracting office will issue an order stopping all or part of payment
until satisfactory action has been taken.
Counting DBE Participation. (26.55 )
We will count DBE participation toward overall and contract goals as provided in 49 CFR 26.55.
Certification. (26.61 - 26.9 1 )
The Fayetteville Municipal Airpori will use the certification standards of Subpart D of part 26 and the certification
procedures Of Subpart E of part 26 to determine the eligibility of firms to participate as DBEs in DOT-assisted
contracts. To be certified as a DBE a firm must meet all certification eligibility standards. We will make our
certification decisions based on the facts as a whole.

The Arkansas Highway Department has certified all interested individuals who have inquired at the airport about
DBE certification (see attached agreement with the State attachment #4). The airport will use the Arkansas
Highway and Transportation Department's DBE directory to determine the eligibility of firms to participate as
DBEs in DOT-assisted projects, and the Fayetteville Municipal Airport-Drake Field will continue to honor the
certification completed by other entities as long as documentation can be provided.
In the event we propose to remove a DBE 's cerfification. we will follow procedures consistent with 26.87.
